I sold a nice house in Anaheim Hills California to a couple. Only the husband came to look at the house and negotiate the deal. They paid for, and received, a detailed report on the property and the neighborhood. Both he and his wife signed the purchase contract in the brokers office. Within a couple of months the buyers filed suit to rescind the contract on the basis that I hadn’t disclosed that aircraft flew over the house. It was a nonsensical waste of time and attorneys. In his buyers inspection report that he paid for it was fully noted that the property was in a flight path for aircraft - and he had signed onto the report that he was aware of that. I think the actual reason for their lawsuit was that his wife did not like the house that he had bullheadedly had picked out without having her be part of the selection. They lost the lawsuit.

I had a buyer say that my house didn't have a basement and wanted out of the contract post-inspection. It was in the listing that there was no basement. My Realtor recommended letting them go to avoid them never closing and losing out on the property i was buying. She thought that the young buyers had talked to their parents, who had sticker shock and suggested they look elsewhere. I sold that house 4 times (signed contracts), the last one finally closed.

@@johnhaller5851 What I do understand is that because of the size and importance of a home purchase, that makes many people emotional and irrational. Probably every realtor has a pile of crazy stories. In my case absolutely everyone could make no sense out of the lawsuit. I think we were heard by an arbitrator, who immediately expressed confusion about why there was a lawsuit since the buyer had line item signed off on the extensive property report that had the flight path as one of the line items. During his initial property inspection aircraft flew overhead! I think the real problem was really the house just didn't make his wife happy🤪

I negotiated for the furniture when I bought my house. I also agreed to let them stay 2 weeks after closing ( they paid me rent). When I moved in- I noticed they took some of the furniture and mirror I wanted. My agent said I could sue the sellers. But, advised against it because court costs would probably outweigh the cost of the few furnishings they took. Looking back- I should have proceeded. Oh well… live and learn. P.S. don’t buy a flip unless you know what you are looking at. I was a novice and fell in love with the aesthetic of the home. 7 years later. I have to fix and replace some big dollar stuff. But, I do really like my home! So, I’ll deal with it. *just passing on some personal info*

We sold our first home 35 years ago after living there for 9 years. About 2 months after closing the new owners contacted us to complain that they didn't like the taste of the apples that grew on the trees in the yard and if they had known prior what the apples tasted like then they probably wouldn't have made as high an offer as they did. I'm not joking! I told them I didn't know what they expected us to do about that. Personally, we had enjoyed the apples, but if they didn't like them then they should just not eat them!! They also complained about finding fleas in the house, so I suggested that they talk TO THEIR DOG about the problem. Never heard from them again. No threats of suing us, but had they tried I'm married to a real estate attorney, so I think we would have been okay.

I am VERY glad you won! Imo, the buyer inspects the house...has a walk through before closing... then closes. Should be end of story. They had the opportunity to inspect the house for termites, mold, possible structural problems, and anything else they could think of. The buyer also got $10k off the price. If they proceed to closing....that it...period. SIDE NOTE: I have NO idea why in the industry they have to call items a credit. I have sold 3 houses I owned myself (I'm a finance/trader guy) and when people start with credit stuff, I have just always said... take that into account with your bid.....just give me your bid. You think the windows are inferior ..just reduce your bid. You think there are possible roof problems...just adjust your bid. A $1MM bid, with a 5k window credit...a 10k roof credit...a 5k concession applied to large closing costs....is simply a $980k bid, end of story.

@@Floorguy1000 I'm guessing that the term "credit" formalizes that the buyer and seller both understood what the buyer got the discount for. You can't come back and say this defect wasn't disclosed, AND you didn't know. You got the credit for it specifically, so you knew. It seems to prevent legal haggling after the sale, I'm guessing. Also, I do think I'd probably just raise my price enough to then drop it for the discounts I plan on giving.

Yes Katy, Basements being below grade, surface of the ground, where the temperature is usually cooler and more constant. In the old days, with food preservation people dug root cellars for that very reason. So it makes no sense at all to have air, other than to modify humidity. But that is for a dehumidifier, not an air conditioner. At the coast many have those, and since we get a great deal of rain I have a dehumidifier for my own bedroom.

Alaska Engineer here. Ice damming has nothing to do with gutters. It is caused by an improperly vented attic, combined with poor insulation. Then the poor roof allows the dammed water under the shingles. Solution? Good roof with ice-water shield up 6' from the eaves, proper venting and good insulation. When you upgrade your old roof, upgrade venting and insulation. Older homes suffer from poor venting and poor insulation, typically. Course, you should maintain gutters, but that's not the cause of ice-damming.

thank you, Americans make a huge deal about things like cleaning gutters regularly as if thats the source of many problems related to rain drainage and snow and getting into the house when in reality the house itself isn't built well one way or another. When cheap thin wood is used to make most of the house what can you expect to be honest.

Well the home inspector my agent used miss some stuff. But I would sue the inspector seller before I would sue the the agent. Most of the stuff was thing like the furnace, air conditioner and water softerner all dying 2 weeks after I moved in. So I replaced them all. Basically there is no 100% guarantee that stuff will not break when you move in. Inspection means what they see at the time and do not warn you that the furnace is about to die. Basically you should expect a few problems and budget for it.

Home inspectors usually wiggle out of this by stating that they can't estimate how long something will last. And good ones don't. My inspector recent noted, water heater is 25 years old. Normal life expectancy is 10-15 years. You do the math.

I'm sorry that happened to you. I agree, you do need to have a budget for potential problems especially if appliances and other things in the home are old. I don't use anyone who is recommended by my realtor. I find my own closing attorney and inspectors through referrals from people I know or by researching online reviews and also if there are any lawsuits or Better Business Bureau complaints against the person I will consider hiring. I think there is a conflict of interest using someone who is associated with a realtor. A home inspector only does a general inspection of some of the main things/concerns in a home but not all the things that need to be considered inside and outside of the home. A home inspector isn't usually an expert on electrical systems, plumbing, and other important things inside and outside of the house. It costs more money upfront to hire a few additional inspectors who are experts in their field but it might be worth it in the long run.

I have central ac throughout the house, and yes, in my basement which is elaborately finished. You are correct. It is usually cheaper and less troublesome to settle in legal cases. Too many shenanigans are allowed to delay or not to bring it to court. The court does not monitor these shenanigans.

Great video! About the ice damning, it’s not just about having clogged gutters (which, by the way, can obstruct sliding snow and ice even when clean). It’s important the attic space be louvered open at the ends to allow cold outside air ventilation. Often homeowners don’t think to insulate their attic floors, which allows house heat to rise into the space and warm the roof. Lastly, shallowly-pitched rooves (e.g., ranch rooves) are more susceptible to ice damns. On your counter suit, I’m not surprised the judge dismissed it if your legal services were free (by using your husband).

Do a walk thru either the day of the closing when you turn over the keys or the night b4 and video tape it to show no mold on the walls, complete disclosure etc etc. I would have attached that to my answer and ask the judge to take judicial notice of it and grant a motion for summary judgemnent vs the plaintiff.

Just bought a home with a walk out basement and it does have air conditioning down there. This is my first time with a basement, so I didn't know that's unusual. I can say, I think the AC portion is unnecessary since most of the area is subterranean and it's continually much cooler down there than upstairs. That being said, in the winter, the heat is a nice bonus, but not very effectual.

Our basement, (NOT a walk out), does have a couple of air vents and an intake vent in the basement. We keep them closed since the basement stays at a consistant temperature and it is not useable as living space. The perimeter has a finished wall and a half bath but no defined rooms other than a central mechanicals area. The layout is not functional as living space and I suspect the added vents were not done correctly since the house did not have a finished basement when built, previous owner added and heating/air units were not updated to account for extra area covered and air flow.

Not related to your video but still on the topic of homes, homeowners in Florida have extorted their insurance carriers over the years by filing lawsuits against them for roof replacements even when there is no damage to them. It is cheaper to pay for a roof than fight it in court. Why do you think insurance premiums are through the roof in Florida. In your case you were lucky since your husband was an attorney but you still lost time, money and sleep over the lawsuit.

Yes, it should have been in the Seller's Disclosure Notice. We just purchased a home, where the listing stated, 'new roof replaced in 2021'. This was a complete lie. There was a small spot in the roof, that was patched. Also, after the first rain, our bedroom had squishy carpet. When Hubby pulled the carpet up, he found moldy tack boards, baseboards, and someone applied silicone calking all along the baseboards to hide it from potential buyers. We did not sue, but we did go the the local Board of Realtors and made a complaint against the Sellers Realtor.

Scary story, just want to correct something, blocked gutters doesn't cause ice damming. Often caused by missing insulation, heat loss melts snow on roof, then freeze thaw cycle will cause it to come through the shingles. There can be other causes, but it is almost always the result of heat loss into anything space.

A Two-zone air conditioning system is not unusual in a larger house in a warm climate. The main floor and the (finished) basement are on one zone, the upper floor (what Americans call the 2nd floor) is on its own zone. Each zone has its own units outside, thermostats, and fans.

At my job, we have been sued three times over 40+ years. NONE of these were legit. When people sue, they sue EVERYONE that might be involved. One got thrown out because we were able to prove that we didn't install the equipment that they said we did. Can you imagine being sued for something you didn't even have anything to do with? The other two had nothing to do with anything we did, but the insurance still paid out some small amount just to make it go away. Also, the people who were included in the lawsuit that did not have insurance were left out of the lawsuit. So because they didn't pay for insurance they got out of it? Doesn't seem fair.

We will NEVER buy another home! Since we are both retired, we have decided to rent/lease the remainder of our lives, and with minimal possessions. We’re becoming very basic. It may not be ideal for many, but is going to be what works for us. We are “done” with this nightmare! Home maintenance costs, taxes, and 3 types of insurance (Homeowners, Windstorm, and Flood) have made it no longer feasible for us to purchase again. Also, these lawsuits have gotten completely out of hand,…to the point of wishing to avoid most humans. This is just so sad! Plus, we do not want to leave ANY of these issues for our children to deal with. We are unloading these headaches. Mercy! 🤦🏼♀️

We declared everything and agent took care of everything. However buyer had no credit and most their money is stuck in China. They used all their money held in 0:06 USA to buy it cash. Money they wanted to fix it up with seems to be their dream house it seems stuck in China. They can hold it or use, it is livable. Could be a rental till they can transfer their additional funds from China before it can be their dream house. My agent says I have nothing to worry about how many years after sale do you worry about being sued. County keeps raising the value they say the house is worth so buyer did get a good deal. Don’t think they will loose. Just hope their property tax doesn’t keep going up like it has been if house looses value. I was just glad to leave the state. Property was a high class area but that can change. Hope new owner at some point gets to make it their dream home.

What happened to "buyer beware" line? The seller of a product will overly hype their product (house, car, bike etc). It's your responsibility as buyer to do your due diligence to make sure you get what you pay for. The average stay in a home is 5 years in US, what if there's an issue in house due to 3 sellers ago and I'm selling without being aware of that issue? How can a buyer's lawyer prove that I was aware of it? ... unless he has psychic powers and can read minds .

Face it, all Realtors lie and should be sued. When a potential buyer ask if theres any issues and the realtor doesnt answer honestly, even though previous buyers already had inspections showing problems which the realtor has seen. Thats a lie.

First, you as an agent are getting paid well beyond the value that you provide. Second, why didn't you have an indemnity clause in the event that the seller has misrepresented this home. Third, why didn't you verify the a/c, considering you put that onto the MLS. Fourth, did the seller have multiple offers, if so, did you not care about what you were representing. Fifth, do you represent buyers. If so, are you more thorough in this representation than you are when you represent sellers. Sixth, you just made an excellent case as to why sellers and buyers SHOULD be represented by attorneys. Seventh, any seller who knowingly misrepresents their home should be sued along with the agent who claims that they sold the home, as you pointed out at the beginning of your video. Eighth, since disclosure notices are legally binding, WHY aren't you having your clients seek the advice of an attorney, considering you cannot provide any type of legal service, including offering advice.

I was interested in info you might have on your channel but you TALK TOO FAST!! 😡 When did instructional speaking become a speed event? I won’t listen to this.

When I talk slow, people say I talk too slow… when I talk fast some people say I talk too fast… you can adjust the playback speed of the video in the settings of the video. Hope that helps.
