It's true... and disgusting. And outrageous. However, sentencing guidelines were different back in 1979, especially in California, so he probably would have been a free man in fewer than 5 years. He likely would have spent the remaining 30 years of his life carefree and happy.

DNA testing is expensive, takes time and unless the sample is good it might not match. In 1990 it was a new thing so obviously people weren't gonna rush to it.

DNA evidence was successfully admitted in court 6 years before this case, and the FBI built a national DNA database 2 years after this case. You're 0/4.

It may be a manpower issue. With no new evidence, the 1979 case is already on the backburner. Unless they suspect the dead man of committing a specific crime, there is no immediate connection to verify. There is no urgency to stop a dead man from committing future crimes. More recent crimes that are more likely to be solved are being focused upon, while additional crimes are being committed everyday.

Can’t even say it because there is so much codd ling going on. Deal with reality. This is all in the past too. The 60’s-90’s was certainly a time where you are probably correct but you’re not correct about the victims. Victims very often the same ethnicity as the attacker. Also. 75% of the country was the guy in the vid back then. It’s like 65% now and even less in CA.

I do not understand why. All they had was an anonymous tip, which "somehow" ends up with someone taking a polygraph test. That person passes the test and DNA is not a factor in criminal cases yet. As an innocent person, do you want to be locked up for simply leaving an "anonymous" tip? As an innocent person, wouldn't you want passing a polygraph test to clear you of guilt?

Polygraphs are pseudoscience. I've taken three of them in my life. They use interrogation techniques and an uninviting atmosphere in order to make the person taking them uncomfortable. If you ever take one, ask yourself why the room is ice-cold. The reason is two-fold: to prevent perspiration due to heat (because polygraphs measure perspiration), and to make the person taking the polygraph as uncomfortable or unrelaxed as possible. Psychopaths and sociopaths can pass polygraphs fairly easily because they have no guilt responses to questioning. The don't even feel like they did anything wrong, no matter how heinous or obvious the crime.

This is an honest question, not a contradiction. I have no knowledge about polygraph tests and do not understand the ice-cold room reference. Unless I misinterpreted your statement, it seems you are suggesting that the test is intentionally set up in an uncomfortable atmosphere to enhance failing the test. If polygraphs measure perspiration, why would preventing perspiration by making the room ice-cold be beneficial? It would seem the other way.

This is why polygraphs aren’t relied on much today. I can pass a polygraph while lying, because I’m indifferent about whether I’m telling the truth or not. Though once considered a reliable tool in the legal system, polygraphs are far from foolproof. It's tragic that the woman lost her life and that the perpetrator got away with it. Unfortunately, these things do happen. At least it may provide some closure for the family. But, in the end, we can't bring people back, and for the rest of us, life moves forward-until it doesn’t.

Despite raising red flags, it is possible for an innocent person to accidentally come across a dead body without knowing where it is beforehand. DNA as criminal evidence didn't start until the next decade. Even then, it would be in its infancy. Swabbing someone's cheek for future possibilities may not have been on any police department's radar yet. Also, is being forced to submit to DNA testing when one is innocent the norm? Even as an innocent person, I am not sure I would "casually" agree to relinquish my DNA, especially if there is absolutely no other evidence to suggest that I was guilty of anything. If my DNA was required to absolve me, that would be different.

Polygraphs are only slightly better than a coin toss. No one should ever be ruled in or out because of a polygraph.

The lab should be held responsible or the sheriff's department if he murdered her and it went unsolved for decades I wonder if he did it to anybody else and they just let him walk around free..

That's ridiculous. They did not even have the killer's DNA sample until his autopsy was performed 35 years later. I don't think the suspect did much raping and killing after his death.

So DNA became available around the early 80s yet this remained a cold case for 4 decades.

It makes sense. Even though available, DNA was still in its infancy. Computer technology was not what it is today. They only had the killer's DNA for the last 10 years, yet those in possession of his DNA likely did not immediately know he was a killer when they randomly took that sample. He died in Florida and the crime that was committed in California was already 35 years past by that time. There was no living suspect to be stopped and no victims in need of rescuing. The knowledge, technology and expertise of how to connect two seemingly random samples of DNA has had time to improve. Meanwhile, 45 years of crimes have continued to occur, garnering higher priority.

And this is why polygraphs are not admissible in a court of law and why you should never submit to a polygraph. They are unreliable. He was guilty and lying but it said he was not. And countless innocent people have had their lives turned upside down when the machine said they were lying when they were not.
