Yes, they should have. Dr. Phil has it all wrong. Trump was not convicted of paying off a porn star. He was not convicted of missing funds. He was convicted of falsifying business records to pay off a porn star. He tried to pass the payoff of Stormy Daniels as a business expense because the felon was too cheap to just pay her right out. If he had just given her the 130K there would be no crime. But the cheap felon had to give it to Michael Cohen and pass it off as a legal expense. That is illegal in this country. You cannot pay off people for immoral or illegal acts and pass them off as business expenses. You need to get a clue, cultist.

Based on previous episodes it's not something I picture her truly believing in. And he clear statements of "the prosecutor her was trying to" and other statements where she made it clear she was starting the opinion of the prosecutor, she made it clear it wasn't her opinion. The other side need not be right out in the right. It does need to have a voice for a discussion to happen.

Judge Merchan gave the jury unconstitutional jury instructions. “Falsifying business records is only a misdemeanor. And the charge against Trump was long past the statute of limitations. So Bragg invented a “novel legal theory” that there was another crime that was committed to cover-up the falsification of records, and that crime magically turned the misdemeanor into a felony. Bragg refused to reveal what that second crime was, claiming it was not necessary! Then at trial the defense was never informed what the second crime was. only during final jury instructions did Merchan reveal what the second crime was…however he gave the jury a multiple choice menu of three crimes they could choose from and they did not have to be unanimous in the decision of which crime they chose. This presents a reversible scenario in that it defies the 6th Amendment rule that a defendant has the right to know what crime he is being charged with. Also a jury must make a unanimous decision as per all elements of the crime. Obviously Merchan’s jury instructions defied that law. Yes indeed Trump was charged with a misdemeanor, past the statute of limitations, fraudulently turned into a felony based on a “second crime” that Bragg refused to identify. In fact that so-called ‘second crime’ was never identified during the trial. Only when Merchan gave unlawful jury instructions was this ‘second crime’ articulated, and it turned out to be multiple choice. This means the law of unanimity in a verdict was broken, which also breaks the 6th Amendment. The Sixth Amendment of the United States Constitution requires a unanimous jury verdict in criminal cases for both state and federal trials. This requirement applies to all issues that the jury is tasked with, such as the degree or character of the crime, guilt, and punishment. The Supreme Court has recognized this requirement since at least the late 1800s.
