Constitution is a present law, when action has not been committed the constitution cannot be in motion..

Such childish arguments to justify the absurd positions of this government. The Constitutional provisions are clear. Once a person states her/his intentions to stand for election as anything other than the conditions under which they were elected all privileges and entitlements that held in the first instance are immediately terminated and curtailed. I find it difficult to understand those who claim that, provision 97 H and G is only prospective. What will be the relevance of that provision if it is prospective?

What the Attorney General intends to do is very dangerous because if an NPP Parliamentarian decides to leave his or her Party and join NDC and stay in Parliament, won't there be confusion?

The Second deputy Speaker MUST not continue to in parliament. He has joined NPP when we voted for him as independent candidate. He wrote to the Speaker to do business with NPP. So he is no more independent.

This foolish argument to justify an untenable position whereby the penalist suggests a word into a constitutional provision which does not exist, shows the extent to which people have departed from principle, wisdom and what is obvious for the sake of party loyalty.This show a collapse of intellectual integrity and a dishonesty that is shameful and unbefitting of a parliamentarian in Ghana's parliament.

A simple question that can resolve the present controversy in Parliament in respect of the four vacation of parliamentary seats. Question: *When should a Member of Parliament vacate his seat. Is it during his present term in office or during his probable future term in office, should he win the future election?* Article 97 clause 1, paragraphs g and h of the constitution of Ghana. 1) A member of Parliament shall vacate his seat in parliament - (g) if he leaves the party of which he was a member at the time of his election to Parliament to join another party or seeks to remain in Parliament as an independent member; or (h) if he was elected a member of Parliament as an independent candidate and joins a political party. If it is argued that the member of parliament must not vacate his present seat but rather vacate a future seat if he probably wins a future election, then it would imply that, immediately he is declared a member of parliament in future, he must immediately vacate his seat, so that another election is organized for him to probably win again. This view would amount to causing other parliamentary candidates (including the political party candidates to contest the same elections twice) and to what end? If this view is upheld, it would also imply that a member of parliament who becomes the Speaker of Parliament, must not vacate his present seat in parliament but rather vacate a probable future seat in parliament. It would also imply that upon dissolution of parliament, members should vacate their probable future parliamentary seats. *Second follow-up question* In the context of this discussion, at which point, can it be conclusive that a member of parliament has either left his political party or joined a political party (if he was initially independent) ? *Answer to question two* The time of leaving the political party or joining one (if he was independent) occurs before the end of the present term of parliament. The time of filing for candidacy with the Electoral Commission is therefore reasonably conclusive as the time that he has left his political party or joined a political party (if he was independent). *Final question* Should a political party be the only one to report that a person is no longer a member of the party? *Answer* In this context, any citizen can point out or report a wrongdoing *Summary* Article 97 is clear that the parliamentary seat to be vacated is the present seat and not a future probabilistic seat. The time of filing for candidacy with the Electoral Commission contrary to his "present status in parliament" is therefore the reasonable conclusive evidence that a member of parliament has either left his party, or joined a party (if he was independent); *and must therefore vacate his seat with immediate effect*

NPP constitution is not equivelent to Ghana Constitution. NPP constitution can dismiss a sitting MP from their party for violation of their laws. The decision has effect only within the NPP party. It has no effect on a sitting MP, even if the pary write to the speaker. If the MP himself does not write to resign from the parliament his seat is intact. I disagree with Eigene about Bagbin One wrong does not make anothe right. The mistake of Mike Quaye cannot justify the wrong of Bagbin. The decision of NPP or NDC to dismiss a sitting MP cannot remove any one from parliament if such MP has not violated the constitution of of Ghana.

This doctor is so disgraceful. It's sad that such a person is representing a constituency. Any person contesting parliamentary election must have understood the government of Ghana constitution and the party constitution. The contract with the party ends when the parliamentarian files to go to another party or go independent. Period. The constitution makes it very clear.

@@paullossah9811 because the 2020 one benefited the NPP that is why to them it was legal but the same law is not in their favour that is why it is illegal. the formena MP was kicked out of parliament because he went independent. today this man is here saying the law only applies to future parliament 🤣 🤣 🤣 🤣 🤣 why didn't they apply the same logic in 2020 because if we are to go by then it means they illegally sack the formena MP from parliament.
