Quack SAN.!! Amendment was made after the appointment of Egbetokun as IGP. Is it not the law in Nigeria that Legislation doesn't apply in retrospect? Egbetokun cannot benefit from the Ammended Police Act because he was appointed IGP in 2023 before the 2024 Amendment and the Amended Act did not state that the Amendment will apply retrospectively.

If a country law or other countries laws are always adjusted thru the back doors of their country's legislatives. Then of what importance is the drafting an enactment for constitutions in every country. Is the constitution not a binding law and bond stipulated from the set up of sovereign nation to be abide by both the leaders and the citizens to comply with and to hold in high esteemed and integrity? Or are constitutions becomes piece of write ups that hold no magnitude of water to contend with any longer? So leaders and politicians can just dabble into it and rewrite the constitutions to meet and suits their interest at will. This is an act that must not be tolerated by any nation as it creates an act of confusion and anarchy. There should be respect for the constitutions and the rule of law by all abiding citizens of every nation.

The truth is that if the PC wants stability in the leadeship they would have recommended someone that is within that age bracket who will be within his active service. The IG is still police officer and would be bound by the extant laws of the police. This is setting a bad precedence and will always create this chaos.

Thank you SAN for this very informative and educative session. 1.There is a general provision in the constitution and there is a specific one also and the specific supercedes the general when there is a conflict between the two. 2. The amendment to the police act is to ensure IGPs stay enough in office to be able to see to the implementation of any reform or positive change they introduce or bring. My own addiction is that the amendment that started with the present IGP is not going to end with him. If you think it is done by Tinubu to favour the IGP remember that another iGP will later come and most likely not a Yoruba. He can be Igbo or Hausa, appointed by a PDP or LP or NNPP government. For some people, facts, figures, and authorities do not work but only emotions and sentiments driven by political and tribal hatred. That is why they refuse to make any sense of all the SAN has said.

To be eligible for the office of inspector General of police in Nigeria one must not be more than 60 or has spent 35 in service. That is the basic rule. Egbetokun fall short of the rule.
