If someone is not completely sue about the German contract content they can ask for a non-binding translation of the contract and its very helpful. Most established employers will be happy to offer a non-binding translation.

Hi Martin, a tariff agreement is a written agreement on employment conditions between labor unions (as representatives of the employees) and employers' associations or individual employers. It regulates, for example, applicable working hours, wages and salaries, or vacation days. Companies covered by tariff agreements often pay higher salaries. The amount of the salary is usually determined by standardized salary groups based on the level of qualifications and work experience, length of employment or other factors. Whether a tariff agreement applies to your work contract or not depends on the type of tariff agreement and the specific agreements in place. Many of the large German corporates in the metal and electrical industry, for example, pay according to the tariff agreement of the IG Metall labor union, e.g. Audi, Thyssenkrupp, VW, BMW, Daimler.

Hi, suppose if I have already signed a contract and the employer has applied for a zav letter. At the same time I got a better offer, and there is nothing mentioned in the contract about terminating it before the work start date, then, 1. How to break contract? 2. Will it affect my visa process as the new employer might apply for a zav approval again? 3. Is there anything I need to consider by the law to break a contract?

Hi, I cannot give any legal counselling, for this I would suggest to contact an employment lawyer. You can usually find information on how to terminate your contract in the contract itself. From my experience, previous employments or applications like this are not taken into account for future approvals, so I hope this would be the case here as well.

Is there anything specific that needs to be checked if there is a variable pay in the agreement? E.g. will it have to mention how it is paid, or will the contract only give the amount and refer to an internal policy for payment terms? Also, do the contracts mention anything about existing or future works agreements (Betriebsvereinbarung) and which specific clauses in the contract may be overridden by these?

Hi Ashish, it really depends on the current state of the company, your job and of course of your performance. Luckily, not all businesses and roles are affected by the recession. But generally speaking, the company can easily terminate your contract during probation period. I hope it works out for you though!

Hello, I wanted to ask about my case recently faced, I have contract and offer letter from my employer in Germany and forwarded to the relevant embassy for visa facilitation. However, I have filled the online application for national visa and similarly the embassy has noted the following two aspects to be considered for my visa issuance: 1- Blue card ( Assessment) 2- National visa with consent of Federal Employment Agency Now, as the process for blue card is lengthy and I am not going with that and only want to process my documents based on the employment contract which I have signed. Can you please explain the difference between direct employment contract and Blue Card, and certain instruction to follow for my appointment. Best Regards,

Dear Abdul, The employment contract alone is not sufficient to apply for a visa, unless you are an EU citizen. You need a visa and later a residence permit (e.g. an EU Blue Card) to enter Germany and start your work. It's generally good news if you are eligible for an EU Blue Card. The EU Blue Card offers some advantages and many embassies give it priority over other visa applications. Hi Meetra, Very nicely explained.I have a question.Is Christmas bonus also counted as a part of the total gross salary for eligibility to apply for german blue card.

Hi Aparna, Unfortunately, we have made the experience that this is handled inconsistently. Among other things, it depends on whether the Christmas bonus is paid as a voluntary bonus or as a fixed additional payment (e.g. 13th month's salary). In general you are on the safer side if your fixed salary is sufficient for the blue card threshold.

@@HalloGermany Thank you for the response Meetra. Actually fixed pay is not meeting the Blue Card Requirement but the contract says that one month of gross pay will be additionally paid as a Christmas bonus. The total amount hence exceeds Blue card requirement.
