Day 3: Alexis Avila, child's father take the stand

I was 12 when I gave birth to my little boy; I was a ward of the state, living in a foster home that was harming me instead of protecting me. I tried to tell my social worker what was happening to me but I wasn’t believed. I didn’t have a good reputation. I was a wayward, problematic kid, a habitual runaway, I suppose I can’t blame anyone for not believing me… long story short: I spent the remainder of my time as a foster kid trying to prove to the State that I could care for my baby. I did everything they asked of me, took all the required classes… kept my life on the straight and narrow. When my baby was a toddler we finally found a foster home that would take both of us and I was able to form a relationship with him. I graduated high school early, with honors, enlisted in the Marines so I could get a grant to attend college. My sweet boy is 16 years old now; he is a thoughtful, intelligent, compassionate young man. My life’s ambition is to make sure he grows up to be stable and happy; understanding that, in spite of how he came to be, he is worthy of this life! My son saved me from a lifetime of bad choices, sadness and loneliness. I can’t imagine any woman, especially a fully-grown adult woman not doing everything to love and protect her child. I pray Baby Saul grows up to be happy, confident and successful ❤

There’s another case in New Mexico Alexee Trevizo who hid her pregnancy and was at the ER complaining of back pain and went into the hospital bathroom and gave birth but never pulled the cord for help. When nurses knocked to ask if she was ok she said yea. The bathroom was covered in blood and the cleaning lady found the baby dead in the trash and wrapped in a plastic bag. Full term. Yet her parents bonded her out. She was allowed to attend the last two weeks of school to graduate and allowed to attend prom with her boyfriend. I can’t believe that the school allowed that when thousands of teens are kicked out of school and not allowed back for verbal threats, or fighting! Yet a 19 yr old killed her baby and tried to hide it in the trash and was allowed to finish school and graduate. Come on your 19 and know that sex means high probability of getting pregnant. You know it’s a baby not a bug, not a alien. It’s a human being and the baby feels pain same as you and all of us. A baby did nothing wrong but be born to someone who didn’t love nor treasure them. God have mercy on your souls.

Alexis threw her baby in the dumpster at 2pm ish. What time was the baby found? I think from Hector and Aprils testimony it was about 8? That’s 6 hours in a double bagged trash bag. It’s a miracle and blessing this baby survived.

Yes it was around 8pm I think. It was definitely at night. It is a MIRACLE that he's alive. My goodness listening to the officers and doctors about how close he actually was to death is insane. His kidneys had shut down, and I think they said he'd reached that point where his organs had started expelling fluid which is what happens when someone dies. I think another hour or so and it would have been too late

And the Dr. who told her she was pregnant would have examined her, gave her paperwork on pregnancy, medical care, etc.! I was a wild kid with behavior issues, daddy issues, and i was in denial for the first 7 months of my pregnancy, but never in my wildest days did I ever think of getting rid of my baby or harming him in anyway. The prosecutor was harping on an oversimplified and frankly incorrect definition of blacking out. It doesn’t mean she wasn’t aware of what she was doing in the moment, it’s that the event was so traumatic that her mind blocked itself from forming a memory of the event. Her testimony didn’t do her defense any favors whatsoever.

Being a mom myself of two beautiful children who are 2 and 3. It is physically IMPOSSIBLE to NOT KNOW you are pregnant! They kick and move and cause pain when they are uncomfortable. My son loved to move and kick and punch I loved every moment of it. My daughter who is 2 sat on my cervix on her butt through the ENTIRE pregnancy all the way till her due dates. I had to have a c section with her. I could not walk with her and with both kids I was physically exhausted I couldn’t walk with my daughter everything hurt. My pelvic area hurt and popped every time I walk or moved or even sneezed or breathed too HARD! I still suffer with walking and picking things up that are too heavy bc my pelvic area still pops and hurts. I’m slowly regaining feeling from the area of the Surgery. From this unimaginable pain I have a very happy little girl. I spent 3 days to a week in and out of the hospital before the hospital finally did the surgery bc she want to be born now but butt first. I work day and night to provide for my children and get very little sleep just to make my kids happy! I’d do anything for my kids. How she could do this angers me to the pit of my stomach. I was 17 when I got pregnant and gave birth 18 when I got pregnant again and 19 when I gave birth. I was detached from my daughter for 3 months but still did everything I could for her while my husband took care of her I finally played with her after 3 months to overcome my depression and want to spend time with my child. I now have a very strong bond with both children that now when they see me they yell at me “MAMA!” “Mama night night?” “Mama bottle?” “Mama juice” “mama I go outside” and they snitch on each other I can’t imagine life without them. Even in my darkest moment I still provided and forced myself to overcome it through the love of my family and husband.❤ if she didn’t want the baby out him up for adoption.

But inmate justice doesn't really happen anymore. It's very rare. The prison doesn't want to be sued so they take precautions to protect them

If she doesn't tell them, a snitch or a visitor or a guard will spill the beans. Either way, she is going to have a very tough 16 years. During the interview she didn’t seem scared or concerned. She seemed very calm. If that was my daughter I would’ve been asking “what do you mean my daughter was pregnant “ and also “where is the baby” !

I sure didn't catch that! I was looking for an answer that would disprove all her BS memory problems, but I totally missed it. It would have been much more effective had the prosecutor jumped on that answer and pointed it out to the jury like the red flag that it was. I'm not so sure I can agree that her attorney "taught her to lie". I understand your point, but I also don't think that Alexis was an easy defendant to work with. But in the end I couldn’t bare giving my baby away when I delivered him. So small so precious. I’m so happy I made that decision my son is my world. Thank God the baby survived! I was seriously thinking there's no way the staff wouldn't try to rush that baby to a neonatal doctor to try to revive it. I saw a clip just a few weeks ago about a baby being worked on by a doctor for at least 30 mins. until that baby was able to breathe some air. It was a miracle and kudos to those doctors who will do anything and everything to save their patients. This baby was a true survivor. In 1963 I thought I was pregnant at age 18 when abortion was not a right (the previous time), and as a very immature student nurse, I knew I was not ready to be a mother. I honestly don't know what I would have done if that had turned out to be true and I had been forced to give birth, but I know what I wouldn't, and could not have done, and that would not have been to tie the infant up in a garbage bag and throw it in a dumpster to die. I might have sought the services of a Dr, who was known to perform illegal abortions at the time. I'm not in this woman's shoes, nor do I know her circumstances, but surely she was aware that there are options today like safe havens where a baby can be dropped off, or finding help from an abortion provider, anything other than the one she chose, but I do understand that poor decisions are made when one is young and scared. What she did was cruel and criminal, and so is taking away reproductive choice from girls and women. Keep abortion legal and safe.

@harryisamuggle I can only offer this: both of those ladies did their heavy laboring at home, with no drugs, with the ability to walk around. That makes a massive difference in how birthing can go. They were likely adrenaline-fueled. Also, when you are committed to keeping a secret, you do whatever it takes. No one really knows if there were complications or not, due to HIPAA. Generally speaking though, with a natural birth, no drugs, no complications... you can walk pretty quickly after giving birth. C- section, pain meds, or epidural is an automatic no walking (in the US) for safety reasons. Once they give you drugs, they won't let you walk due to safety. It can slow the birthing process.

She keeps saying I put “IT” in there referring to her new born baby! Absolutely disgraceful and repulsive of a human being! She deserves to be punished to the full extent of the law in my opinion! People like this should just practice safe sex! She should never be able to give birth to another baby for the rest of her life!
