Farm laborers are often not citizens so they have zero voice which is exactly why these industries hire them… they are desperate enough to do the hard work for very little pay.

@@julianvega2677- Desperate people do desperate things. There are people who try to flee to different countries that have a huge chance of dying. If you didn’t know, Diane isn’t better. People are willing to take risks. And sometimes the climate is different in countries as well. Letting someone take a little water break is not gonna be going soft. So for anybody to not want to have people take water breaks seems to be the heights of cruelty. And guess what, in case you don’t care about people that have darker skin, this also applies to us Europeans that work outside in construction and stuff.

​@@iMatti00 I've never needed a water break and I've spent 16 hour days, winter or summer, 40 below or 100 degrees above zero, working outside. It's called coming to work prepared for work. Not hard to carry a little liquid so someone doesn't have to inconvenience the entire staff by going for a drink every 40 minutes. It's called work, not daycare.

Just provide the water. People will bring there own water bottles. I work in a 85 to 100 degree shop. 12 hrs a day... Everyday. Ya gotta drink water. People bring there own bottles. Breaks are used to eat and drink coffee the bottle can be attached to you to drink water all day long as needed.

I did roofing for a decade, and what he said is correct. If you need someone to hold your hand and remind you to take your mandatory breaks, then whatever happens is on you. Every company for the most part is subject to osha, therefore your employer should have their Its The Law poster in the office and should have directed you to it at some point. Its up to you to read and understand what your rights are when it comes to safety.

@@bmass0828 Yeah, I used to work as a land surveyor. I think this is one that just 'sounds bad' to people more than is some kind of evil thing. Bri even noted it was to create consistency as opposed to confusing or contradicting ordinances. What exactly is 'protection from the heat and sun"? If everyone quits working when the sun comes out, nothing is going to get done. And if we continue to work when the sun is out . . . it's gonna be fine.

This is the second most likely. Overwhelmingly, people like Bobby are actually people who came from lower class situations and got lucky...they now look down on people who didn't make it with contempt because "If I could make it why can't they?" I've worked years in landscaping. Carry a bottle of water and wear a hat. No one is going to stop anyone from taking a swig of water and then getting back to work. Problem solved. It's not complicated

Read the actual language of the bill! All it says is that LOCAL governments cannot enact any crazy additional heat laws than the state already provides. The state is saying, what we provide is 100% protections, local governments cannot require 250% protection.

If there is one thing that local governments should not be prevented from doing is trying to help its citizens/ residents deal with the heat. A hurricane can come through and flatten a hundred homes and it might not be enough workers now because they've left the state or worse dead.

“100% protections” is laughable framing. They passed this because the state is super majority GOP run. Those protections are pretty weak which is why 20 year olds are dying.

Because OSHA is a thing already that mandates these things for you. All people have to do is read the paperwork your company gives you upon hiring, or go to the Its the Law poster that should be posted in a public common area and read it. Its not on Tina from Hr to remind you to drink water, take breaks, and to get out of the sun if you're working in extreme heat. Its more like, why can't people read, and why are people not aware there is already a thing in place to protect you. Maybe he's just tired of uniformed people doing the bare min and expecting everything in return.

After its investigation, OSHA cited McNeill Labor with one serious violation for exposing workers to hazards associated with high ambient heat while working in direct sunlight. Federal investigators also found that the employer did not report the worker’s hospitalization or eventual death, both of which the law requires be reported Looks like if someone had reported him using existing laws, this could have been prevented. Maybe know your rights instead of popping off the cusp.

From Bri's explanation sounds like they were trying to take advantage of a random tragedy to shoe horn in pay related regulations. I worked construction many years, the idea that it's your boss's fault if you don't drink enough water is ridiculous. Robby is simply not being manipulated in hurting those very workers (of which I was one) bc 1 person wasn't smart enough to take care of themself.

I'll explain it to you Bri even though you're supposed to be smarter than me. The Democrats went so crazy and fascist, that the Republicans became the lesser evil in spite of these draconian, awful policies. Democrats don't really fight these anti-labor things (they just voted to break a rail strike) so who exactly are people supposed to vote for that actually supports workers? There is no party or faction the materially supports workers. Your side gives lip service, and no substantial gains along with excessive regulations that hurt us. Unfortunately, Robbie the upperclass fake libertarian is right in this case. Our only power is to sit down and say no I won't work for you, but we need mutual aid in place to accomplish that. I should add that I'm coming at this from the perspective that the both parties are fascist, we lost the class war and need to acknowledge that and start from where we're at.

This is why I love to have Robby on the program. He does a beautiful job of giving us the classic, right-wing, Milton Friedman arguments (or pretexts) for a free market. And Bri comes out with the perfect arguments against them (which you can use the next time you run into a conservative). Every progressive economics teacher would like to have a student like Robby in his class.

My opinion, the government shouldn't have anything to do with it. It starts with the employees. No one can stop you from taking a break, getting water or having protections in place. Sonetimes you have to make your own conditions. Companies will only get away with what the majority allow them to get away with. Refuse to work if they make a fuss about breaks. Government intervention is unnecessary. Unified opposition is.

It’s a good question I was an A/C service technician and the charge to the customer was $65 dollars an hour in Florida at the time, which was what a service technician got in a Union. I’ve been on Jobs where the guy sweeping the floor made more than me plus retirement benefits. But groceries are so high now I rarely buy fruits and vegetables or meat. If unionized I think people like me on S.S. would starve. The only thing that saved me is I bought a home in Florida when it was reasonable. If not I would starve now. I would never have moved here if not for the low cost of housing at the time.

If you stand in the sun for 8 straight hours without drinking water, or taking a break, that is on you. You are entitled to those breaks, because they are already law. There are notices and vocal reminders everywhere to stay hydrated and not to exert yourself in extreme heat. Its not the governments job to remind you to be a mature adult and mandate how you act whilst working.

@@jayware4219 Its not their job to baby sit you. They also have a job to do. Every job is subject to OSHA regulations that should be posted in a common area for all to see. Meaning you getting breaks is mandatory. It is YOUR responsibility to monitor your body and know what is going on with it as well as knowing your workers rights.

Yeah, nuanced as in osha exists and too many people are too ignorant to know that you already have an organization in charge of safety and health that grants you mandatory breaks amongst other things.. Just because you need someone to hold your hand doesn't make his position less valid.

Yeah, I’m a in construction here in Florida. We take care of our guys. The narrative that labors are being denied water is just ridiculous. Because if you don’t take care of them, they’re gonna pass out on the job and you’re going to lose money. You guys are just assuming that status quo is draconian and it’s not. We have ice water, electrolyte powder, ice blankets for emergencies. This law would be completely unnecessary if it weren’t for the county level officials (none of whom have ever worked a labor job) demanding total control of construction sites and instituting rules that are crazy & counterproductive.

Back to pre industrial revolution work safety. That's exactly what conservatives want to see and attacking worker's safety is a top priority of conservative political parties. Considering Florida relies HEAVILY on immigrant laborers this stunt by DeSantis is targeted towards immigrant labor and minimum wage workers.

As someone whos worked outside in Florida most of my adult life, this kind of legislation pisses me off. One thing we keed to be mindful of though, is this doesnt prevent federal or state regulations from being enforced. Those regulations are pretty generous though. Framing this like "all workers are now completely helpless if they work outside" is false. We have the same protections we've always had, but this is (incorrectly IMO) not allowong local municipalities to increase those protections.

YEah, because osha isn't a thing. Tell us how he's the monster, when it is on you, and don't read either the paper work, or the osha poster that tells you your rights and all about mandatory breaks. IT not even about don't work there if you don't want to anymore. You already have a body in place to protect you, and most people are unaware.

What happens when all the corporations decide to band together and come up with brutal working conditions what can the workers do then, just not work and not eat! Government’s job is to protect the workers from harm, yes it has to be reasonable but asking not to die on a job sounds fairly reasonable to me!

The bill simple states that the individual companies need to comply with OSHA mandates ALREADY in place, to provide water, breaks and shade etc as needed along with other basic common sense work schedules. It took some digging but I found the actual bill online, it has nothing to do with withholding water from anyone, think about it….what possible good would it do to withhold water from someone you have working for you ? Making them suffering on the job and not able to do the work? That makes no sense at all. Why would anyone do that and more importantly what does DeSantis or anyone have to GAIN from proposing something like that? I think you just want subscribers to pay your KZbin dollars.

Well, Brie, this is the way things work in a “capitalist democracy,” which is a system of democracy (and socialism) for capitalists, wherein the function of law is to protect private property (i.e., capital) from the masses, who are workers: employed (i.e., used) as tools of their employers, the wealthiest and most powerful of whom do the same thing with the rest of the world, aka imperialism.

Robby is intelligent enough to understand that laws already exist and that you don’t need to add more. It’s not an issue of the roughness or softness of hands. It’s just reading comprehension and knowledge and common sense. It’s also about being driven by logic and reason instead of emotion.

what some of the commentors along with Robbie don't seem to understand is that water is probably being denied under duress most times, aka lose your job if I find you doing anything else but work. Of course, I wouldn't expect a set of people who never experience anything wrong because they are more than likely the perp more than they are not, to understand these things. If a company will hire a worker illegally, they'll probably deny water too. I'm sure this law is based in punishment of illegals...as usual the far right shoots itself in the foot. This definitely will make Desantis revered and the local economy boom!

I've worked years in landscaping. They didn't carry a water bottle with them to work and wear a hat. No one is stopping anyone from carrying a water bottle. Well, its hard to argue that particular point when Desantis won re-election in 2022 by almost 20 points in a former swing state. However, I think any workers should be granted the necessary bathroom/water/meal breaks... This is basic governing 101.

I got a feeling that folks on here dont know that Florida also doesnt protect for lunch meals, yet employers provide it. This is probably going to be another nothing burger but makes headlines because DeSatan bad. Companies understand that if they don't have employees they go out of business and have to provide certain things that society has agreed are needed, without government protection. The free market will decide.

Many employees prefer not having lunch break laws since most lunch breaks are unpaid. They would rather eat a sandwich during a 15 minute paid break than be required to take a 30 minute unpaid lunch break. Lunch breaks are how the 8 hour day became a 9 hour day. Some people prefer it, some don’t.

@@EndCorporateWelfare Agree. The problem is that if a state or municipality has a mandatory lunch break law, then the employer has to make you take it or they are violating the law. Mutual agreement, as you said, makes the most sense. Sounds like you are a reasonable boss.

@@EndCorporateWelfare I worked for a company that had a 9 hour day, with an hour for lunch. It was an office job and almost everyone was salaried. I brought my lunch to save money, so most days I ate a sandwich at my desk while working. The company got 9 hours for the price of 8. I could have sat there and read a book for an hour, but it seemed like a waste of time. My hard work was noticed and I often received good bonuses, raises and promotions. If I were required to take the break both the company and I would have lost out.

Agriculture workers aren't included in the Fair Labor Standards Act either so pretty much they can be treated as dirt and they have no recourse

Agricultural workers are not excluded from FLSA. They are also covered under OSHA. Protections may/ may not be adequate, but they are covered.
