Hello. Thanks for the video. I have a question. I am registered with ASCAP as a writer and publisher. In 2012 the song was signed with the label. The label owes master track rights but never assigned ISRC code to the song. Is it possible for ASCAP or SoundExchange to survey for performance/digital royalties? The label's response is that at that time they didn't have a publisher. Also I couldn't license the track myself at that time, since the label owes all the licenses and rights. Where do I stand on that? Thank you very much!

Ok. This is interesting. Couple thoughts. The record will be hard to track without ISRC codes. You likely don't have the right to assign ISRC codes if you don't own the master track. Now you could submit as a publisher and try to acquire the royalties. Not sure what they may have done to prevent that. However there is a issue here. How can they own the license the record without being the publisher? Their are multiple licenses involved in a record. They may have the master license but they need the need copyright ownership to secure the others. This is a little messy. It would likely take some work to clear it up and on the end you may be able to retain a portion of the record. What are you looking to do with the record?

Artist can get paid from KZbin through various platforms. KZbin allows you to monetize your own channel. Then you can collect from other videos that may use ur music through various means: distribution platforms(like distrokid), publishing admins (like Songtrust), or companies that specialize in collection from youtube like audium. The better question is: Do you want to fine, cease and desist, force ads, etc. to generate revenue from your supporters

By far the best explanation of these topics that I've seen on YT. Question: If a cd with one of my songs in it it's being sold at Walmart, and they have 10 CDs on the floor does that mean that I get paid my share of those 10 CDs?. Because, I am assuming that the record label sold those CDs to Walmart for them to make a profit. Am I correct? Thank you for your time.

Vidal Valle thanks for the support! Hmmm ok - so the short answer is yes. But it's tricky. If you are the writer than you are owed 9.1 cents per sale. CD's are sold wholesale so that's about 91 cents if they only have 10 in stock. However that 91 cents is for the writers to split. So yo split that with the producers and other writers per your split sheet. Additionally- if you are the artist then you also receive an artist royalty which is likely 8%-20% pending your deal. All of this also depends on whether or not you own your rights in the first place. But 10CDs is small for a bulk order so you are likely owed more.

Fender Frank hey it really depends on the scenario. Each PRO calculates it differently. Normally the measurement will include some sort of metric(s) for the volume of impressions l, length of the usage of the record and such. So a live performance for a karaoke bar or a life performance for a small concert versus a large concert or a televised performance will all pay out differently.

You would make them an in house producer. Your contract agreement will determine what you're owed. If you agree with the producer to give up some royalties then that's where your money comes in.

John Dave a song can be registered twice. It's common that this happens more than twice. It won't matter if the other publishers register you or not. Though it would help the PRO out a lot. From what I understand; publishers consolidate this information some how and are able to match your entry with mirrored entries. However each PRO is different will have different methods to deal with this. I always register everyone involved and keep the splits on file. I haven't had any problems from multiple registrations. I have been contacted regarding the matter, when there is a variance from one submission to another. Generally PRO's will hold all the money until all publishers and composers come to an agreement and correct their portion to match. No one wants their money help, especially since royalty pay periods are so spread out. So generally situations get cleared up quick.

John Dave so this is a rather complex situation. So yes you can register two versions of that instrumental one with vocals one without the vocals. In this case the instrumental would be a song of its own once you add the vocals to the record it is now a new song. So if you released an instrumental disk or album or EP on a streaming platform for example, then you would receive separate royalties off of that instrumental. You would have to treat both songs a separate songs and track them the same they have to have different ISRC codes and all of the other tracking systems. As far as the second thought. You can keep all of the publishing for the instrumental song if you were the only person that created it or you negotiated or purchased the publishing from all the other people that contributed to the composition of that track. However you cannot legally take the publishing from everyone else involved unless they've agreed in writing and typically there has to be some payment for that ownership exchange.

ロボット失恋 that's tricky. You need that documented. Common law copyright will still give him ownership of his half of the copyright and thus his half of the publishing. A split sheet would help notate that he is indeed giving you ownership. Or a simple custom MOU. And you would need to copyright the record as the only rights owner. CD Baby may have some tools to help so this. Either way it's an easy fix. You need their signature on any legal document that specifies what you agreed to WOM.

Muayed Alsherif many people believe that the producer is the publisher and the songwriter is the songwriter. When the truth is that both the producer and the songwriter are publishers and songwriters. The historical reference explains why. Producers had to physically write their music on sheet music Back when this system of payment was invented.

Victoria Crump hey it would depend on the agreement. Most producers, that sell their beats online,do not give up their publishing. An exclusive agreement typically gives you the right to use the beat and sell the song without limitations. However the producer will still own their publishing on the record.

Exclusive and I collect royalties. Now, how do I add him or should I add him when registering the song. Most of these beat makers business side is crazy. I bought the track exclusive and when I asked him for his information he just gave his email and name and sent stems tracked out. He produced track Me and one other artist and I do have split sheets filled out. Do I add him on ascap registration.

Victoria Crump I would to avoid any future conflicts. The producer has a lot of power in the publishing world. If he/she did the whole track themselves then they own 50% of the record. That's enough to get it snatched off of radio if the money comes back funny. However you are only responsible for yourself. It's good will to include all the players. In the end, a signed split sheet is the only legal proof unless the producer also registers the record with the same numbers

ok so add him under composer, me, and other artist for our lyrics and under writers me and other artist. I appreciate you patience and help. so under ascap put him as composer/writer, me, and other artist. so out of 100% 50 goes to him 35 me and 15 for remainder artist. I will send him a split sheet etc

Puente Loops OK now it makes sense. So that portion is an introduction to the show itself. The music in the background belongs to one of the artist that I work with. They created an introduction theme song and chopped up some clips of previous speeches that I have done and made a collage of the speeches at the end of the song. This portion does not necessarily make sense in this order. It was created to showcase some core values that I present through these videos. I did feel like the intro was too long for the beginning of the video so my newer videos have a shorter introduction. However I do keep that song at the end because I like the message. Lol I can completely see how this would be hard to understand if English is not your primary language. No worries. Thanks for the support.
