Drum Island - Lift

Drum Island was a short lived music project whose members included Torbjørn Brundtland, Ole J. Mjøs, and Rune Lindbæk. Svein Berge officially makes a special appearance on one of the tracks on 'Drum Island', but it could be said he generally had more creative input on this album than he is credited for. This track bears a strong resemblance to 'A Higher Place' from Röyksopp's debut album Melody A.M. Both tracks do use the same two samples. Jean-Michel Jarre's 'Wooloomooloo', and 'Freedom' by The Tyrell Corporation.

@almightyshux as mushroomsmoke mentioned, drum island sampled jean michel jarre's woolloomooloo in the first place and if röyksopp guys were ever to pay royalties that must be paid to jarre. the songs sound quite alike but wasn't torbjorn a part of the duo drum island with rune which would means that they produced the track together? we only heard the rune side of the story and we don't even know if drum island paid for royalties to jarre so the best thing would be to let the court decide.

The soundscape has similarities to "A Higher Place", similar samples, but thats it. This is a totally different tune. Artists need the freedom to create something from something, and I think in this case røyksopp created something entirely different using similar samples. Kill that and you kill freedom to create.

@BCE86 & mush You have to keep in mind samples and sampling are including in what's considered composition these days. IMO i can hear the heavy influence of LIFT within Higher Place let alone using the exact same samples Drum Island used to begin with. To the extent that you can contend that Higher Place is similiar enough to be a remix of LIFT. Considering that some remixes are further removed from the original then these two purportedly "completely different" songs. Rune deserves his due.

I don't get it.. There are some elements in the two songs that are somewhat similar, but while Lift sounds like the inside of a rats stomach, A higher place has a melodic theme. That's what makes it a great song, not those pluck plingy sounds. If I sample the engine of a Mercedes and use it in a song, I don't really think Mercedes can sue me for using "their sound"?

1) The elements contained in both tunes are sampled - meaning that Lindbæk cannot own the rights to them. 2) Court submitted evidence that Lindbæk wasn't even in the studio the day when 'Lift' was produced. He should've never been credited in the first place. Bottomline: he has no reason to be pissed at noone, except at himself for borrowing money from his mom to bring up a case on such fragile basis. He sued them in hope of scoring money, not due to artistic principles.

I just had to listen to some other tracks by Rune Lindbæk. Although I didn't like Lift, he actually has a lot of other, really cool songs! :-)

Which version came out first? This song is nearly identical to Royksopp's. Someone committed musical plagiarism for sure.

hey mushroomsmoke, heard that some guy from drum island is accusing röyksopp of stealing this track and releasing it under the name "a higher place". the tracks sound quite alike but i don't think röyksopp guys would do something like that knowing that this would come up eventually. any info about this issue??

Amazing magic video. Anyway, this is the same song that was used in the Drum Island "Lift". As far as I know Torbjørn Brundtland was only techniques employed by Rune Lindbaek and Ole J Mjøs at the time this track was made.. I think Røyksopp has a bad case here since they failed to get this rights cleared with Rune Lindbaeks Drum Island.. And especially since Rune Lindbaek is the owner of Drum Island Records and shuld own the rights to this melody right?

Hmm.. I dont like this kind of music.. but I think this Lindbæk has a point. Its the same tune as Røyksops "A higher place". Not only similarities, they use the same phrase "A higher place". That was the final evidence for me. Røyksop has copied too much here. Even myself could make a version out of this "Lift" if i was allowed to copy as Røyksop has done. No wonder why this Lindbæk is pissed off.
