The landlord gets it not the estate agents. Legally they wouldn’t get away with doing that, plus there isn’t much insentive to do that, the landlord has to pay fees for the estate agents to take care of all of this so in the long run messing around keeping people’s deposits wouldn’t be cost affective, plus the property would be empty and getting all damp and stale as it isn’t lived in/ appliances being used. You’re actual an ideal credit card person. Get a good one with points for travel etc and you’ll build good credit (which can take a few years to do).

I agree completely with what you said about the service from estate agents and the STRESS of moving post covid!! They have so much interest in each property now because of the demand that where I live it’s the same, they literally do open viewings and then let every person submit their application for the landlord to choose from! Rather than like first come first serve like it used to be. The service is horrendous, they make you feel like they are doing you a favour, when you’re the one chasing them, and paying them! Then when things are wrong with the property that you are paying crazy money for, they act like you’re being demanding 😂!!

I’m in Scotland so not sure if it’s the same in England but whenever letting agents/landlords have been a problem if you threaten to take them to a tribunal they change their tune real fast. When I was younger I was given the option of providing a guarantor or 3 months rent in advance, asking for 12 months rent is a huge red flag and a complete trap. 12 months of dealing with her? Absolutely not 💅🏻 you’ve definitely dodged a bullet and letting agents can be soooo cheeky for no reason in emails so be proud that you stood up for yourself 💖 x

Trans union is a great credit check company, used it before I starting the process of buying my first home . I have a credit card and I only use it for petrol and train tickets, things I have budgeted for and pay off as soon as its on the card.

Definitely get a guarantor I had to do that once. Their insurance is void if they don’t have a complete credit check. Their hands are legally bound so I promise they aren’t just being awkward. As for keeping your deposit just keep pushing back and they should refund or partial refund minus admin fees.

You probably have a CCJ on your credit file which would have been flagged up on their end during the reference process. You can speak with the civil courts (small claims) to get this removed as they would have made a judgment on the unpaid parking ticket in your absence. You can apply for them to remove it and explain you weren’t aware of the letter which should resolve things! It happens all the time so don’t worry. Hope this helps queen x

At school our business teacher said that we should get credit cards and buy a loaf of bread every week on it then pay it back to build up our credit scores. But to get a credit card you need to be a uni student or employed (probably on a decent wage). But I have become chronically ill so dropped out of uni and am unemployed!

I live in the US, but have had a horrible rental experience recently. I lived in a comfortable apartment for 6 years. I wanted more room and a new space. Moved into a townhouse, the land lord ended up being a scumbag and ghosted us when we had maintenance requests. I’ve had to go to the housing authority and am in the process of taking him to court. Same happened to me back in 2018 - I failed the credit checks and we lost £500. It’s very clear in the contract you sign when I hand in the deposit : if you failed credit checks or decide to withdraw you loose that money - so it’s legal unfortunately 😞

I’ve been a realtor outside New York City for 25 years. She should’ve not handled it that way and honestly she should’ve returned your deposit. It’s very silly to treat a a client that way. When dealing with potential renters I am always the same as I would be with a sale- one day they will be buyers and if you treat people right they will use you. My advice is to definitely speak with that mortgage rep you spoke of and at the same time go around and start interviewing real estate agents and see who you click with instead of just calling whoever lists a property.

The same thing is happening here in Australia. There is a shortage of properties available to rent as house prices are soaring and ppl can’t afford to buy. Landlords are picking and choosing for all the wrong reasons. My son has had to move back home as rent prices skyrocket. Emma make sure you get your money back as none of it is your fault. You’ve hit the nail on the head, so much competition and disrespect where estate agents are concerned, literally treating us like 💩🥲 renting pre covid was sooo much different and easier so I relate to this so much, even though where we live atm isn’t ideal for my own sanity I need to get off this rollercoaster of will I rent somewhere new won’t I 🤦🏻♀️ maybe this is the fucked up way our generation will finally become homeowners on the property ladder because the renting system basically have given us no other choice 😂

282 pound debt is not a reason to deny somebody an apartment or a home that is insane. It sounds like they are trying to increase the rent and get somebody else in. There will pay a lot more after seeing the interest in the flat or trying to push somebody to get a lump sum upfront, something is definitely fishy about this

I am very anti-credit card. I only want to buy stuff. I have the money for it, but after speaking to like a credit expert, getting a credit card was the best way to go literally in like eight months. My credit score jumped over 100 points, just by using it every month and paying it off.

She had to get you to withdraw your offer, or she couldn't keep the holding deposit. If you fail the credit or reference check they have to return it. If she told you otherwise she lied and they should be referred to Trading Standards because they acted illegally under the Tenant Fees Act 2019. If you have her lying in writing you can leverage it to get your holding deposit back. If they'd do it to you they'll do it to others. I had the same credit problem when I was looking into mortgages pre-covid. I'd never borrowed so I had no credit history. Get a credit card from your bank, set it up to automatically pay off the full balance every month and just put your groceries on it. Then you're not tempted to spend money you don't have, it's just for groceries. There's so many pitfalls in renting these days, you have to keep your eyes open. It's a shame if the landlord was decent they picked a bad agent.

I live in the south in the states and it is somehow even worse than you have described. In order to rent, you have to apply. Sure. But then you have to pay to apply. It is, of course, non refundable. Now that you have applied, you then pay a deposit. And where I live the rental rates call for making three times what you make a month in order to qualify. As my rent is now 1700 a month, I would have to make over 5 grand a month. Fortunately I have lived here for seven years, but when I first moved in rent was $725! It is a ridiculous scheme and preys not only on poor people, but also people who happen to have unconventional aspects of their lives (self employed, arrest history, debt, whatever). It is gross. I'm sorry this woman was so cruel to you. She is either fully jaded or just took a dislike to you for some reason.

I get what you mean about the service industry. I’m a little more empathetic so working in customer service I would never be rude to my customers. Everyone is going through shit and I would feel awful if I was the last straw for someone, so I make it my purpose to be kind to everyone because I go to places all the time and get treated like trash just for being a customer?? So here is some insight... As you didn't declare the unpaid car parking ticket, this means you've failed the referencing and because you've failed a lardlord/lady would not be able to accept you in their property as it would make all of their insurances invalid. Obviously, a landlady/lord could accept you at their own risk, but it all depends on the person. It costs money to go through all the referencing checks, hence why that's a non refundable fee. Its very annoying, I know, but next time, just make sure you declare this unpaid ticket. Otherwise, the same thing will happen again. Good luck!! X

Hello lovely Emma, you should be able to get your deposit back The landlord or agent could keep your holding deposit if you: decide not to rent the property give wrong or misleading information cannot pass a 'right to rent' immigration check They cannot keep your money for any other reason. For example, you should get your holding deposit back if you fail a credit or reference check, as long as you give honest and factual information about your situation.
