Thank you for posting. I wanted to put my house in a trust for my daughter to avoid capital gain tax in cause she decides to sell it when she comes of age. I still owe on the mortgage however, what would be the best option to pursue?

Hannah, as long as you are the lifetime beneficiary of your trust (and certain other restrictions, but that is the big one), placing your home in a trust will not cause a problem with your mortgage. if i was the Creator and Settlor of an irrevocable trust with a pour-over will and i transfered an asset into the trust, open up a bank acc for the trust and then settle the trust is it true as settlor not having any connection legally to the asset and trust?

If someone else was trustee and depending on the terms of the trust, you wouldn't have legal control. I think there would still be some situations in which you would be considered to have a legal connection with the trust assets. You would want to consult an attorney in your jurisdiction about the specific scenario you have in mind.
