Did any court declare the 24 law makers seats vacant? 2. Did Gov Sim has singular authority to declare their seat vacant? 3. Is it truly right for the court (as approached by the 24 member) to declare the action of gov Sim wrong? 4. In all these, has gov Sim acted right? 5, Is it right for professionals like lawyer to come to national TV castigating the judgement of a competent court just because they're politically biased. 6. 1. The law says you should vacate your seat if you defect to another party. The speaker declares your seat vacant. No court needs to make this decision. 2. Gov. Sim did not declare their seats vacant. He is acting on the decision of the speaker of the remaining 4 lawmakers. 3. This decision is for the higher courts to make. 4. Sim is in a political battle with Wike and his allies for the control of state resources. By his popularity among the Rivers people, you can tell he is on the right track. 5. It is wrong to condemn court judgment on national TV, except when there's an obvious flaw with that judgment. A judge quickly pronounced judgment based on an Appeal Court decision, knowing that the matter was still at the Supreme Court. Besides, when you stop the allocation to a state (knowing that this will defund schools, hospitals, civil servants, pensioners, and developmental projects), people will question your motive as a Judge. Unfortunately, similar abnormal decisions have been coming from the Federal High Court in favour of Wike. You don't have to be politically biased to observe the trend. 6. Fundamental blunders had been made by Fubara already, his blunders have given no room for faultlessness in the judgments of the high court and appeal court. Any reasonable person should understand that only law will be tested in these matters, not public opinions. There is nothing in the Constitution that warrants the seizure of Revenue belonging to the State by any agency of the Federal Government. Let me also say this; A governor who withdraws money from the Revenue of a state without appropriation or contrary to an appropriation law is liable to impeachment. The punishment is not seizure of the Revenue belonging to the state. There is nothing in Section 120 of the Constitution that provides that the Revenue of a state should be seized if it is spent without without a valid appropriation law or contrary to a valid appropriation law. Where a governor spends the Revenue of a state without appropriation or contrary to an appropriation law, it is a gross violation of the provisions of the constitution(gross misconduct) and therefore an impeachable offense; in accordance with section 188 of the Constitution. The issue of whether the Revenue of a state can be withheld under any circumstance is not even justiciable. Therefore, I would like to see the Court of Appeal reverse the decision of the Federal High Court with respect to withholding of Revenues accruing to Rivers State. Fiscal Autonomy is the hallmark of Federalism. The money in question does not belong to the governor who supposedly is spending same unlawfully. So, if Martins Amaewhule and his colleagues believe that the governor is withdrawing and spending moneys belonging to Rivers State in a manner that grossly violates the Constitution, tbey should commence an impeachment process against him. The route they have taken is unjust and unfair to Rivers people. Note: I was not analysing your emotions but what I believe is the postion of the law.

The Governor failed to recognize the 27 Assembly members, even when the Court had not declared their seats vacant, he was the one who decided to present a budget to 3 people but our objective analysts cannot ask the governor to recognize the lawmakers.

The Governor needs to take them to court (Federal High Court), and if he is able to show that they defected WITHOUT any problems in the party, then the court will pronounce their seats vacant! Until then, he is only acting like an "emperor" by not recognizing them. That is the law!

Rivers is the only state in the South block that delivered 2million votes in 2015, and till date the only state in all of South that can do so. It is the only Swing State in Nigeria. 2027 election is the problem of River State, soon to be the problem of Nigeria and by extension problem of Africa.
