I am NOT an attorney but I do work for a law firm that handles civil lawsuits and insurance defense. This declaration went with a Motion for Summary Judgment, meaning basically they're trying to get dismissed/out of the case and this is their attempt to argue that they're not liable. Guarantee Jeff's attorney responded or is working on a response and they won't get out of the case because this is a long shot lmaoooo they called themselves out for sure. Also Ethan is right on the head that it seems they're trying to prove he's an employee so they can tender the coverage to their insurance company instead of money coming out of David's pocket. Anything for David to not be held responsible (potentially, allegedly). Terrible...

@@deemarlin it's not so much about Jeff having insurance, more so the company itself has an insurance policy to cover things such as lawsuits, injuries, accidents, etc. Similar to car insurance, they pay monthly for a company insurance policy. If something goes wrong, their insurance company will pay out damages, instead of David Dobrik LLC being fully on the hook for the damages. Hope this helps :)

I’m also not an attorney but I’m a law student. A motion for summary judgment doesn’t really mean that they want the lawsuit dismissed. It just means they want the judge to rule in their favor based on the undisputed facts of the case without doing a full trial (prob because a jury would be really sympathetic to Jeff). But yeah you’re right they want the judge to basically let david off the hook and say he’s not liable.

They are likely wanting to prove he was an employee so the lawsuit is against the LLC versus David personally. Which is the whole premise of an LLC (limited liability company) to protect your personal assets.

I work in WC insurance, it sounds like that the claim increased his insurance to insane premiums and could have potentially caused the carrier to cancel on him because some do if the insured has a “change in hazard” or loss runs are too high and may have threatened to cancel his insurance which makes it hard to get new coverage and could cost him more down the road. Also CA has their own bureau and tends to be tough on stuff like this as premiums are already pretty high out there. Some people pay out of pocket to avoid actually filing with the claims department for this reason or lie about the seriousness of the injury (happens mostly in construction). Also it makes sense why he’s saying Jeff may not have been an employee technically but even if he wasn’t, Jeff would technically be a 1099 if he is working for David with payments made to Jeff because I think anything over $600 that is documented in anyway counts as a documented agreement. I’ve seen text messages be used in court documents to verify employment and Venmo transfer to show forms of payments. I guarantee the state of CA did an inspection of David’s business and may have found other issues that they cannot share. I would LOVE to see that inspection report.

What normally happens is that the carrier will pay and then if they want (since they have to pay for it) request from the state bureau to do an onsite inspection of the full company to determine if a new code needs to be added or the insured is not mentioning the full scope of the business. I have a feeling since State Farm is also suing David, that they requested an inspection, found something, and now are saying uh you have to give that money back and most likely cancel your policy. Which for him is a huge issue and would explain why he’s trying so hard to not admit full fault on this.

That is factually untrue in the evidence section the rope was looped and knotted and both Corina and Jeff were seen in the video with their foot secured in the loop so they weren’t just hanging on with their bare hands. And because of this loop their feet were in this caused the accident to be even worse because Jeff was also trapped after the accident occurred because his foot was also stuck in the loop whilst Jeff was unconscious. It also caused his hip injury too

As the president of the David dickhead llc she should have company policy and procedures in regard to risk management and risk assessment which clearly they don’t have. So this should be in Jeff’s favour if he was an employee and there was no risk assessment done and such a devastating injury with lifelong implications occurred due to their gross negligence. Not sure about the states, but in Canada the workers compensation act is a no fault system, meaning if an employee is harmed at work they are entitled to compensation through insurance, but are unable to sue. I think that's why they are trying to say he's an employee

I hope Jeff stays quiet. He wears his heart on his sleeve and sometimes that can get you into trouble. Jeff should never have had to worry about being covered by Davids WC insurance just to have the necessary surgeries he needed after being hurt by David. He also shouldn’t have had to put off surgeries just to make sure the insurance company would cover the surgery. Doctors will not touch you if they aren’t going to get paid. Some doctors wont even work with Workmen’s Comp claims because of how difficult it can be to get paid.
