Hey. I have to say Destiny. I am a right wing dude (libertarian). And I have to tell you: My respect for staying consistent. We don't agree on much but I can admit that you stuck by your guns and I can seriously respect that. I hope this charade of a case will be dismissed and rittenhouse goes free and I hope they counter-sue that prosecutor, because he almost abused rittenhouse to the level of interrogation tactics (repeating a question until you hear a response that suits you etc.). You are right on the algorithms part. However, there is a way to test the accuracy of something like that - by having an already scaled up image that is considered a representation of the truth - so if you have a blocky image of a dog and then an upscaled one. You can train an algorithm to upscale the blocky one as well as possible to bring it close to the upscaled one. That is in general... For court cases, that is fucking impossible to have as algorithms are very specific AND you do not have the ground truth - in this case the algorithm will just be injecting information into the image which can decide the case.

It was pretty much case closed for me the day I heard about. I found unedited footage, watched it, heard them screaming "KILL HIM", saw them TRYING to kill him, saw him running for his life, then finally he had nowhere to go, and had to fight for it. Everyone has a right to defend their own life.

i really am appalled at a lot of these leftists making fun of kyle’s appearance calling him a gross pig, a demon, making fun of him when he cries… it really shows how a lot of these people try to be so pro-humanity and anti body shaming but they’re fine blasting a 17 year old’s appearance and calling him a white supremacist without evidence all over the internet. he just turned 18, but that’s still super young to treat his beliefs like they’re permanent without ever hoping he can change and like it’s not a product of the environment he’s probably been around. people have got to stop being awful to others that disagree with them or saying their personal beliefs like they are the truth when it’s not factual with such confidence like some religious group because that’s the most unprogressive way to get people on your boat.

It's okay because they don't like them, if you don't like someone then it's okay to betray your 'ethical values' which you preach so strongly but hold so loosely, you're allowed to make fun of people for immutable characteristics. Don't like white people? it's okay to be racist against them, they're the enemy, look at all the bad stuff they do. I feel like anyone with a modicum of self-awareness should be able to see the flaw in that reasoning but it's reinforced so much by their group that the idea that your reasoning might be flawed is immediately rejected. These people would have been Nazi soldiers in Nazi Germany without a second thought, it's the exact same mechanism that occurs in their brain that allowed Nazis to justify the shit they had to do in their regime on a daily basis and a lot of them would have believed everything they were doing is 100% justified. I'm not saying the left is nazis and I don't mean to equate making fun of Rittenhouse to being a nazi, just saying they express no strong individual values whatsoever - their entire belief/values system is a slippery ball rolling around a roulette wheel. These types of people have absolute no integrity, their values are a facade they don't even try to most of the time and they suffer from such intense main character syndrome that any level of introspection would probably keel them over in pain.

One was 15 days prior, without a weapon, to a friend in passing in private saying "I wish I had my rifle to stop those thiefs". Versus in the moment, in a dangerous and illegal setting, charging and chasing down a child while screaming the N word and saying you are gonna kill them if you catch them.

You can absolutely submit new evidence if it comes up during the trial. But it does have to be submitted to the court prior to being used as evidence so that the defense has an opportunity to examine it.

You can’t.. you can’ only to the court but it has to be approved by the defense. Its not like the movies. Both sides have to agree on teh evidence before the trial. Just like they agree on teh jury.

Worked as a microscopist and image processing software developer for years. Even pixel scaling is interpolation. Some interpolation methods are less "lossy" than others, but all digital magnification require interpolation (mapping image pixels to screen pixels). The naive way to interpolate (as seen near the 37:00 mark) on most computers nowadays is bicubic interpolation, which just smears the image by finding the average between neighboring pixels. Usually motion gives much better visual information over a series of frames, but if you're using bicubic to enlarge such a small area of an image, you're asking for a high level of burden of proof on your end. Even if they showed nearest-neighbor images (integer scaling that results in blocks of pixels), it would be nearly impossible to tell much information about that particular image. "Enhancing" footage for forensics is about as movie-magic as you can get. Edit: That's not even to mention the fact that most cameras are encoding video with lossy codecs and adjusting for low-light.

Anyone who didn’t come out thinking Kyle defended himself is intellectually dishonest, yes. They have to bend and twist the facts to an absurd degree to keep the narrative intact. Imagine there are still people out there believing he shot black people, and was running and gunning down the street. They think he only managed to kill three people, and that it’s basically a miracle that he didn’t kill more. They haven’t watched anything, and still think they know more than us. That’s actually some of the scariest shit I’ve heard in a long time. Totally ignorant people judging others without looking at a single fact, and they are not even aware that they know less than shit.

Something I enjoy about Destiny since I’ve moved away from conservatism is that he’s incredibly consistent on things that go against the mainstream left’s narratives. People like Hasan and Vaush have to bend over backwards in order to pacify their communities because takes that Destiny have would literally destroy them, so they HAVE to spew misinformation. Seriously, props to Steven for staying incredibly consistent, it shows he really does have a fucking backbone.

I watched the whole trial and I remember people saying the judge was so biased. He was mean to the prosecutor. That couldn’t be further from the truth. I wish everyone would of watched some of the shit these guys pulled to get a win. It was really gross.

I especially like their scenario. So Rittenhouse is right handed. According to the prosecution, he went to that gas station. Set down the fire extinguisher, calmly as they make sure everyone understands and then proceeds to grab the rifle with his left hand at the grip and using the right hand to stabilise the barrel, while the gun is still slung around his neck. Additionally the 10 or so people around him react to this "brandishing" in no way whatsoever. I mean there is reaching and then there is reaching.

True. Destiny has some pretty god awful takes... but he never obfuscates what he is actually saying behind buzzwords and bullsh*tery. I'm a huge Sargon fan, and I'll speak for a large majority of us in saying that we are also fans of Destiny and his candidness. The best kind of adversary is the kind you can actually respect. I'd definitely share a beer with Destiny and that's rare in a 'political adversary' these days.

As a photographer who knows a bit about the differences between cameras and phone cameras I second that photos taken with a phone even without any interpolation or other change to the image should be approached critically in a situation like this. The amount of processing that a phone does nowadays is ridiculous. Particularly the sharpening done to high megapixel images often creates all kinds of artifacts that could look like anything if looking at it at 100% scale. Video would likely be less problematic, but every phone model and app used for recording needs separate evaluation. Phone cameras are not aiming for any kind of accuracy, but general pleasingness.

We are talking about 4k drone fottage. Not Phone cameras, not photographs... Guys, the video shows Kyle lifting his gun but the video isn't clear enough for a 75 year old to see the action... everything else is just opinion and distraction. Why are we having all of these irrelevant side debates on how using images in court is terrible to begin with? This is just frontloading an argument because you are scared what the answer may be or what the jury could see in that video. If the video isn't clear enough then there should be ZERO need for you or destiny or anyone else to bring up further argumentation as to why photography etc is bad evidence. But here we are... and you can ask yourself why that is. Why people are bringing all of these things up to load onto the argument. Just let the jury decide instead of playing all of these weird American debate style games. wtf

1 key differences between Kyle saying he wished he had his gun and Rosenbaum saying if he got him alone he would kill him are that Kyle didn't tell the shoplifters he wanted his gun (he said it to a friend he was sitting in a car with) so he didn't even express this to them. It's hard to threaten someone who has no idea you even exist. Also, it's hard to show "state of mind" with a video that's over 2 weeks old. It's one thing to be sitting safe in a car with a friend watching from across the street, it's another to be walking through a city with all the crazy surrounding you.

@@55Noco I think the argument is not the Kyle used deadly force to protect property, but instead that Kyle brought the gun to threaten protestors in order to defend property. If Kyle used the rifle as a way to threaten protestors, this would enact Rosenbaum's right to self-defense. Even if the gun was not fired until he felt his life was in danger, I think there is an argument that the only reason why Rittenhouse needed to use self defense was due to his threats against protestors who acted in self defense against someone threatening them with a gun. Now, I don't think this will stand in Wisconsin due to open carry laws. However, I think it is incredibly unlikely he brought the gun for self-defense over using it as a threat of violence to those wishing to destroy property.

That is why a mistrial might happen. Trying to imply that use of 5th amendment means guilt is a big fucking no-no. But that argument was used in front of trial and could have biased them. Hell, even if a mistrial doesnt happen, Rittenhouse definitely has the grounds to appeal just based on that.

omg whats so funny about this is the prosecution doesnt seem to realize he is literally listing off all the crimes that the protest/rioters were committing when he was asking the hundreds of "you agree you cant use deadly force to protect blank" questions. i feel like theres a better way rather than telling the courtroom these people were lighting this on fire, breaking this, burning this, destroying this etc. Maybe its just me, but as a juror this would probably make me view the people in a bad light after being reminded of how destructive, belligerent, and reckless they were that night.

@@FBvio inferred? the whole point of a fair justice system is to give the accused the chance to defend themselves, if you can assume that someone is guilty or guiltier because they refuse to speak to investigators, that is ridiculous. why would a justice system be fair if you were allowed to legally assail someone in court simply because they wished to remain silent under inquiry during pre trial investigation? is silence evidence? obviously not. you also make no valid point regarding spoliation, there are already restrictions against the destruction of evidence both in the us and uk, and you can still draw adverse inference from an instance where these are ignored and evidence is tampered with. besides, how do you know i'm american in the first place?

There is no video of the first person he shot. The problen with America's laws is that it is possible for both sides to claim defense. The peoplr chasing Kyle can argue that they thought he was a danger to their lives because he had already shot someone and was running around with the gun. And Kyle can argue that he felt his life was in danger since these guys were chasing him even though he had a gun. The reality is this case hinges in the initial confrontation, for which we have no video or evidence. All we have is Kyle's word, which is obviously not trustworthy. He says the first guy he killed started the confrontation and the other guy can't argue with this because he's dead.

The first confrontation is the Rosenbaum guy who chased Rittenhouse and throws the bag at him while someone behind him fires a pistol into the air causing Rittenhouse to turn around at which point Rosenbaum (no idea how to spell) catches up and tries to take the gun away from Rittenhouse. Rittenhouse tried to flee the situation, I have no idea how anyone can believe this is anything other than self defense.

I think it's already insane that kids are allowed to roam in public with firearms even under supervision. That in itself is a failure. On top of that, Rittenhouse was isolated and left on his own, at night in an already dangerous situation. I think every single adult that was supposed to look out for him, from the organizers to the parents, completely failed him. He could have easily got himself killed that night. As for Rittenhouse himself, I saw the footage. I'm telling you right now, if I had somehow been in the same situation he was, there would have been a ton more dead bodies out there. I'd have been taking shots at anyone who even looked at me sideways, purely out of terror. And that's now as a 30 year old, let alone when I was 17. I think Rittenhouse himself handled a difficult and scary as fuck situation exceptionally well and it is NOT him who should be on the stand in court, it's the organizers of his group and his family. The so-called ''responsible adults'' who allowed for him to be in that situation.

@@Zach0451 17-year-olds are only large children. Rittenhouse was a child and should have been under someone's care, but it is hard to contain a 17-year-old and I get that as well. About the trigger happy part. Imagine yourself in Rittenhouse's shoes given his situation. You carry a rifle and people around you are shouting for your death, some people even charge at you with skateboards, broken bottles and guns. Are you to say that you even at your apparent advanced age would be able to contain that trigger finger for anything approaching the level that Kyle did? I would not. Most people would not. Them acknowledging that fact with some level of hyperbole is not a show of weakness on their part. You are weak for calling them out as if they are.

about interpolation at around 37:30, everytime you display an image at any scaling that isn't an integer, you don't have a clear pixel correspondence. You could as well try a clear image with pixel perfect fonts, enlarge it by a factor that won't allow 1px to convert to an x by x grid and shrink it back to the original size. You will see that the font actually lost a lot of sharpness. If you save files in between it gets worse and even returning to original size after doubling each axis, you will also get a blurrier result. The only difference about browser/software based zooming of an image file is, that the 'damage' by interpolation is temporary, as you're always keeping the original source, that you're scaling off of. If the presented frame of that video (not to mention low-light, camera based compression, encoding compression) is actually close to what's being discussed in court, interpolation shouldn't even be the topic. 1 pixel in the original file is the normalized error, that you will never get over and no amount of tech could solve that. Describing that dark pixel mesh as a human being is the most you could possibly guess without getting to deep into visual bias.

The correct way of presenting the footage to the jury IMO would be to go through the footage frame-by-frame, zoomed in using nearest-neighbor. I think the context added from a temporal component would inform an observer way better than any single frame upscaled. Even if it's only 5 frames. IIRC the expert who did the upscaling used almost a substitute for this by averaging the color of a number of frames, and then upscaling that with bicubic. Ironically enough, the image destiny got linked already looks like it's been bicubically upsampled. Also, the part where destiny talks about "inherent interpolation" on hardware is bullshit. If you tell a GPU to put a pixel somewhere, it will do it. Interpolation is configured by the programmer.

@@Brosyphus A mistrial would allow the exact same case to be brought up against Kyle in the future, which is what it appears the prosecution is attempting, since a lot of things have gone against them. This is also why the defense brought up a motion for a mistrial with prejudice, which would prevent the state bringing the case again.

I was spraying the front yard of this nice house, and my head was baked. Not the good kind of baked, since I don't smoke weed. Just the sun-broiled kind of baked. It was a pine tree, and the pine cones were tiny and green and not emerged just yet. So yeah, they did kinda look like pickles, but they were pine cones. @@JennyDarukat student loan forgiveness is a poor idea because there are alternative life paths besides university and people who chose a military career, vocational school, being an entrepreneur, or some other career path and taxing them to pay for your personal development is morally wrought. What should be done in my opinion is two things. First better auditing of how public institutions spend their money and limit some of the wages paid to bring the average tuition cost down to a more reasonable rate. Second, legislate against a lot of the predatory student loans that issue interest rates that are absolutely agregious.

@@pommiebears Being charged as an adult is not the same as saying you are an adult. it means the seriousness of the crime or action requires they treat you like one because of the seriousness, and the defendants ability to understand the seriousness. It's only conflicting if you keep focusing on the word "adult" as some sort of gotcha. The only one confused here is you.

People are acting as if kyle was running around shooting rioters in defense of property. No, he was standing guard offering aid & defense. Also, someone did practically ask him to defend his property or at least heavily implied it. At no point did kyle ever engage on someone for damaging property. Only after people attacking him did he ever even raise his weapon.

This judge did an amazing job. He allowed the case play out to its conclusion with a jury decision on all remaining counts. However, if the jury would have come back hung or with a guilty verdict on any of the remaining 5 counts, he left the misconduct in his back pocket and would have used it in a "mic drop" moment, and perhaps retired to put a cherry on top because this was a horrible display of humanity from some of the countries leaders. This was the right verdict but it showed how horrible people up to the head of our country act politically and have nothing to do with the way this country was founded. So sad. Everyone who holds public office should have to pass a constitutional test.

prosecutor arguing that its just like a magnifying glass is just objectively wrong. It absolutely IS possible to simply scale up the blocky pixels and get a 1 to 1 accurate zoom but that isnt what happens in your i-phone. If you want to zoom in to a picture on nearly any currently available commercial device then there will be some interpolation applied to smooth out the edges on the magnified pixels so that the image doesn't look blocky. He's either being bad faith in saying that its "common sense" when he knows its actually a common misconception or just wrong. Judge is absolutely correct to put the burden of proof on prosecution.

I had never considered this until Destiny said it. Everyone who was flaming Kyle said "oh he shouldn't be out at night, he shouldn't be leaving his state". These same people tell me we that kid running with a gun from police last year had every right to be out at 2AM and he got profiled, or that immigrants shouldn't be harassed for entering illegally. They are literally coopting righty rhetoric against Kyle because he is white.

At 1:01:31 when he’s talking about pinch and zoom adding data the prosecution later also clarifies that they are conflating a different program that was introduced later. The prosecution should have said “if pinch and zoom added data then the file size would change.” But this is also a widely accepted practice and odd to have to defend in court.

Honestly... I'm so confused about people complaining about him having a gun... I believe he was idealistic at best with intentions of lowering the damage caused to property in this case but, nonetheless, he had knowledge that there were violent and dangerous acts being perpetrated in these "peaceful protests". With that in mind, being that he was asked to protect property from damage, if no one showed up with a weapon the entire line of good samaritans that are preventing improper violence and protests would have been mauled by the "protesters" and what would have been prevented? Nothing. They would have been the bad guys in the scenario to the people that believe their right to peaceful protests includes the right to destroy whatever they want. They would have been opposition and the gun is the only thing preventing these people from steamrolling the entire group to ascertain their version of "justice"

@HB I'm glad to point out that this was both illegal AND immoral. This is not always the case. For example, Rittenhouse will clearly be found not guilty for killing 2 people. Putting himself into the wet dream fantasy of conservatives, to kill someone in 'self-defense' is incredibly immoral.

This is a young man who, after having shot someone threatening his life, sought out local police to turn himself in. Police told him to get lost. He then went to a police department further away from the rioting and turned himself in again. This Kyle guy who was placed in a no-second-guess situation and was eager to inform authorities. This is not a murderer.

If I witnessed a looting, I'd wish I had my gun. It also, in the mind of kyle, could've been more than 'just a looting' for all he knows. He also said it in a pretty obvious sarcastic manner. He also never said it directly at the person & chased him lol. Why the prosecution thinks this is at all comparable to an active felon who said he was going to kill kyle prior, chased after him, and lunged for his weapon, is beyond me. It wasn't a direct, imminent, or capable 'threat'. It was an outburst of emotion after watching a POS person rob & destroy another's livelihood before his eyes. His lack of any violent history or crime it testament to that fact. Presumption of innocence. He's an emotional & moral kid. Completely get it.

1:24:00 H264 is most common, before that the most common was MPEG-2, H265 is newer and its fairly rare, VP9 is barely used outside like open source stuff and browsers cus it was basically just created as a non-patented alternative to other codecs

A real key question is "How easy is it to manufacture a scenario in which one credibly fears for ones' life for one to two seconds?" It's probably beyond the scope of the law, but it is materially and sociologically relevant. For instance, if Rittenhouse entered a black church service with his AR15... would the reaction of the congregants at any time become a sufficient reason to use the gun in self-defence?

Uhm. It’s private property so in that scenario (assuming guns aren’t welcomed or at least they’re suppose to be concealed), church patrons would legally have to fear for their lives before they could retaliate. Not a legal and it varies from state-to-state ofc. Just because someone has a firearm, doesn’t mean you can just shoot them immediately. Private property or not.

@@6Churches This is meant in regards to the legality of carrying the firearm. You might have the right to bear arms in public in your state, but on someones private property you have to adhere to their instructions. So if they tell you "no gun" then that means no gun. If the gun bearer then were to proceed to go in despite being instructed that would actually allow folks in the church to use self-defence.

I don't at all agree with the notion that you can't use deadly force to protect property. People have fought wars throughout man's existence over property. If there is a woman that lives alone and someone breaks into her house and starts stealing stuff, she calls the cops and they tell her they aren't going to intervene, what is she supposed to do? She can use "non-lethal" force? She's supposed to try to wrestle a grown man or physically remove him from her house herself without deadly force? Never mind the fact that you can kill people with your hands. This whole incident happened because the police were NOT protecting private property on those nights. What are the owners of that property supposed to do in that instance? Their insurance did not protect them from damage caused by rioting or looting so they were 100% liable for any damages done to their properties. People think they should just sit there and "take it"? That's absurd. In the absence of police, you absolutely have the right to defend private property with deadly force.

Zooming will certainly change the image if it was not captured in sufficient resolution. It depends on the image whether the zooming provides a reliable reproduction or not and for this you need an expert on the algorithm used. There are really good zooming algorithms. Most of the zooms are just the average of neighboring pixels, which creates the blurry effect.

Think about it like this, the positive the judge is asking them to prove is that the photo is an accurate representation (while zoomed in) this means they have to proof that there was no addition and/or subtraction of important information from said picture.

The "prove a negative" fallacy applies when someone asks you to prove that something that didn't happen didn't in fact happen and it is impossible for you or anyone else to replicate the conditions at the time of the event in order to prove that it didn't happen. Let's say, prove to me that aliens never visited earth. That is an example of "prove a negative" fallacy because it is impossible to prove something that never happened never really happened and it is also impossible for you to create a situation where you can prove aliens never visited earth, in order to do so you would have to idk, make aliens come to earth and then show everyone "see, when aliens visit us you ear this sound, you see that ship over there, the sky burns, whatever" idk. In this case tho, it is possible to prove that image X was not altered/suffer alterations from some software because you can replicate the exact same conditions with another image or with the exact same image if you will, thus proving if it did in fact happen or not. Proving negatives is something that you constantly do in science, so i don't know wtf are you even talking about.

the pinch to zoom discussion was fascinating. I think they were right, unless its absolutely on native hardware and you're looking at the RAW, its already been altered by processing and interpolation to get it to fit the display. That's where its up to the expert to explain how the image processed does not alter the intent of the image enough to change a meaning. That picture is so tiny and grainy its dang near impossible to determine anything.
