When all you have is a hammer, everything looks like a nail, and you never even consider whether there’s a better way to drive that screw in. I’m sympathetic, genuinely, and I wouldn’t want to see him catch a felony over it. I also respect him for being honest and upfront, that should go in his favour, I think it shows he wasn’t being malicious. He shouldn’t have started shooting, but I also get that he felt threatened (even I don’t think he was actually threatened in any meaningful way, in the moment I expect I’d have felt much more threatened than I do sitting behind a keyboard from a country that has more meaningful privacy laws).

I'm sorry but considering that jaywalking is illegal some guy taking his gun and shooting random arcs of bullets into the sky is not the least criminal. it shows an absolute lack of gun safety, lack of concern for nearby neighbors and distant random people, and a total self centeredness. and he even acts somewhat indignant about being arrested after spraying and praying at a drone he knew nothing about. he's probably pretty paranoid so it isn't like this isn't a pattern of behavior with him. in other words all signs point to this guy not being a low risk criminal. he just needs the opportunity he believes is antagonistic enough and he'll shoot at whatever he wants.

You have a RIGHT TO PRIVACY GUARANTEED in our constitution. If they are found in violation... THEY are the ones who could be charged unless HE invited them onto his property. You do REALIZE that 500' above your property in a congested area is YOUR airspace and in non congested areas it can go up to 1000. This isn't as open and shut as it appears. Police officers are there for one reason... he discharged a firearm. They do NOT make the call on what happens after the fact. Lawyers, a jury and a judge will determine the circumstances and reason.

Companies shouldn't be doing "test deliveries" over random people's houses. They absolutely need to change drone laws. Quick flyovers over someone else's property to get to where they are going, sure. But drones should NEVER be allowed to hover over someone else's properly low enough for it to see or do anything unless they have authorized it. I’m a drone pilot and I don’t want any drone flying over my home. I never fly in residential areas (unless specifically for Wedding and Special Events here in Atlanta and I keep my radius within that home’s property line ) Any experienced and responsible drone pilot would never fly over someone’s home like nevertheless …you can’t shoot them down by law and common sense (which not everyone has) tells you not to fly up to hotel rooms over peoples’ homes, etc.🎥😎

I've never seen a delivery drone, and i'm in a realtively modernizerd area. According to the video, he wasn't "blasting", and blasted carefully. But don't get me wrong, it is dangerous, however nobody WAS hurt. What's abnormal, is people like you, who justify and see it as fine that some random robot "aircraft" can just hover over or around your house. These are not comparable to delivery drivers. His actions were reckless, but feeling menaced or violated is a natural response to having a drone hovering over your home or your residential neighborhood. The FAA and Wal-Mart should both take this as a red flag from the public about greenlighting this kind of operation. So I’ll share my experience as a drone pilot of 4 years. All pilots are expected to undergo basic drone flight certification before using drones. Drones .55lbs and over are to be registered with the FAA. Drones are considered aircraft’s according to FAAs own statutes(UAS/UAV) attempting to interfere with, tamper or sabotage an aircraft regardless if manned or otherwise is considered a felony. Drones are expected to abide by the same safety and privacy regulations as manned air craft. Drones are to be used in class G airspace and are expected to give way to other aircraft, failure to do so can result in revocation of flight privileges and arrest. Drone pilots who operate for commercial (non recreational) purposes are required to get Part 107 certification, no special authority is required for advertisement/testing of already flight approved drones. US federal government and by extension the FAA posses sole authority to categorize airspace and enforce its own regulations/guidelines. No amount of airspace over private property is owned by anyone other than the FAA. Flying over people/crowds/vehicles is only permitted upon request to LAANC and approval. Flying over private property is not in itself a crime but violations of safety and privacy are (not to mention noise complaints). Obviously it is wrong(an illegal) to use a drone to violate someone’s privacy, but flying over someone’s property is not in itself an invasion of privacy. If you are outside you are in public and the expectation of privacy is zero. Just as if you were to be seen naked in your back yard you could be charged with indecent exposure even on private property. That being said no one should be misusing drones and pilots operate under the purview of the FAA and as such are held to a much higher standard than someone piloting an RC car, as such the penalties for going against FAA regulations are much more severe and carry a much stiffer punishment. If you have issues with a drone/pilot try to contact them to express your concerns, but do not under any circumstances attempt to interfere with the pilot and his/her operation of said aircraft. It is both dangerous and a felony, not to mention any damage and injury incurred as a result of interference(or operation) becomes the responsibility of the person causing such incident to arise(be it drone pilot or person interfering with the safe operation of said drone). Most of us are just normal people who love to fly or love photography/videography and have no ill intention with our drones. What you think is suspicious activity, like a drone hovering stationary for an extended period of time is more than likely someone shooting a time lapse. Please be kind to each other, most of us are happy to share our hobby/profession with you if you ask. And for the love of god do not discharge a firearm into the air and especially not within a neighborhood. (Source: me, firearm owner and drone pilot)

You have a right to protect your property below and above ground (500ft) if you can hear a drone it's definitely below 500 ft especially if you think you can shoot at it and hit it. 500 ft is 1 2/3rd's of a football fields long. A drone is considered an aircraft. It is illegal to fire a weapon at an aircraft. The police are enforcing a federal law. Depending on the laws of the state, the drone operator could be charged with trespassing. The law has to do with how much air space above ground level of a property is considered to be owned by the property. Also how far below ground level. dates back to medieval England.
