Your explanation on limitation is very useful. I want to know that transfer of a property from some legal heirs to one legal heir was fraudulently done and while suit was filed in the Sindh high court and stay was obtained within few months of transfer. Meanwhile, defendant gifted the property to his son before the said stay was obtained. This fact was concealed and no such information was given in written statements by the Defendant. After 13 years during the pendency of the said suit this fact came to the knowledge of the petitioner, if the petitioner after 13 years when the suit is still pending add the beneficiary of the gift as party to the said suit, will it be considered time barred. I shall be grateful to receive your opinion. Thanks and regards

Yes you have right to challenge such fack mutation in civil court Limitation run from the date of knowledge of fraud & its expaire after 3 years.

Sir mashallah your lacture is up to the mark... But I actually correcyrone thing.. The reference you gave in your topic about pre emption that is about section 13 not 12 tal be muwatibat, talbe ishhad and talbe khusumat. Talbe ishad is a demand of notice...... Section 12 is about revocation of sale within 60 days as per contract.
