There is no 90 days period prescribed in crpc to submit chargesheet. 90 days period apply in case where accused has been arrested. Investigation can continue without any time frame.

Very nice narration of the incident Sir, the charge- sheet is always filed against the Accused persons after completion of Investigation.Time limit of 30/60/90 days for filing chargesheet is always from the date of arrest of the Accused.If there is no arrest,there is no time limit for carrying out investigation and/or for filing chargesheet . In the present case till now there is no arrest yet so there is no question of filing chargesheet.

Nice report .. but some errors in your report- 1. In India, a chargesheet is to be filed within 90 days of arrest and not 90 days of crime incident. In this case in Canada, there has been no arrest yet so any clock hasn’t started as yet. In India the arrest comes first and then police still keep on investigating etc and has 90 days for chargesheet, In Canada - arrest is the last step of investigation (and not first), once all evidence is summed up and everything is clear the arrest happens and then charges are submitted in court within 48 hours 2. Police Jurisdiction issues on whose case it is in Canada are extremely rare. In this case the issue cropped up because there used to be no Surrey police services and Surrey used to be under RCMP, in around the same time by passage of a law- Surrey Police Services was formed and RCMP was transitioning all powers to Surrey Police for all cases in Surrey jurisdiction. So kind of both police services were having say in Surrey jurisdiction because of ongoing transition. 3. CSIS can’t share evidence to anyone by law who hasn’t got CSIS security clearance as per the law. That is why even premier of British Columbia (like CM in India) has not been shown evidence and just informed about allegations. Leader of opposition has been offered to go via CSIS security clearance if he wants to see evidence but he has refused for security clearance as it would result in him not being able to speak up on certain issues and politicians will never want that for obvious reasons. So question of sharing evidence with India is near impossible under current Canadian Law, unless an amendment to the law happens . Only allegations can be shared, it’s weird but that’s how the law is currently.

What he would have shared with India is the allegations basis the evidence with CSIS, he can’t share evidence without court’s approval or CSIS security clearance. I don’t know if he ever said that he shared evidence with India, I think he would have said he shared allegations with India. Though I am not sure, will have check his statements to confirm
