This is just to put a proper legal context on what the forum's guest is saying. First off, it is true that the power of Congress is plenary, if not all-encompassing. But as applied to legislative inquiry, there is a constitutional limit to it, that is, for any of the committee conducting hearings to RESPECT the rights of the resource persons invited therein. One of these rights is to remain silent, or equally not to respond to any question raised in the forum. If truth be told, VP Sara Duterte did not disrespect the committee members altogether, as in fact she attended the budget hearing called for the purpose. But, noticeably, she served notice to the committee that she leaves the OVP budget for 2025 to the prerogative of the House. Her reasons are simple: the topic under consideration is not related to the budget proposal but to past years' confidential funds that had been deliberated and already answered during the 2023 budget hearings. Although Rep. France Castro has the right to raise the matter, in the exercise of congressional oversight, VP Sara Duterte is not proscribed not to respond. Under the House rules, only witnesses may be compelled to do so. She is not a witness in that proceeding, hence she is not bound to the compulsory effect of the same. If the appropriations committee members would want to elicit information pertinent therefor, they could summon the Commission on Audit (COA) for any Notices of Disallowance (ND) that had been issued. It's noteworthy to consider however that the OVP is still given 180 days to reply to the COA-issued disallowances. At the time of the hearing, COA has not consolidated its action regarding the matter. So if VP Sara Duterte did not respond to the same query involving the confidential funds subject of the NDs, it is her right to do so. After all, as Atty. Melvin Matibag very well knows, there is no law penalizing any act of refusing to answer during a congressional inquiry. The most that the committee can do is to cite the resource person in contempt for failure to cooperate. This the members did not do. In fact, the committee chair allowed the vice president to leave the hearing freely, after the latter politely asked permission from the former. As to the issue of "state of mind" that Atty. Matibag has mentioned several times here, let the forum's audience be guided that the congressional proceedings in question are "legislative" in nature, the purpose of which is simply to formulate binding statutes, whether amendatory or original, emanating from the data culled from the proceedings. The same proceedings are remotely "criminal" in nature, where the "state of mind" of the accused (or resource person, as in the case at hand) is not even considered in the appreciation of evidence. More so in any legislative inquiry, since "motive" is not a factor, although persuasive to say the least, in the formulation of laws. Indeed, if one cannot divine a person's state of mind, then it is pointless to even probe into the reasons why VP Sara Duterte would refuse - and still continued to refuse - to actively participate during the budget deliberations. This, finally, brings me to the matter of "parliamentary courtesy". Like any tradition, any person has a choice to be bound by it. It is discretionary, not compulsory. Hence, if VP Sara Duterte believed, and rightfully so, that the hearings to where she is invited are fora of fishing expeditions for purposes of possible impeachment, then the committee cannot and should not expect any form of reciprocity. Respect is earned. No person can compel due respect from another if he cannot even impose respect upon himself. Again, this is just a tradition or parliamentary more. It does not have any force and effect of a law. On hindsight, VP Sara Duterte is correct. As to date, there is already a groundswell of support from among congressional lawmakers to endorse any impeachment complaint that may be filed such as, among others, the one being drafted by former senator Antonio Trillanes. Last but not least, let this matter be brought to the attention of this platform's viewers. During the plenary interpellation of the proposed GAA, the budget of Philhealth was tackled. One of the speakers, Rep. Tim Adaza, refused to yield the podium to another lawmaker, Rep. Willie T. Lee, who challenged the quorum and the overly-inflated proposed budget of the healthcare agency. To any one's mind, this is not the kind of courtesy that even among members of the House of Representatives should grant to its member. In light thereof, should VP Sara Duterte be blamed for staunchly defending her stance not to yield to the appropriations committee? I don't think so. Just a humble view for Atty. Melvin Matibag to ponder. Thank you!
