Discovery Process In Personal Injury Trials

Hi! Just saw your youtube on discovery. The question I have is just because you assume that a medical product is why I got sick does discovery start then? Does that mean my 2 year SOL starts then? Or what if being sick/ trying to get proof held me back took me time to get proof. Can I still get statue of repose of 10 years?

Another question 🙋‍♀️ is it too late to switch lawyers when your in litigation? If you do switch will the lawyer take all your money or put a lean on your case etc

It’s not too late. And no the lawyer doesn’t take any of your money. It never costs a client even 1 penny to switch

Your awsome. Great info Doctor Frekhtman. Question, If insurance offers a significant settlement, is it ultimately up to me to accept or denie? Can someone still go take it to trial even though the attorney doesnt recomend doing that because it would could be detrimental to losing everything on the table? In short, can someone take it to trial no matter what and what amount? I was a passenger in a legally parked car in the parking lot and a sheriff ran into the back of the car not chasing anyone or just ran into the car. The sheriffs car had dents, broken glass everywhere from the headlights and scraps during his deposition he lied and said he hit me at 5mph the car I was in was rocking back and forth after he hit it and before he hit I was up on the middle part in the suv reaching to the back seat to grab my bag when he hit it threw me to the front passenger hit my head on the dash. My back,neck and left leg was hurting I had headaches and ringing in my left ear I got epidural shots but my disc went from 3cm to 6cm and had to have surgery to fix it but I’m still in pain I can’t sit or stand for long my back aches and my leg goes numb. Do you think they will get out of this because I know he couldn’t have hit her car going 5mph and they had me go see a medical examiner idk this is stressful

That sounds like the sheriff is at fault for hitting you. As long as you have a strong trial attorney you should be ok.

Just means a new firm will be handling. It isn’t good or bad unless you know the quality of each firm then you can evaluate. They do it for a variety of reasons. The insurance carrier usually decides

@@AttorneyArkady yea so case was filed in 2021. And so far there hasn’t been any mediation or settlement talk. I just thought it was curious they would substitute at 3 months before trial.

I recently was miss diagnosed in the hospital after being struck by Truck they told me there was absolutely nothing wrong with me except for soft Tissue damage and come to find out late after getting mri they told me i had a compression fracture of my t12 vertebrae do you think i have a malpractice case

The issue you will have is proving what injury you suffered that was caused by the hospitals mistake in misdiagnosing. You already had the T12 fracture caused by the truck crash so best bet is to file suit against the truck and that should be a great case. Good luck.

Hello Sir, I had two surgeries cervical fusion as well as a lumbar discectomy I had a deposition a few months back. My attorney has informed me that the defendant lawyers can not find the person that rear ended me. I’m scheduled for mediation in September.Being that the worker that was at fault wasn’t deposed, will that effect my case in a positive or negative way and why?

Usually if the defendant does not testify you win on liability so it’s very good for your case.

Arkady….thank you for the insight and calm, over the past year, as I wait for my case to progress. It has been over 2 years and I will finally be deposed in 3 weeks. I have a very good trial attorney but have never felt that I could ask everything I’ve wanted to. It was as if I’d be told when it mattered….lol So, I have immersed myself in KZbin since. I also think when policy limits are high, it is such a waiting game. Like a Bad neighbor, you know who is NOT there. One thing I wanted to mention…the defense attorney is a Plaintiff’s attorney too but seems to be SF’s main man in my area. I noticed this online when I saw alllll of his other cases beneath mine on a public website. How can this attorney get to know every case and expect to go to trial, if needed, when he has so many cases in a short amount of time?
