Procedure for warrenty case is prescribed under chapter XIX and summons case is prescribed under chapter Xx

Namaste Sir, Suppose, I am CJM and I have recorded statement of a victim/witness under section 164 of Cr.PC. Now, 1. am I eligible to try this case ? 2. Commit the case to other court equivalent to CJM? 3. Or keep the case in abeyance till next CJM joins? Please make a detail video with examples of Supreme court judgements or reference.

Major difference and most controversial difference. In warrant case magistrate can discharge the accused but in summons case he cannot.😊

Rules may be there but when the accused or witness not appearing before this court to participate in trial, the court has power to issue warrant in any case to compel appearance. What do you think Sir?
