The state has to prove it's case beyond reasonable doubt. It's not Malema's duty to confirm whether it was a real gun or not.

Yes, the onus rests upon state to prove that he indeed discharged a firearm However, since Malema's claim was that the gun discharged was in actual fact a toy, he had to prove his claim as as a reasonable person would be right in any case to assume the gun discharged was a real gun. Now is the state's turn to gather evidence to refute his claims of a toy gun. It's that simple.

It was a weak case to begin with, I am actually shocked that the courts did not strike this off the roll and decided to proceed with the case. It was obvious from the beginning that he was going to say its a toy gun and the case would get broken.
