Four innocent young people violently murdered... of course evidence should be sought out! IF the evidence matches a suspect, then the defense lawyers can only come up with why the evidence shouldn't be used! Those four young people can't speak for themselves, so the law should be able to investigate. The killer violated their rights! What about that violation?

The Kohbergers home is in a gated community. That garbage per se, is only allowed to be touched once it leaves the gated premises. The gated premises is gated for a reason. It is private property. Also the neighbour that was interviewed said that the Kohberger family And the neighbours had an agreement. That is, if the garbage containers were full then they could use any of the neighbours garbage bins that were not full. Please do your research if unsure. Remember, it was Christmas. Allegedly, there is a lot of extra things to throw out at that time of the year.

@@rebeccaoliver7977 He put his own trash in seperate bags and put them in neighbors cans to hide his DNA. His parents did the normal thing and put their trash in their own cans. Kohberger thought he was so smart, but all they needed to get the warrent was a family members trash that showed a connection to the murderer. This occurs all the time now.

@CommonSense-e1m exactly! There were three other male DNAs on that knife sheath which were never looked at by the prosecution. Never! Also that little snippet of DNA was on the bottom of the knife sheath inside. As you probably are aware when Touch DNA sits on brass And, within three hours perhaps if you’re lucky four hours it disintegrates all the DNA. I did call up a Company that makes these sheaths and they said that there is a coatimg that they put on the button but of course lacquer is porous as well so the DNA in any case would have been contaminated and therefore not reliable. These people never listen .. I guess one cannot fix stupid

One of the greatest true crime books ever written, “In Cold Blood,” had the effect of being a requiem for the victims. They were a beautiful, generous family, involved with the community, making their murders so much worse. I’m looking forward to reading this interpretation of the Idaho tragedy.

Innocent? Ms. Taylor is not arguing her client's innocence. (At least, she is not doing so at this time.) She is currently intent on making the State prove his guilt by lawful means. She is questioning the lawfulness of specific investigative procedures, in this hearing.

@@catsj1767 The defendant did not go to law school, and he is not a criminal lawyer. On the other hand, his attorney -- Anne Taylor -- is a very accomplished criminal lawyer. She was even the Head of the Public Defender's Office in her county, before joining Kohberger's defense team. It is pretty certain that she does not need the uninformed input of her client, in order to develop and present legal theories.😃

So BK's attorney is actually trying to say that police needed a warrant to search through his neighbor's trash to retrieve items BK placed there himself, and seen doing so on video? If BK had placed the items in the trash of his own family, in his own house, I would agree that a warrant would have been needed. That requirement disappeared the minute he released those items from his personal custody and placed then in/on the property of someone not related to himself, without that person's knowledge, and in the darkness of night when nobody was awake or knowing what BK was doing. If i remember correctly, this activity was seen on camera, which created reasonal suspicion for those items to be retrieved, and no warrant would be needed. The knofe sheath was found at the murder scene, and an intensive investigation was being done on that sheath. Wouldnt sending that evidence for further testing be an expected and necessary part of the investigation in determining who that knife sheath belonged to? It doesn't make sense to need separate and additional warrants in order to send this evidence for testing in an attempt to locate the owner/user of the knife and knife sheath that had been used during the commission of those murders. Im glad there's a good judge in this case.

I'm at the beginning of the video, so I'm just watching the defense attorney make her argument to suppress...and let's be fair, this is her job, to try to do this. Indeed, if she failed to try to suppress, if Kohberger is ever convicted, he'd have a claim of improper defense. That said; let's look at her argument. 1. "it was done in private". Yes of course it was. Law enforcement generally keep their investigations private. Let's compare this to the work done on the Gilgo Beach serial killer. It was finally properly started in Feb 2022 (after 12 years). Was that "done in private". You bet your sweet serial killer's arse it was done in private. They weren't out there giving press conferences letting their suspect know how close they were, and to make sure to get rid of any incriminating information, or go on the run. Apart from press conferences, who else exactly does this attorney believe SHOULD have been being informed of all this? 2. "that should raise red flags". Note the use of the passive tense. SHE is responsible for raising any problems. THAT is exactly her job. "flags" don't just raise themselves for no reason. And if she's saying there is a problem, she needs to cite the laws or precedents which create any red flags. She didn't. Not a sausage. 3. she claimed that taking an item out of the trash needed a warrant. Nope, not if it has been put out for collection. Which it had. 4 why is a warrant needed to transfer a sample from one lab to another? Maybe it is, I'm not a specialist, but I've never heard of that. AND, once again, she failed to cite a single law or court ruling or precedent which established that to be the case. I've never heard an attorney fail to cite the legal authority of their claim.....if there is one.

But this judge is not taking any of that BS and I guess she's going to have to go back to the drawing board. @@tinaspann7745 From a strictly academic, non emotional, point of view, it is kind of interesting to consider what might have happened had he not left that knife sheath. From what I know about the case - which I followed a fair bit at the time and a bit after his arrest, but not much since - LEOs had the white car to follow up. I wonder if they would ever have followed that to Kohberger. I believe he went and altered something about the registration - I'm not sure. I wonder whether LE would have done a huge sweep of any and all videos - all ring cams, all store cctv, all traffic cams, all ATM cams, the lot...in a widening circle, and have found a good shot of the car, with the plate. Because he was out at a pretty unusual hour. Not too many other cars would have been around. I tend to think...they would have come across him and his car eventually. But leaving that sheath behind. I;ve wondered if THAT is why he drove back. Whether he went into a total panic and drove back with the wild hope he could somehow retrieve it. It is so like something from a novel. Someone who considers himself so much smarter than everyone else. Especially women. He screws up his career and life again - which he'd just done at the uni. Enraged, he explodes in this manner. But still thinks he's fiendishly brilliant. Then finds he gets SO overwhelmed, or excited, when ....well dong what he did, that he leaves a great big huge flaming clue behind. Sort of like an evil O"Henry story. Not quite as weird as a Poe story...but getting there. The fact that the defense are trying SO hard to get the DNA out and the DS out...tends to indicate that they know they have nothing else. Of course they'd do those things anyway...but they're definately giving off vibes of "this is all we have, there's no real defense. That alibi we talked so much about a couple of years back. Yeah, that was a joke. Especially as that ailibi was..he was driving around, near the home., and turned his phone off as he got really near it. Then turned it back on, shortly after the murders."

He is trying out his ‘knowledge’ of proceedings that he’s learned in school. Thinking he committed the perfect crime. This is his examination… which eventually he will fail. His time in the court room desiring all he had prepped for…. Soon it will be over. He will be put in jail to have his spirit broken. Knowing he failed his thesis, his desire to become a notorious killer. Little time of day will be given to him after that.

Hi Nate, I didn't see this live as it is 11:02 p.m. Eastern Standard Time. I am watching from Jacksonville Florida and I watch you all the time. I am editing this post as I just saw on Nancy Grace KZbin video tonight where something came up about another home invasion in the same area similar to the Kohberger case. She was discussing how this could be the practice trial that Koberger may have done like you guys were talking on your show tonight. You might want to look at Nancy Grace which aired on 1-23- 25. I wonder if the police department's there have looked at the similarities of the two cases. Wouldn't that be something if investigators could find something in Koberrgers phones GPS to put him near the second house?

I hope the four young students get their justice. If he gets death penalty, I pray it won’t be decades. I feel that’s cruel to the victims’ parents and loved ones to suffer so many years to wait for closure and justice.

Yes and she best do her best to do what he asks so nothing can be said she failed. Yes, but she is doing every crazy thing he asks… as he is the one grasping at straws trying to state he committed the perfect crime. But reality is - no, no he messed up. He will never ever get out again.

Kohberger has no rights and no other person does over their DNA at a crime scene. Police can collect a knife sheath underneath a victim and process for DNA. Defendants have no rights over their dna nor fingerprints in crime scenes. We’ve scene fingerprints challenged by defense in past history when it was used in evidence against a defendants in court. We are seeing DNA being challenged that was collected and processed. Defense wants his cell phone records, Amazon account, Apple account, ATT all suppressed, and thrown out. Defense and prosecution are doing their job. The judge is doing his job and is highly respected by defense and prosecution teams. We all want Justice for the victims and defendant. Judge Hippler knows what he is doing and is clear with both sides to be prepared and follow the law. It’s a relief to see order in court and not the circus that went on in Moscow. May Justice prevail.

Great job Nate! I don't see all the confusion and need for motive, the average decent person couldn't understand heinous crimes. BK if guilty, has all the signs of a predatory sociopathic killer who probably fantasized about committing and getting away with the perfect crime, i.e., he was a former drug abuser, bullied, didn't fit in, a reported misogynist, studied serial and or infamous killers, etc. Listen to experts like Dr. Gary Brucato for his takes on various homicide cases- truly enlightening.
