Det stemmer. For eksempel; om man forsøker å smugle noe man tror er amfetamin, men det senere viser seg at det er koffein. Blir man straffet for forsøk, jf. HR-1993-105-A og straffeloven § 16.

Hadde sjåføren vært smart hadde han ikke sagt noe og tatt det til retten med advokat. Kunne da ha argumentert at han ikke viste om dårlig håndbrekk og ikke fått like hard straff.
