These two characters are nothing alike other than sharing a name. DC’s Sorrow is a villain and his look, powers and background are completely different.

Lanterns have been tied to emotions for years and this was just following the pattern. Sorrow comes with tears just like happiness comes with smiling. The Sorrow looks more like Moon Knight, and aside from being Debbie Downer characters they barely have anything in common. You're not hearing Joseph Michael Linsner cry foul because his character had tears under her left eye (talking about Dawn) before this other guy's Sorrow. The Sorrow Lantern or whatever doesn't even wear a mask, he just cries comical amounts of fluid from his face. I'm personally just a longtime GL fan who's tired of (insert gimmick or new color) Lanterns. We've got everything on the ROYGBIV spectrum, Black, White, Omega, Gold, Ultraviolet, the First, the Phantom, and now Sorrow. The War of Light and Blackest Night were great stories, but DC can do better than just rehashing the ideas of Geoff Johns.

I'm pretty sure generic names such as Sorrow and Punchline etc. are not protected by copyright. The character looks different enough in my opinion to not be confused with the original Sorrow so Dc will be fine.

Copyright protects a specific work, trademark protects an element of branding (which is a large umbrella and includes character names). You couldn't effectively trademark a random word used as a character name unless you convince a judge that it's presence in the marketplace is unique and distinguishes a specific brand identity for that market. For example, "shadow" is a generic word but if I tried to create a vigilante crimefighter character called The Shadow, it could easily be found to be trademark infringement.
