Can you implement that clause that allows you to apply their rent to the late fees first, if they already signed the lease agreement? In other words if that clause is not in the contract can you still use it? Like if they sign the contract agreement on the first of December and then you want to use that clause going forward but they already signed, can you create an addendum stating the contents of that clause as going forward to being used if they are late? I ask because I just bought property with tenants but the agreement is signed but I want to Use that clause that you’re speaking of. Can I use it or not being it wasn’t in the agreement to begin with.

If you’re going to amend a contract you usually need the other party to agree to the amendment.

@@LandlordAttorney thank you! I figured that. How can I enforce payments of a late fee? Meaning, if they were late for January and got an added late fee but then they pay February but haven’t paid the January late fee.. How can I enforce them to pay the late fee before taking February payment?

If you are using a state realtor's association lease, usually it has an application of funds clause in it. Then if you use Turbo Tenant or a similar software to collect rent, in many cases it allows you to turn on a feature which applies delinquent fees FIRST before it allows them to pay off the rent due balance

@@dongorgon612 This is difficult to answer without seeing your lease or knowing what state you're in. Generally, you can apply money to the oldest debt first, unless your state or local laws prohibit it. The Application of Funds Clause is simply a good term to have so that it is crystal clear to both the tenant and the court.
