On 3/26/2024, at approximately 11:57 pm, I was conducting proactive traffic enforcement on US 19, in the area of Berkeley Manor Blvd. I was sitting stationary in the center median of US 19, south of Berkeley Manor Blvd, facing north, observing north and SB traffic on US 19. At that time, I observed a red four-door sedan traveling northbound on US 19 in the outside lane. The sedan was traveling at a higher rate of speed than the surrounding pack of traffic. After traveling through the intersection of Berkeley Manor Blvd, the red sedan abruptly moved from the outside lane to the inside lane, cutting off a vehicle in the center lane and a second vehicle in the inside lane. I subsequently pulled out of the median and began to catch up to it.
As the sedan approached William St, it made another abrupt lane change, cutting across the center lane and outside lane, where it cut off another vehicle, before turning right onto William St. As the sedan negotiated the turn at a high rate of speed, it drove off the edge of the roadway into a pothole, which nearly caused the driver to lose control. At that point, I activated the emergency lights of my issued marked Patrol vehicle to conduct a traffic stop on the sedan. The sedan traveled eastbound on William St at a high rate of speed, turning off its headlights. I activated the marked patrol car’s siren and caught up to the sedan as it made a left turn onto Plyna Street and began traveling NB. The sedan continued NB at a high rate of speed, willfully fleeing or attempting to elude me.
The sedan approached US 19, subsequently running the stop sign, turning right and again traveling NB on US 19. As we approached the intersection of Northcliffe Blvd, the sedan's hazard lights came on as it continued to flee at approximately 80 MPH. After passing through the intersection the driver of the sedan continued fleeing, making no effort or attempts to pull over. I attempted to terminate the pursuit by utilizing a PIT which was unsuccessful. The sedan moved from the outside lane to the inside lane and accelerated before coming to an abrupt stop, south of SR 50. I positioned my patrol car directly next to the sedan & ordered the driver to stop. The driver failed to comply and again accelerated in an attempt to flee. I immediately attempted another PIT, which was successful and terminated the pursuit.
I immediately began giving loud verbal commands to the driver to show me his hands and stay in the car. The driver failed to comply, exited the car, and walked to the area in front of my patrol car. I continued giving him loud verbal commands to get on the ground, to which he continued to disregard. The driver eventually got down to his knees momentarily before standing back up, continuing to disregard my commands to get on the ground. I ultimately approached the driver and transported him to the ground, taking him into custody by handcuffing him behind his back, which were double-locked.
Subsequent to arrest, an inventory search of the car was completed prior to it being towed by a FHP rotation wrecker. The search resulted in the discovery of 3.92 grams of a crystal-like substance, identified as methamphetamine and 1 gram of a green leafy substance, identified as marijuana. A presumptive field test of both substances was conducted which provided a positive result for methamphetamine and marijuana, respectively. All of the substances were located in a bag on the driver's floorboard, immediately at the driver's feet, and in the driver's door pocket.
The defendant identified himself as Devon Allan Fifer, producing a Florida driver's license, hereinafter referred to as "defendant." It was later revealed the defendant gave a false name (Fifer). The defendant's true identity is DERIC MICHAEL PERRY.
At approximately 12:13 am, I read the defendant his Miranda Rights, which were read from a department-issued Miranda card. The defendant advised he understood his rights and agreed to answer questions. Post-Miranda, the driver stated that he did not mean to run from me, that he was in a rush to take the female passenger to the hospital because he thought she was overdosing. It is important to note that the female passenger was alert, conscious, and talking, displayed no signs of overdosing, and was evaluated by EMS before being released from the scene. The defendant denied any knowledge of the drugs that were discovered in the vehicle, which were in his immediate possession.
The defendant was subsequently transported to the Hernando County Jail, without incident, where he was booked for the charges listed in this document.
