In 1967, the Supreme Court limited that right by announcing a legal doctrine called qualified immunity, ostensibly to protect government employees from frivolous lawsuits. Anyone who has read the Constitution knows that its brief text is subject to different interpretations, even by so-called originalists. Supreme Court justices don't make law. So qualified immunity is unconstitutional.

I have yet to see any police dept investigate the conduct of their officers and find, "They violated the rights of the citizen, broke the law and made a false arrest."

if she did left the scene and not gave info, that's pretty much a hit and run. idk. there are 2 sides of the story, and i don't know which one is the truth. 1 side she claimed she did give info to other driver and both decided not to involve police. the other one is saying she just left the scene and the other driver ended up calling the police. you pick.

I'm more concerned about the children that were left alone. I don't care that the oldest was 15, there was no effort to make sure they had access to an adult in case of an emergency. The police could have had them contact a family member or family friend or anybody willing to make sure the kids were okay until the parents could return. That is extremely concerning to me.

Concerning? I'm sorry, but when is a 15-year-old child incapable of watching other children. People are paying younger children than that to babysit children. GenX and latchkey children survived and are alive and kicking. Where were the children going - nowhere? Based upon the house, her ring and the locality, they were going to be just fine in their neighborhood

My girlfriend was wrongly arrested in a grocery store. Her son was 10 yrs old They took her away and left him there! They wouldn't tell him anything. After her constant protesting that she had to get someone to get her son they let her use a phone to contact a family member.

@@moneymoney12 What if one or more of the kids had a medical condition or illness? Do parents not get arrested all the time for leaving kids unattended at home? This will cost the city millions. Sounds like somebody is jealous at the PD. All charges dropped is death sentence for city in civil suit.

I had a fender bender in a parking lot in Texas. A private parking lot. Two police officers saw it happen. I asked them to attend to the accident. They said it happened on private property and they have no jurisdiction. The other driver and I could sort it out ourselves.. So much for police presence.

Uvalde was an unfortunate reminder of their real priorities with the public. Arrest the parents trying to save their kids while also waiting around for an hour as the children bleed out for “officer safety” then later threatening a mother who spoke to the media with probation threats

failure to stop and give information in after an accident in Texas is exactly that.. she didn't brake the law because she was there present and had an agreement with the other driver..

Exactly. She did the other driver A FAVOR. He was at fault. Legally their choice since their was no injuries and minimal damage. That is absolute BS that the cops think they can show up after the fact and demand personal information. There was no “Investigation “ so there was no “interference”. Clearly these cops picked the wrong ones to mess with.

It doesn't matter who is at fault. Exchange info with the other driver and let the insurance companies work it out, but NEVER call the police into the situation.

She received the other driver's information and insurance has it. I think the problem was that it may not have been an even exchange of information. The question would be who told because the other driver supposedly backed into their car.

You aren't read your rights unless you are undergoing a custodial interrogation. Because they were not interrogated, no need to be mirandized. Cops are under no obligation to present a hard copy of an arrest warrant.

Don't settle out of court. Everything these cases of police misconduct are settled "for undisclosed" terms or amounts the truth of the matter remains hidden from the public. And...the police move on without taking corrective action.

Hope he cost that city a lot of money..till the public starts seeing how law enforcement has corrupted itself. Abusers and thugs in uniform ...ending qualified immunity will clean the streets and make it more trusting in those that supposedly are there to protect, serve and bring justice . Back the blue till it happens to you... good cops are few and far these days. Look at stats and court cases, firings, lawsuits, arrests, of all who claim to be good in the occupation...its on the rise.

That's more than a fender bender. That driver might be doing insurance fraud to get money. People need to take photos of everything if they don't have cameras in front and back windows. That other driver needs to be investigated.

That is part of the problem with the law enforcement problem in this country. Ya'll support law enforcement ... until they F with YOU. I do support ... GOOD law enforcement officers .. unfortunately 97% of them neither know nor care about the law and just do whatever they want. We need a nationwide database and commissioning of officers, they need to carry and pay for their own liability insurance, and prosecutors need to use and publish databases of each officer's "success rate" (this would of course still be skewed because of the well meaning but abused plea system).

$25 million dollars of other people's money isn't enough to get these thugs' attention. This news story didn't explain that the other driver at fault had connections at the PD and lied to the police to get the wife in trouble. That driver admitted fault at the scene and declined her info. He asked her not to contact the police. Then he went to his police buddies and claimed that she drove off after running into him. The DA refused to charge that driver. He was never arrested. It was after that happened that the cops concocted charges to come and arrest the Mom and Dad. They ignored pleas from the parents to make arrangements for their minor children to be cared for overnight. This entire episode was under the awareness of and the complicity of the top brass. I wish the "News" station did a better job of getting out all the facts.

I tip for all those who say they don’t need to give insurance. Yes they do the insurance company will not fight for their insured without a police report. Otherwise they just pay to fix your damages and your insurance will eventually go up his original contention was his wife needed privacy and couldn’t give her information. But now they are on TV for the whole world to see 🧐

That's the problem, your insurance will tell you they want a police report, but when you call police at a parking lot, they tell you, it's private property, and you handle the situation among the 2 parties.

This is why police need to be educated beyond high school. Instead, they are hired right out of high school and given 11 weeks of training, a badge, and a gun. I think if you are asked to perform a job you should have knowledge of the duties the job requires. Police are asked to enforce the law and 70% have no clue what laws they are enforcing. Hire educated people with criminal justice degrees and pay them the salary their degree demands. These Law enforcement departments will save enough money to pay the educated new hires just from all lawsuits they won't be getting.

She didn't leave the scene. she was backed into. she exchanged insurance info and left. The other people i guess decided they would pull a fast one and call the police and say she left and i got her license plate. The woman had pictures of both vehicle's damage.

you are so wrong this kind of behavior would lead to arguments, fights etc,,every driver thinks they are right. Exchange insurance and license is ALL the dealing you need with the other driver. Take picture of damage and surrounding for your own insurance report. 911 is for emergencies,not fender benders and other trivialities.

The police do NOT need more training. What is needed is to not hire psycho/sociopathic people into the ranks of LE. Don't DEFUND the police, but spend the money on psych evaluations to PREVENT ego driven school bullies from having a weapon and a badge. Also, when officers misuse or abuse their authority, FIRE THE OFFICERS IN CHARGE. They are either corrupt because they know this type of behavior is happening and are condoning it or ignoring it. OR, they are incompetent because they DON'T know about it and what their officers do under their watch . There is no third possibility. It can ONLY be one or the other.

Current training falls well below par for these cops. Even a juvenile could have acted better taking in to account the 4 kids from 10 to 15 years left alone indefinitely to fend for themselves, is disgusting. These officers and their instructors during training need to be fired and held jointly responsible, with loss of pension, perks, qualified immunity and blacklisted. In addition to lengthy jail time. The kingpin, (other fender bender), is still at large and needs to be tracked down prevented from fleeing the country to face charges for manipulating false arrest, violation of amendments, false warrants and more. I would love to see his face pasted here when caught. I think the duped judge needs to do the right thing here and issue and arrest warrant for him if he has the guts. remains to be seen. The victim's lawyers will certainly find out who this judge is. It wouldn't surprise me if they are related.

Police are doing it to themselves. It is sad that police were more trustworthy when I was a kid than they are now. People say body cameras are making police better. I don’t think so. I was never afraid of police as a kid, now that I’m 53 I am. When I was a teenager I had many more interactions with police than my entire adult life and each time as an adult they have been less friendly. As an adult they have all been for traffic stops and the cops all have attitude problems like it is personal with them. Yet as a teenager causing problems they were understanding? Strange?
