easements just grant a right of access. They don't permit the other party to do whatever they want with the property. It's still your property.

it wasn't clear who's property the driveway belonged to. He said "their property line or easement line" ran right past his shed. But a property line and easement line are two different things. If that is an easement line then his property extends all the way to his fence and the neighbour has access rights. They can do what they need to do to gain access but they can't negatively impact him. If that is the property line then that is his neighbours property and he is the one with access rights. In which case his neighbour can do whatever they want as long as they still allow access. Lowering the grade level that much would not be considered allowing access.

start listen at 2:52 for sound. this is their property stake here, that tree is the property stake on the other side. so his neighbors own the driveway and he has access rights but I agree with you. what their plan is, is illegal. what they are planning or were planning since this video is 4 years old now was to put a 20ft deep ravine in the middle of his driveway which would not have allowed him the access he gets and would make him pay to get something installed or built so he could get to his house. this would have also undermined the foundation of the little overhang he is calling a shed and would eventually give out causing his trailer to fall down into their driveway destroying it and then them complaining that why did he has his trailer so close to their property. I would probably have shown the access papers to the construction company that showed up to do the work and would have sent a copy to every construction company in the area telling them that what my neighbors are planning is illegal because it would block my house.

An easement gives you right-of-way, but it does not give you right to significantly alter the property. So it seems to me like the ravine that was created must actually be on the neighbors property, and the easement line he pointed out must be the actual edge of his right-of-way. Otherwise this story just doesn't make sense. If the neighbors did create that ravine on the easement, then they are in some serious shit.

From the video explanation it looks like the ravine is on the neighbors property and your driveway is actually the easement that he doesn't have access to bexause of the fence and the drop off. To me it looks like the ravine needs something for erosion or eventually that fence will fall down

Hmm interesting predicament. I think the driveway is an easement on the neighbor's property, and for whatever reason they want to dig it up for what I'm guessing is making the ravine larger. If it was a legal easement I don't think they would legally be allowed to. Would be great to see an update of whatever happened.

While general there us just a line showing an easement, that doesn't mean that the footage us equal on both sides of it. My neighbor accross the street lost 25 feet if his assumed front yard while I only lost 5 feet when the county made the road 30 feet wider, which included sidewalks on both sides. The ironic part is my neighbor spent 3 years convincing the county that the road should be widened and to install sidewalks, where as I contested the whole project stateing to leave well enough alone.

If they have easement, and it states where the easement is they can't just move it or make it bigger. The deeds should says where & what the easement can be used for. If the easement says it's 25 feet wide, & they want to build 2 lane road, there is probably room, but the county says it has to have 50 right way. They only have what they have. It was bought, bargained for, or something, at any rate, till either the court or someone buys, bargains, or something it don't change. Who says they are going to take the new road down next to your out building is you. Don't let them push you or take what they don't own.

I'd say you have two obvious issues. Firstly you have a right of support from adjacent land. So regardless of the use of the driveway and the easement, the neighbor can't just dig away at land beside your foundation, unless they are prepared to put a lot of money into building a retaining wall. The other issue of the easement is that they can do what they want with their land, so long as it doesn't interfere with your access to your property using the easement. My guess is that digging down as deep as they want to is going to make your access to your property very difficult, and thus interfere with your easement rights.

I live in Washington too and have been in court for 4 years with a crazy neighbor. Roads been in since 1977 , he moves in 2013 and everything is wrong. Come to the conclusion that the state likes to keep lawyers in the $ and refusing to enforce or enacted laws that prevents this nonsense. Why 60 feet? Are we putting in a 4 lane hwy? You should not have to lose all that property ( that you still pay taxes on) just because 1 guy wants things to be different.

The property lines you showed means you have an easement on THEIR property. They can do as they please, as long as you are allowed to branch off into your property.

I don't know either of you, but it looks like you need to move your shed cover for the trailer. As stated the current driveway is on their property. I don't think it's neighborly to do that, and it doesn't make sense to do all that work, but it is their property. It just looks like you'll have to move some stuff around and build your own driveway. I was curious, is that fence on their property as well? If the new driveway is going to be five ft down next to the shed after you move it you may want to wall it up to the dirt stays in place to prevent the garage from shifting. An easement is on the property deed. Not all easements are the same. Depends on what is written. Vague wording always causes problems.

A property line denotes ownership. Property lines forming an enclosed geometric area denotes an area of property that MAY be owned by some ENTITY. An easement grants a right of access to some specific part of said property, nothing more and nothing less. The information contained in this video doesn't present a clear picture of anything, therefore no conclusion can be drawn.

Apparently like a lot of other's you don't no the rules, laws and regulations governing just what an easement is and the purpose of. A city, town, county and the state all have rules governing them. In general though you may pay taxes on it, you don't actually own the portion of your estate that is easement. I'm gonna go out on a limb and state that your road isn't centered on the official plan. Old roads generaly are not. I've seen cases where as the actual center of a road is completly on one side. Thus one side of the street is on ones easement, ther other isn't.

You can delete the dead air space of just walking etc to get to the meat of the matter and make a better video. But ignoring that it is usually a good idea to post an update as to what happened.
