DIVORCE ON AFFIDAVIT
भारत में affidavit पर divorce तलाक मान्य नहीं है (No, a divorce by affidavit is not valid in India).
कानूनी प्रक्रिया जरूरी (Legal Process Required): भारत में तलाक के लिए कोर्ट प्रक्रिया जरूरी है (In India, a court process is mandatory for divorce). The Hindu Marriage Act, 1955 और Special Marriage Act, 1954 जैसे विवाह सम्बंधित कानून (like the Hindu Marriage Act, 1955 and the Special Marriage Act, 1954) कोर्ट के जरिए ही तलाक की अनुमति देते हैं (laws related to marriage allow divorce only through the court).
Affidavit की भूमिका (Role of Affidavit): हालाँकि, affidavit का इस्तेमाल आपसी सहमति से तलाक (mutual consent divorce) के लिए किया जा सकता है (However, an affidavit can be used for a mutual consent divorce). ये affidavit समझौता पत्र (separation agreement) का हिस्सा होता है, जिसे कोर्ट में पेश किया जाता है (This affidavit becomes part of the separation agreement, which is presented in court).
कोर्ट की मंजूरी जरूरी (Court Approval Needed): अकेले affidavit तलाक को अंतिम रूप नहीं दे सकता (The affidavit alone cannot finalize the divorce). कोर्ट को इस समझौता पत्र को मंजूर करना होता है और फिर तलाक का फैसला सुनाना होता है (The court has to approve this agreement and then pronounce the judgment of divorce).
DIVORCE BY NOTARY
नहीं, नोटरी से तलाक भारत में वैध नहीं है (No, divorce through a notary is not valid in India).
नोटरी की भूमिका (Role of Notary): नोटरी सिर्फ दस्तावेजों पर हस्ताक्षर करवाने और उनकी सत्यता प्रमाणित करने के लिए होते हैं (A notary's role is limited to witnessing signatures and verifying the authenticity of documents). वो किसी भी तरह से तलाक को वैध नहीं कर सकते (They cannot in any way validate a divorce).
गलत धारणा (Misconception): कभी-कभी लोग सोचते हैं कि स्टांप पेपर पर सहमति से तलाक का लिखा हुआ दस्तावेज नोटरी से बनवा लेने से तलाक हो जाता है (Sometimes people mistakenly believe that a document prepared on stamp paper with mutual consent for divorce and notarized is valid). ये दस्तावेज कानूनी रूप से तलाक को मान्य नहीं कराते (These documents do not legally recognize a divorce).
PANCHAYATI DIVORCE
भारत में पंचायती तलाक को मान्यता नहीं है (Nahi, Bharat mein panchayati talaak ko legal मान्यता (maanyata) nahi hai).
पंचायती फैसलों की सीमाएं (Limitations of Panchayat Decisions): पंचायतें स्थानीय मुद्दों को सुलझाने में अहम भूमिका निभाती हैं, लेकिन वैवाहिक मामलों में उनके फैसलों को कानूनी तौर पर मान्यता नहीं दी जाती है While Panchayats play a role in resolving local issues, their decisions in marital matters do not hold legal weight).
हालिया उदाहरण (Recent Example): दरअसल, पंजाब और हरियाणा हाईकोर्ट ने 2021 में यह स्पष्ट किया था कि पंचायती तलाक कानून की नजर में वैध नहीं है (In fact, the Punjab and Haryana High Court clarified in 2021 that a Panchayat-mediated divorce is not valid in the eyes of the law).

If customary divorce is given on stamp paper and notary then it should be valid under section 29(2) of Hindu marriage act.

If there is any such custom then stamp paper or notary is also not required.....they can never be part of custom.....moreover if parties cannot prove custom then it becomes invalid....
