Form i-246 is used to stay a removal (deportation) for someone who already has a removal (deportation) order. It is used as a last effort to request that a person with removal (deportation) order be allowed to stay in the United States.

Can you have an attorney present during your interview? If the officer denies your request, can you appeal that decision?

Hello, Francisco, Great question. You can definitely take an attorney with you to the interview. There is no appeal from a denial of a stay request, however, your attorney may have relationships with supervisors or other representatives in the government who may be able to assert some influence if it’s an egregious denial of a stay request or a case with extremely compelling circumstances.

can you still apply for a green card by filing for i-30 after getting the stay of removal approved?

Hello, Maryam, There is no prohibition on filing I-130 after a stay of removal is granted. However, it will be important for you to understand if you are able to still qualify for resident status if you have an order of removal, and what additional steps you’ll need to take in order to reach that goal.
