Non-competes in employment without additional or high compensation need to be barred. It is different if you sell your company to another party that you cannot go back into that same business in the same area for a set number of years. When I was in college I about to be hired until the owner brought out a non-compete. All I was going to do was carpentry work. I told him to screw himself. Three days later I got a job with one of his competitors. The owner there laughed when I asked if I had to sign a non-compete and said, "why the hell would you need to do that?"

Investment in training, protection of trade secrets are valid arguments for non compete clauses. Personal freedom is just as valid against them. The compromise, as it exists in France is a non compete signed at hiring, that is compensated by an indemnity equal to the salary over the period covered by the non compete, irrespective of who is ending the employment contract.
