"O you who believe, obey Allah, obey the Prophet and those in authority among you (who is Muslim and obeys Allah without equalizing Him with someone else); and if you are at variance over something, refer it to Allah and the Messenger (to resolve it), if you believe in Allah and the Last Day. This is good for you and the best of settlement." (4/Nisa, 59)
People can be at variance over religious and worldly matters. In case of dispute and disagreement, people are divided into two parts:
1. Believers who believe in Allah (awj) and the Last Day and refer all the matters to Allah (awj) (the Book) and His Messenger (pbuh) (Sunnah)
2. Disbelievers who do not reject the taghut which they are ordered to stay away from. They do not resolve their disputes according to the Quran and Sunnah. (See verse 60 of Surah of Nisa)
We understand from this verse that Allah (awj) determined an order when inviting us to obedience. First of all, what Allah orders must be obeyed according to His word. Then what the Prophet orders must be obeyed by looking at his his word. Then what rulers among us order...
Pay attention to the verse, there is not a word "obey" before "those in authority among you". In other words, this word has not been mentioned for our scholars whom we will refer to, or for our rulers who order us...
The dispute will be experienced among the Islamic community:
"But if your Lord had pleased He could have made all human beings into one community of belief. But they would still have differed from one another." (11/Hûd, 118)
What should be done in case of dispute?
"...refer it to Allah and the Messenger (to resolve it), if you believe in Allah and the Last Day..." (4/Nisa, 59)
In this verse, the requirement is that any dispute must be referred to Allah and His Messenger regardless of whatever it is about. According to this verse, referring the disputes to Allah and His Messenger is a requirement for faith in Allah and the Last Day.
Ibn Qayyim (rh) says in the explanation of this verse:
"We concluded from here that if one avoids judgment according to the Qur'an and the Sunnah, his faith in the Quran and the Sunnah comes to an end."
