Truckers undergo a more detailed and invasive background check than most agencies conduct on their own cops, and more often while at the same employer. There are multiple national databases, each covering any and all with commercial driver licenses, on every current and former trucker. Yet to date there is no private or governmental national database on law enforcement officials, nor even state databases in most states. Unlike truckers, law enforcement officers enjoy rigorous unchecked union protections that enable those engaged in criminal activities to remain on their jobs and to find new jobs when that is no longer possible, and union dues give unions a powerful incentive to do so. Only in the most extreme cases, like what we’ve seen in the murder of Sonya Massey recently by a police officer with a terrible past during his brief career in law enforcement, can a very few cops finally be stopped, maybe. That bad cop was enabled in order for him to bounce from one agency to the next every few months despite his record of misconduct and unsuitability as a police officer. Here we have a sexual predator using his badge to victimize women while on duty who wins settlements whenever caught and fired, as well as when an agency that fired him for cause states that and why to agencies considering hiring him. It shouldn’t take news reports to remove criminals from law enforcement, and it definitely shouldn’t take lives being destroyed by these criminals to accomplish the same. A national database on law enforcement officers is needed in order to protect the public from criminals becoming law enforcement officials. Until there is one, restoring public trust in law enforcement will be next to impossible. Each state should be required to have state databases as well. Agencies that knowingly fail to report bad behavior by law enforcement officers, as well as agencies that ignore such conduct when hiring them, should forfeit their so-called ‘qualified immunity’ protection against civil tort suits that result. That would provide a financial incentive to hire only qualified officers who deserve the trust of the communities they serve. Bad cops should be stripped of their qualifications and qualified immunity protections, no exceptions.
