The supreme court did not end a right to abortion. There is not, and never was a constitutional right to have an abortion in the United States. Abortion is not anywhere in the United States Constitution and as such, per the tenth amendment is an issue to be legislated at the STATE level, not the federal level. What this supreme court did was overturn a bad judicial precedent (the roe decision) and correctly put the issue of abortion back to the states to decide.

Legal safe and rare should be the approach to abortion , it’s should be used only on specific cases especially if minors are involved in rape
@xyzydoucare Жыл бұрын
Considering that the fetus grows within the woman and has psychological, social, economic and physiological effects on her own body, it MUST be her who chooses to decide what she has to do with her body. Do u know what the maternal mortality rate of the world is? So basically it must be her choice whether to take the risk of pregnancy. Not a man or the state for the matter. Indian constitution has done a great job with the MTP act and that is may be one of the few aspects where we are more organised and developed in our thought processes than the US. Because with the absense of a federal law, conservatives there leave no opportunity to cease women's rights and only depict them as vessels to let humans into the world and reduce them to a mere uterus. U should read their scriptures sometime which reflect exactly this mentality. This is the reason for the large hue and cry around abortion law protection in their country. How is Mississippi Heartbeat abortion law logical when 6 weeks is not even enough time for the woman to know that she is pregnant, let alone an abortion? Do u have any idea of the menstrual cycle and the physiology of pregnancy? A woman may think that it is just a missed period and may not even suspect a pregnancy in that time. Do u really believe that the definition of being a human is only a heartbeat? Even animals have heartbeats, and I don't see people defending and endorsing vegan laws all over the place? Please have some clarity and also do consider THE WOMAN'S HEARTBEAT before making such comments.
@sampatkalyan3103 Жыл бұрын
@@xyzydoucare nope.You provided many failable arguments which can be countered very easily. And please I can say the same thing to you please consider the heartbeat of men and the child which you are going to kill in the name of abortion. And comparing a human child with animals and vegan things shows your self centred opinions and playing the victim card will not help you. And it is her choice to get pregnant or not but not her choice to kill the child. Get your brain straight. You are the one who needs to have clarity before spouting nonsense. So before teaching me about clarity about how you have one. And don't put hypocrite statements. Because I am very clear about it. And that heartbeat argument is very shitty. By this logic you can kill humans who are in comma and tell that they are not humans. I guess you are able to see a flaw in your argument. And let me be very clear it is women 's choice to get pregnant or not but when women get pregnant it is not just longer a woman 's choice because men also take the same risk a women takes. Expect physiology and I have explained why it doesn't matter.
@xyzydoucare Жыл бұрын
@@sampatkalyan3103 Well if many of my arguments are falliable, then why didn't u address everything that I questioned? What is it about the "heartbeat of men"? Do u seriously think that yhe woman's pregnancy/abortion is going to kill the man who impregnated her? Laughable argument at best. I only asked u to CONSIDER the heartbeat of a woman, meaning her health just like u r considering the fetus's because in ur comment, u r not taking the life of the mother into consideration, the reasoni mentioned to read up MMR. By asking u whether the mere presence of a heartbeat is enough, I meant if it is enough for u to declare that the fetus has its own rights independently from that point on and am questioning u y not other points of life like when the fetus is capable of sensing pain or the point of fetal viability (like in India) or any other point of the intrauterine life. I compared to animals only to expose ur narrowed view on the matter. On a side note, why do u see animals as inferior? I didn't ask u to talk in favour of aborting the fetus anytime. I asked u to take a more reasonable approach in deciding till when it is okay to abort a child considering everything else and not just in terms of the baby or the men trying to continue their gene pool. Other major corrections in ur reply: U can't call a fetus a 'child'. Child is not used for a fetus in-utero implying it is not yet a complete human being and does not have its own rights. This is how the law works of u do not know. First u need to decide on when the intra uterine life can acquire separate induvidual rights from the woman for it to be protected by the state or the country's laws. Till then, the life is considered the part of the mother and she has the right to decide what to do with her body. This is what I asked u to get a clarity on. Laws and constitution are not writtten based on anyone and everyone's wills and wishes and standards of morality. They have a code so as to ensure that no one's rights are being infringed upon. Woman's rights are surely being stamped on in ur argument. So please do learn and speak instead of escaping by just calling someone immoral or absurd because u cannot see a certain fallacy or the truth for that matter.

All actions have consequences. To be clear, people have the right to choose. However, if you choose to kill, you will suffer the consequences of that action. The question people need to consider: Is one moment of convenience worth that consequence? Furthermore, if you act on your right to choose to do something, others should have the right to act on their choice to prevent you from doing it or act on their right to choose to punish you for doing it. This is why we have laws and why those laws should reflect the highest moral standards of the society they serve. A law that simply protects a right to choose is not moral as morality is something that can be chosen. We can choose to follow the laws, we can choose to be moral, these choices can be arbitrary but like all choices, acting on them have consequences. An arbitrary law will not be just and by default becomes immoral. Law and morality need to be absolute to promote order and deliver justice, without absolute laws and morality, we will have chaos and injustice. Abortion is not moral because it is both an action and a choice to commit that action. Abortion is in fact immoral because morality will determine that an unborn baby has the right to live just as you or I have the right to live. Therefore If a law protects that choice then the law becomes unjust and ultimately immoral. This is a bit of logic wordplay and I hope it promotes some critical thought. Feel free to choose to listen to it, or not; but your choice will not change morality no matter how much you seek to justify your actions
@xyzydoucare Жыл бұрын
This is no logic wordplay, This is just you moral policing others. And moral policing has no place in law making or breaking for that matter because apparently everyone has their own standards of morality. The question here is of rights of individuals. And since pregnancy has psychological, socioconomic and physiolocial effects on the women's body, it is necessary to protect her rights to choose whether to take the risk of pregnancy considering the high maternal mortality rates and the emotional toll that she has to go through. So if the law of the state or the country is forcefully pushing the woman to continue risk of pregnancy and the woman dies due to pregnancy related causes, doesn't that mean that the state/country and the society that supported the law altogether committed murder of an actual human being let alone one that hasn't formed yet? If you really do not want abortion to be a problem, why not endorse vasectomy for all the males since it has 95% safety and 99% reversibility?
@diehardernxgt2161 Жыл бұрын
@@xyzydoucareyou said right to individual. But what if the individual happens to be the unborn child who cannot consent to be aborted? I would agree that abortion should be legal for some exceptions like incest, rape or risky pregnancy, But to say that abortions should be treated as a means of birth control is a bit of a grey area.
@xyzydoucare Жыл бұрын
@@diehardernxgt2161 I never said abortions must be used as a means of birth control. It's what happens when the preliminary birth control measures fail, so no person must be forced to carry the pregnancy just because of the failure of a birth control method. They should still have a choice. And coming to treating the unborn child as an "individual", the law we have in India is pretty good. The point at which a fetus is considered an independent entity and able to sustain life on its own if delivered is known as the period of viability which varies from country to country based on the healthcare infrastructure and in India, it is 24 weeks. So Indian abortion laws are based on this principle. This is the exact point a fetus can acquire individual right to life and hence abortions beyond this point are illegal. Here, the rights of both the pregnant person and the unborn fetus are preserved. But, what the US has done is utter disrespect to the rights of women in general and has major flaws medically (I could explain how if u're interested) and socially which again tend to increase the risks that come with pregnancy which a woman should not be expected to bear.
