None of the evidence that media is talking about stands scrutiny of the law. As per media reports, 17 people are involved in it and everyone takes the defense that their individual act does not contributed to victims death. How does prosecution prove that exactly whose act contributed to death? There is no way. Secondly, it is unsure from media reports whether criminal conspiracy is alleged or not. If criminal conspiracy is alleged, then since their act resulted in victim's death, it carries the same sentence/punishable similar to predicate offence. Now the question is what is the predicate offense here? Since alleged act took place in June 2024, it comes under either IPC 302 or 304 (Part 1 & II). Although, defense tries complete acquittall in this case, they will not be unhappy if ultimately lead to conviction under 304(II). Next, what could be the punishment under IPC 304(II) - this carries a sentence of imprisonment up to 10 years or fine or both. The conditionality is "OR" here. That means, there is a potential that all the accused if proven guilty under 304(II) may just serve some minimum sentence (let's take the midpoint of 5 years) and fine. It is to be seen how strong prosecution evidences are from the perspective of law, if it strong it may still go under IPC 304(Part I) and it is unlikely it will go under IPC 302. Given the background of some of the accused in this case and the competent lawyers that they can afford, and appealing up to highest court, anyone who is expecting anything dramatic is bracing for disappointment. Media needs to excercice some restraint and demonstrate the knowledge of applicable laws relative to accusations. As far as the bail is considered, once charge sheet is filed in court, the chances of getting bail increases. Probably, the accused Pavitra Gowda may bet the bail soon after charge sheet. Again, media report is unclear on alleged act under IPC 201 & 204, which may have implications on getting bail. But, generaly defendants have right to bail and excercising it after filing charge sheet, if otherwise not limited by IPC 201 & 204, are likely to get it.
