I think a lot of concern of the legitimacy of the program is the lack of leadership buy in. Everything is coming out faceless. No leaders in my org (HHS) have shown support. Everything comes from departments, not people.

court case from 1990 in which the supreme court ruled that employees are not entitled to receive benefits/pay due to false information provided from OPM. They said that "no money can be paid from the treasury unless specifically authorized by a statute." There has been no authorized statute for this deferred resignation offer.

I don't think you had to take the Buyout (Deferred Resignation). Probationary employees that have poor performance may be targeted, but that is not now, but later.

This is just my theory based on general understanding of government authority and bargaining protections etc. 1. People will still be considered employed until Sept 30th which means they will be entitled to a paycheck, so budgeting decisions can't exclude these "deferred" resignations. 2. Our employer has the right to assign work, meaning they also have the right to NOT assign work. As the embodiment of the executive branch, the president is ultimately our employer, which means he has the authority to not assign work to people who accept deferred resignation. Now all that being said... most people I work with (at the IRS) don't really have a lot of job skills that would translate well into the private sector, so I don't think many people are taking this offer. I imagine this is largely true across the board. Many IRS employees have very specific job responsibilities and understand how to use very specific computer systems or are familiar with specific information on government forms, and none of that translates into a similar paying job in the private sector.

See OPM v. Richmond, 496 U.S. 414 (1990). Richmond lost this case because government agents are not liable for disseminating incorrect information. In this case, if the money never arrives, you likely have no recourse.

No you are supposed to be vested. Downside is your annuity will be based on your last three years and so the amount will be subject to inflation. Also you have to wait until 62 to collect the annuity

My parents were federal employees, and I retired from the FAA after 26+ years. There is no such thing as deferred resignation. An email is NOT an official offer. If you resign by February 6th .. voluntarily .. you are on your own.

Hi, I like to be completely clear on my understanding after watching your video, OPM came out with additional FAQ this weekend regarding employee eligible to retire under VERA, however my understanding is VERA needs to be OFFER to each employee by each agency, How do I know if my agency has this authority ? I have not seen any communication from my agency regarding VERA. All communication from local agency is regarding telework.
