Question with the OVI laws if you are sitting in the car "intoxicated" and you turn on the air conditioner you could be arrested for OVI. But when Tesla's Robo taxi's come and you are in the back seat getting a ride home and you turn up the AC is that still OVI?

My suspension due to refusal to give breathalyzer specimen is ending within days and I've not received my license back . Been driving with occupational license and at time I applied I also paid my reinstatement fee of $160 . Shouldn't I get my license back same as occupational one by mail ?

No, it is not guaranteed. You are correct that it rarely leads to jail time but if a jail sentence is given it must be a minimum of 3 days

Sir do I have a question for you. I don't know without any money if I can get a answer that I'm looking for. Or even with money if I could. Long story try to make it short. Got a DWI after driving. I was outside of car at a gas station. "Did" A field surpriety test. Refused they took my blood. While at hospital sketchy stuff happened between cop and nurse he covered up his mic along with a few other things. The vial that they took my blood in had a problem is there a problem and I told them from the get go. Can I get a DWI. I accidentally drove into a very small ditch my car got stuck no one got hurt. I called for a tow truck they called the cops on me that's how the cops approached me at the gas station. Sorry for the long story. I have a lawyer I don't know how good they are they said they caught the got the odd things on tape and audio. Really nothing to benefit me just a cop covering his Mic.

He did say it's in your attorney to do the work and look at body cam dash and statement/testimony because burden of proof is on the prosecutor and not the defense. Unless everyone did everything right from start to finish you might have a defense.
