The UK is not in the EU. European Convention does not have jurisdiction over the UK. Try the international human rights.

@@moby1388 Yes, although the UK is not in the EU, apparently signing up to the ECHR is separate to membership of the EU. So as far as i know we are still the same as before. I don't know when this idea of 'detaining' someone without arresting them came out. I don't know what the idea of it is; who does it benefit the most ? On one hand the person stopped can say that they 'haven't' been arrested, so it doesn't sound bad and mess up their reputation, and the police can save face to by not 'persuing' the matter ? Or is the idea that an innocent person would co-operate and the guilty would resist ? ( is it an offence to resist 'being detained' ?)
