FAMILY CODE: Paternity and Filiation

I now fully understand why the status of my filiation in my baptismal is 'illegitimate'. It made so confused that leads me to gather information on why we're all siblings have illegitimate filiation and can't bear the surname of our father. Head held high Sir, it makes everything clear to me and inflict lot of knowledge albeit it's quite complex to fathom considering few unfamiliar terminologies you've cited. Thanks a lot Sir.

My eldest sister (panganay) was born 2 years before the actual wedding of my parents in 1993. So my Mudra had no choice but to register my sister's name under her surname because the only way to get father's surname that time was through marriage. But she did the trick during my sister's school days. Instead of submitting the original NSO birth certificate, she submitted Birth certificate from our municipality in which my sister's surname was from my father. But when she enrolled in FEU college in 2007, the NSO birth certificate was the requirement. Luckily, a new law was passed where illegitimate children can now take the father's surname. My mom processed the all the requirement needed to change my sister's surname and submitted the newly issued NSO birth certificate to FEU. Problem solved. P.s my sister's surname is still from my Mother but there is an annotation on the right side saying that she can use the surname of our father.

I know this! My eldest sister was born in 1991 but my parents only married in 1993. During her enrollment in college, the FEU registrar required her to submit NSO issued birth certificate. But my sister's surname written in the report card was from my father. So my Mom processed the papers to change my sister's surname. Luckily, there was a new law passed in 2004 saying that the children born before the marriage can adopt the name of their father. P.s. my sister's surname in PSA birth certificate is still surname of my mother. But there is an annotation on the right saying she has the right to use our father's surname with the effectivity of subsequence marriage of our parents.

Good eve , attorney. Ano po ba ang requirements para makaapelyido ng anak ko ang apelyido ng boyfriend ko ? Nung nanganak kasi ako ay underage pa ang boyfriend ko at sabi sa civil registrar ay hindi raw pwedeng dalhin ng anak ko ang apelyido ng tatay nya. So ayun po, apelyido ko po ang dala ng anak ko. Hanggang ngayon po hindi pa po kami kasal.

magandang araw po atty. maari po bang magamit ng aking anak ang apelido ko kahit hindi kami kasal ng kanyang ina. ipinanganak po sya ng september year 2000. at may pirma din po ako sa likod ng birth cert nya. sapat na po ba yun para magamit nya at mailagay ang apelido ko sa pagkuha nya ng mga goverment i.d at passport at ganon din po sa school records nya.

Atty. Papano po kung iniwan po kami ng asawa ko at wala na po communication up to this moment 6 years na at nasa akin po ang anak namin. Gusto ko po sana magkaroon ng cuatody sa anak ko. Papano po gagawin

You can have exclusive parental authority at custody sa anak nyo dahil inabandona kayo ng asawa mo. If you like, you can file a petition for legal separation. Among others, mahihiwalay ang property ninyo at makukuha mo ang exclusive parental authority over your children

Good morning. Sorry for the late reply. Dahil hindi sila kasal ng nanay ng bata, illegitimate ang bata. Pwede naman ipagamit ang apelyido ng kapatid mo by filing an application sa Civil Registrar under Republic Act 9255. Pero, I suggest para sa best interest ng bata i-adopt ng kapatid mo ang anak nya. By adoption, the status of the child will be changed from illegitimate to legitimate at magagamit ng bata ang surname ng kapatid mo.

We should remove laws discriminatory to illegitimate children like reducing their inheritance to half of those legitimate children and the iron curtain rule. I mean the state can enforce any laws for the sanctity of family, punish those who commit adultery, concubinage and bigamy as well as requiring the parents to support their children but the state shall not discriminate innocent children born from the consequences of their parents. Illegitimate children should belong to quasi-suspect class similar to women and lgbt. But how certain groups can afford heightened protection of suspect classification. These are the requirements: 1. History of pervasive discrimination 2. The trait that causes discrimination against them has no material effect on their ability to contribute. 3. Immutability or the inability to change that trait because it is inherent to them or so central to their personality when you force them to change it would damage their own personal self (like sexual orientation, skin color, sex, national origin and ethnicty). 4. Those groups are only insular minority politically powerless to change the law against them or afford the law to protect them.
