Meaningless ruling. No wonder I never see any Gh judge in international appointments, so a party can buy a member to switch and still remain in parliament? This should have been given to first year llb students to interpret .

This is laughable from a whole Supreme Court. The Judges interpreted the constitution correctly except for a slight hitch in the majority decision. They recognised that one can change party alliance and so loose his seat , however the hitch is , they decided to apply a time dimension to the interpretation which was not warranted by the text of the provisions in my opinion. They insist that an MP who has “cross-carpeted “ shall vacate his seat if he does so Mid-term but the same could not apply in this case because the elections would be for a future parliament. And that right there was the hitch that made the interpretation wrong. Two questions were necessary in this case and a yes to both of them would mean the MP would vacate his seat. 1 Has the MP in question left (currently) his former party or independent candidacy to join another party or decided to go as an independent candidate ? Ans. Yes 2. Does the MP despite the change in political alliance seek to remain in the current parliament under his former party or as an independent candidate? And Yes. By this article 97 G and H is sufficiently met the MP should automatically vacate his or her seat. THE COURT ERRED. The court has created more problems from this judgement. Can any political party sack a member who goes independent in the coming elections?

In a democracy, you represent one party at a time, so being in parliament and representing two parties or independent candidate, is neither here or there. You can NOT do that. You go to campaign and dish against yourself? Are you mad, sensible or human? Education has eluded us to this point to make this kind of argument in public. We are a country that are being watched by other countries and if these are our Judges. We will not be country to lead in anything. Tells the level of our IQ as a country. We don't write for writing sake and should make sense of what we write. What's the intent and what are you saying. We don't fetch water into baskets so how are you going to accumulate and be productive. Law is not that mad to be just law. Unless brainless minds are together. So the results is where we even go to seek for help, in Ukraine. If we are a sensible country at all. Our elite people are backward people who knows how to cheat and not accountable to the very people or person who appointed them. We live like animals without a leader, but they have their colonies and they are productive. Let's be sensible when we are in public not confined to political few chamber or under a stupid judge Court room. We are building a country and we have tomorrow to meet. So if you go to school come back and asked to make sense of a situations, you prove as such. Knowing some had made it through your journey also. We are making this country a country of no sensible elites, looking at what to show for, for our income and expenditure sheets. Corruption has made us hopeless to the core. No motivation making the street person not caring for anything but survival. We are becoming a lawless country and we will know shortly if we don't change our ways. What was in the minds of the drafters of the Constitution and the history of it. How will market women and hairdressers make things difficult for themselves? To interprete the Constitution this way. Let's be nation builders and know there is tomorrow. Think again. This judgement is like speaking at a Constitution reform commission trying to reform or amend a Constitution. Why the 6 months and 3 months timetable meant for? Why are the parties Constitution send to the High Court. So if you automatically leave your party why should you be representing them again and forming your own? We should think and again we are building a nation for tomorrow. Just saying.

@ Respectfully, you make little sense! Which of the four MPs has left their party TODAY and where’s the evidence? Please, quit the insults and just make your point. For all we know you’re not a rocket scientist to be questioning people’s intelligence. I don’t know what academic degrees you have but I’ll take the collective wisdom of the 5 concurring justices over yours any day.

Solid, watertight reasoning from the majority 🙌🙌🙌 Can’t help but feel proud of the justices for interpreting the Constitution so painstakingly. They tackled the issue of jurisdiction ab initio before addressing the issues in dispute. And what can I say about the beauty and succinctness of the language!
