That's necessary under section 230, without it those platforms wouldn't exist and none of the influencers whining about it would have an income. The imbalance between (privileged) big corps and smaller channels is the actual issue. Which, at it's core is due to the US legal system's flaws when it comes to slap suits and litigation costs.

that’s indeed how the function works and they let you know that in advance. due to how copyright law works etc they have to pull the plug and you have to retroactively prove your innocence etc. The problem with the system comes in that it’s highly automated and multiple strikes can be awarded simultaneously, so actually addressing and arguing your case can be quite difficult if you can’t get a hold of a real person

You have no idea unless you've actually been wrapped up in the criminal justice system. You find out real quickly just how much you don't matter, and nothing you have to say will ever be listened to. A complete and total hapless victim flapping in the winds and if you don't believe me then I implore you to go out and even just be accused of breaking the law to find out . And if the presumption of innocence is actually in your corner to begin with then why do they arrest you? Why do they put handcuffs on you? Why do they take you down to the police station and get your fingerprints and every other bit of information they can possibly get from you? That doesn't sound like how an innocent person is treated?

If memory serves, there is a (now) antiquated SCOTUS court case that governs the play of copyrighted music, and it allows for a certain number of seconds that are considered essentially "fair play" in the public domain (although KZbin is a whole other context/story, i'd suppose....) I'm a law nerd but certainly not a lawyer, but this ought to be right up "Your Lawyer Friend, Zac's" alley, no?

I imagine the reason KZbin does not adopt the sort of forbearance plan for creators with a good reputation that Aaron suggests they do is because there is no real reward for them to do so. In a copyright lawsuit, or any other civil lawsuit, the plaintiff will target the deepest pockets and most KZbin creators do not have assets worth pursuing. KZbin, on the other hand, is Google (Alphabet, actually) and they have some of the deepest pockets among the world’s corporations. That means there is plenty of incentive for copyright owners who believe they have been violated to sue because regardless of the creator, KZbin is always a party to the violation -- if there is truly a violation.

When I watched the replay later in the day after the stream was over with I could see you and and everything that was blocked live i guess, so kinda odd.. the whole process is broken here on YT, it is biased against certain groups and in this type of case it is a way that YT benefits from revenue and the creator losses.
