I was in a not at fault wreck on a gas powered Scooter. Just after escaping death, the state trooper still gave me 1 charge : No Motorcycle License. So I went to judge trial and showed the judge ; nobody can get a State motorcycle license on a non clutch ( automatic transmission ) bike : it's not allowed. ( My air cooled scooter doesn't even use water and dose 40mph at 60-70mpg ; it's a county road bike ) Well I floored the whole court room . Even the judge looked across the whole court room openly and said " I'll fix this later, defendant not guilty ". What made me mad is the young posturing state trooper wore his sunglasses the whole time and the " public pretender " charged me $50 representation for only announcing my name. Last thing she said openly to me as everyone was leaving the court room was " I couldn't of done that ". It still cost me court cost even dealing with them. I don't feel like I won anything and have had an attitude towards the system ever since. They're crooks.

This is truly wise advice. It is the only thing that can level the playing field, and give you some actual decent legal recourse, in the aftermath of being preyed upon by law enforcement. It is a shame, so many take no precautions at all, when dealing with law enforcement. It is not safe to assume: police officiers will abide by the law themselves, as so many police officiers know, robust protections are in place (qualified immunity) should they decide to violate your rights......even in an egregious way. Recording them, ideally, without their knowledge, may be the only way, you will ever have justice, should you be victimized by law enforcement.

I strongly suggest a background process video recorder (easily available on your app store for free). That way your phone can stay locked while recording and not tipping off any officer

You don’t have to do anything wrong for the police to investigate you. Sometimes the police will lie and make up a traffic violation to pull you over for.

My friend got pulled over for "speeding" one afternoon, he was held on the side of the road while his truck was searched for nearly 2 hours until the sun went down. At which point the cop gave him a tocket for driving wothout his headlights on as his only citation. It was 4pm when he was pulled over and the sun was still in the sky before he was held without charges for 2 hours. He wasnt driving at night at all, let alone driving without headlights at night

@@cyleleghorn246 Years ago I was going home from work at 3AM. I passed by a cop sitting on the side of the road. I was in the right lane the whole time. That forms a continuous lane that goes into an on ramp that takes you onto a highway. I know I was doing the speed limit and had good lane positioning. Since it’s a continuous lane, there’s no reason to use a turn signal. The cop pulled me over and said I went left of center and failed to use my turn signal. I could tell he was making it up as he went along. When he saw my work shirt and could clearly see that I wasn’t intoxicated, he let me go with a “warning”. He clearly lied and made up things to check me out.

@@jsphmo you are wrong. If you are sitting in the driver's seat of a car you are considered to be "driving" by the law. You can get a DUI (driving under the influence [of alcohol]) simply by sitting in the driver's seat of a car on private property without even the engine running.

In Ga most traffic citations are criminal so signing the ticket is not an admission of guilt but is basically a signature bond so you don’t go to jail.

The problem is mostly in corrupt democrat run cities. It's out in small town America too but not all departments are brown shirts. We've got to get control of the leadership of the cities and get these POS naziss out of there. Real cops love the law and hate criminals. Bad cops hate the law and love criminals. What if the officer purposefully misquotes me in his report, to try and make me sound like a jerk. He even used quotations. The conversation was on 3 body cams, my phone, and my ring doorbell. I said "I choose to use my 5th amendment rights to not answer any questions". He added to it and quoted me calling them names and saying smart alec things.

Send your ring camera footage to the prosecutor. Do you have the body cam footage? If not file a FOIA request before your court date. Being disrespectful to LEOs isn't illegal. Only disturbing the peace and obstruction are. In order to "sue" you have to prove a tort. It's not easy and not cheap. Proving an officer lied on an incident report by use of video is much less expensive. You could easily do it pro se.

About 10 years ago, I went to court to fight a traffic ticket! The day in court when I went to fight the ticket, there was 50 other people fighting their tickets! The judge found everyone guilty and fined them! Even if I was guilty! It is mathematically impossible that 50 out of 50 people were guilty! It was all about the money! The courthouse was less than a year old and the city needed to pay for it! Even my 10 year son who was with me knew! As we left the courtroom he said dad that was just about the money wasn’t it! 😮😮

No it is not mathematically impossible. Your baseline assumption is incorrect. If all 50 tickets were for legitimate traffic violations then all were legal tickets and all individuals were guilty. You are assuming some statistical number are not guilty to which you have no proof or reason to believe that to be true.

@@vrdog9660 In many cases the officer will write you up for resisting arrest for one thing and change the report to something different. He may first write "you tried to run", then he may change it to "you put your hand in your pocket" and when the other officers on the scene let him know that neither of those happened, he will many times write "you didn't get on the ground fast enough".

Not you see why the founding Fathers went back into session to write the Bill of Rights. Even they knew way back then that all governments eventually become corrupt. Ours is no different.Traffic laws and its enforcement is big revenue for the state. That's why cop are so well protected. Its a clandestine way to collect more taxes.

Public safety is a minor concern. Actions speak louder than words. Deeds reveal the truth. The focus of law enforcement is on generating unlegislated revenue for the state. The effort is on achieving a positive cashflow - Maximum return for minimum effort and minimum risk. It is determined by cash generated. Not on what the cost of a type of crime is to society. If it was, there would be far more concern over Identity theft, or human trafficking - just to list two. The effort devoted to "Traffic Control" outweighs all other law enforcement combined by at least a 3 to one ratio. Everyone basically perceives this. More and more people are getting fed up with it. We're being harvested for cash by what are far too often narcissistic or psychopatic cops - who should never have been allowed to wear a badge. Meanwhile, the real criminals are left to operate in a virtual law enforcement vacuum. Some people even argue that we wouldn't have so many sick b@$tards wearing badges if there wasn't such a demand for revenue collectors lining our nation's roadways.

In the 1960’s my brother got a speeding for going 29 mph in a 25 mph zone. However, there was a line on the citation where the officer was to enter what a safe speed would have been. He wrote 30 mph would have been safe. That ticket was thrown out by the judge.

I'm a long haul trucker from Cali. I got a speeding ticket in upstate NY back in 1987. I forgot about it. My Cali DMV report never reported it. As far as I knew I had a clean driving record regarding that ticket. 25 years later I was pulled in to a weight station in Gestapo Maryland. My truck passed the inspection. No violations. They ran my license. I was almost arrested for the ticket in NY from 25 years ago. They wrote me 3 different driving on a suspended license ticket. I had a copy of my current Cali DMV report. Showed valid. No tickets nor accidents. Cost me $1000 for an attorney and $800 for all 3 cases to b dismissed.

Regarding your point, you're probably right, we live in an overly litigious society where people see the courts as the lottery. Where good cops are discarded to appease the mob (ie derek chauvin) After looking into it further, Colorado, Montana, Nevada, and New Mexico have removed qualified immunity and they are spiraling out of control.

It has been repeatedly used by police officers to escape accountability and civil liability for engaging in violent and abusive acts against the public.

from personal experience, I was once charged for letting my dog run loose (I didn't have a dog, my rear porch was being repaired and the ticked should have been for not having a porch), the judge yelled at the prosecutor for having the wrong charges so the prosecutor quickly changed the charges and tried to prosecute under the corrected charges. I told the judge that I couldn't be prosecuted under the amended charges because I wasn't given the proper advanced notice of a court date and time to prepare my defense. This time the judge exploded at the prosecutor and read the riot act to him and dismissed all charges against me. Bottom line, even if the charges can be amended, there are still due process laws to prevent last minute changes in the court room. Once the officer presents the charges to the court, he can't change it. I answered the incorrect charges and after that it was too late to add new or amended charges.

The fact that a traffic violation is a criminal offense is ridiculous. They should only be a civil violation. The idea that you can be stopped, detained, jailed, etc for a simple violation is absurd.

Option 1 - Deferred adjudication (pay a fine, plead no contest, it drops from record if you don’t get another citation in 3-6 months) 2. Hire a lawyer (In most bigger towns lawyers will represent you for the cost of the ticket they get it dismissed almost always. 3. Driver safety course (I’m not a fan of this but it’s better than paying ticket.)

In NY and MA, if you go to court for the initial hearing on your traffic ticket, ANY officer from the same jurisdiction can be present to attest to the facts of the ticket for the prosecution. At your trial, it’s the officer who stopped you who has to be present.

I defended myself in a Mississippi courtroom in 1984. I won my case, but it was a kangaroo court. The judge realized I was not going to stop at his court. I was prepared to appeal as far as necessary. I pointed out several irregularities to the judge. The police chief was lying to cover up his officer’s incompetence.

Good stuff overall, and I appreciate your style! You're on the ball. Thank you for useful advice. In Arizona civil traffic is governed by the Arizona Civil Traffic Procedures and heard in Civil Traffic Court. Unlike a court where the defendant has rights, Arizona has crated this "special" class of hearing and process where there is NO DISCOVERY. So while you may want to "ask the prosecutor for evidence" all you'll get is information on how to pound sand. Prior to the actual hearing you can submit whatever documents you like --and the court and the prosecutor will ignore them. Once at the hearing you are (in Arizona) allowed to cross-examine the officer as to the evidentiary statements they've made. That means you CAN ask about measuring device calibration, keeping logs of same, officer experience, etc. but don't expect this to lead anywhere except a motion (by the prosecutor) to amend the record to "let it show that" the instrument was declared sufficiently calibrated by the tesifying officer. The Judge is a cop in a black robe. He/she will side and presumptively agree with the cop. Your "right" is the right to plead guilty, plead nolo contendre (Latin for "no contest but sounds better") or not guilty. The latter allows a scheduling of a thorough hearing where the black-robed cop still has a predisposition to side with the uniformed officer. I love living in Arizona. I do not love "Civil Traffic Court" and how politicians gutted civil rights so we (the accused) have no real choices as to how to handle a case... other than... you know... please guilty. I have no dog in this hunt YET. I drive on the public highways, so odds are I'll be in court sooner or later. I have no pending or active citations. I've never been arrested. I'm like "the good guy" and YET I fear for my safety if some piece of shit in a uniform wants to mess with me. That's what we call "a police state." thanks for listening.

The thing about not signing the ticket is true but you do have the right to read the entire ticket, because you have the right to know exactly what you're signing. Take your time, It means that officer cannot give another ticket to somebody else while you're reading that ticket. They want to pull you over give you a ticket and search your vehicle as quickly as they possibly can so they can move on to the next poor doing sucker. So if you slow them down by taking your time to read and fully understand what you're signing. Then that officer cannot give another ticket until you're done.😂😂😂

What’s funny is most of the people posting here probably would love to give other inconsiderate or reckless drivers tickets if they could. Like when you see someone with expired tags or U-turns from the curbs, or the guy who almost hit you running a red light or stop sign. Right. Can’t tell you how many times I’ve been flagged down by somebody pointing out (or honking at me) a traffic violation that I did not see. And then they were incensed when I told them that I could not write a ticket for something that I did not see. I can’t testify in court that somebody “told” me about a traffic violation that happened in front of them.

@@LAPDDET-bn7hk I've been harassed on the side of the road by far more clowns straight b-llsh-tting about why they pulled my over so they could go fishing than I have been pulled for a valid infraction. I've been pulled for supposed drunk driving ("swerving in my lane") by a guy who was in the oncoming lanes of a divided highway doing at least 140mph combined(Yeah. within the speed limit in that state). Totally implausible. Total mockery of professionalism. Why was I pulled. Almost certainly out of state plates. I call clowns clowns when they do clown things. People don't like getting tickets. I spent a couple hours in jail after being arrested for refusing to sign a speeding ticket. Only after being in jail did I find out signing doesn’t admit guilt only that I acknowledged an officer wrote it out in front of me. My wife came in and I can hear her say, “I’m here to bail out the prisoner “. It was a small town, I was the only prisoner.

I had a parking ticket in PA many years ago, in the 90's. At the time, I was living on the west coast, just visiting PA. It was a poorly written ticket, it didn't even have my license on it. So I kept it but never paid it. I've been pulled over 8-10 times now, they either let me go or give me a ticket. Nothing was ever said about that ticket.

Paid a out of state ticket, but didn’t inform my state DMV that I paid the ticket, so my state DMV canceled my licenses, didn’t tell me. Months later Military MP informs and had to explain to me what canceled licenses is, never heard of such a thing, then looks the other way so I could go get it fixed.

Most people just pay the because it costs a lot in lost wages, travel, and the fact that if you did all that, and you lived in Pittsburgh, you might need to stay in a motel if the docket was full. Several states do that, I am told, but I don't know. Best bet, go around states that do that.

Here is a similar but different issue I ran into years ago. I was severed with a summons to go to court over a dog barking issue. I signed the summons that the office brought to me and when I went to court, the judge said "You admitted to guilt by signing the summons." I politely said to the judge, "Are you crazy, signing it for receiving the summons not for admitting guilt". I still lost the case, but and had to pay the court costs, but did not have to pay a fine.

Pro Tip: In the last year, because I do a lot of driving, I’ve managed to occasionally exceed the speed limit, was “camping” in the outside lane, and once I was accused of not coming to a full stop at a stop sign. 2 of these offenses were at night. On both occasions, upon being pulled over, and since I had nothing to hide, I pulled over, careful to leave my seatbelt on, then rolled down the car windows completely, and turned on the interior light. I also put my hands on the steering wheel at 10 & 2, as suggested by defensive driving classes. Why the elaborate display? Well, I have a friend who’s a Texas Ranger, and he told me the great fear of every officer during a stop especially at night, is that they cannot see your hands and they cannot see who all is inside your car. Upon being asked for my license and registration, I ask them “May I go ahead and reach in my back pocket?” You’d say, this is really too much. What’s the point? Well, in my experience, it works, because I have been pulled over 7x in the last 10 years, once when I was exceeding the speed limit by over 26 mph and I haven’t gotten a ticket on any single one of these occasions. Offering a little bit of professionalism, a bit of respect, a willingness to show the officers you’re aware of their safety and you want for them to know you both appreciate (most of them) their safety and their families…Will go a long ways towards avoiding a ticket. Seems a small price to pay. Works for me, give it a shot.

In states like Oklahoma, a cop will stop you because your seatbelt is "loose". In certain cities in Oklahoma, cops can take you to jail for dumb stuff even if the infraction doesn't warrant that and you are not being beligerent. In certain cities in Oklahoma, the police really need to be investigated.

How about he either gives me a lecture and a warning, or shuts up, writes me the ticket, and goes home to his morbidly obese wife whom he's dated since the 7th grade?

Depending upon what state you were in, many traffic violations are criminal. When the officer stops you, you are legally under arrest. By signing a ticket with your promise to appear in court, you are released from the arrest. If you choose not to sign the ticket in a state where is a criminal offense, the officer has no choice, but to place you into custody. Also, every citation I have ever seen clearly states that by signing the citation is not an admission of guilt.

The last speeding ticket I got was in Elmodel, which is exactly the kind of SW Georgia hick town the name suggests. A motorcycle cop at least 80 years old was waiting around a corner were the speed limit drops suddenly from 55mph to 35mph before you have a chance to slow down. He had the Southern hospitality schtick down pat. "We catch a lot of folks doing that, you know. I once had to write a tick to myself." He was quite a civics booster. "As long as you're hear why don't you enjoy yourself at the diner and then visit our town museum." As I lived 300 miles away, I wrote a letter of objection to the judge, but it didn't do any good, so I paid the $94.00, which I was told if I paid, there would be no ding on my driving record. That sounded shady, but I paid it by mail. I wrote the Georgia Bureau of Investigation about the speed trap, but never found out if it did any good. I never travelled that part of Georgia again.

That's the favorite revenue booster for most small towns that are run by corrupt politicians, judges and cops. Some even try it on interstate highways but usually stick to the off interstate roads so if I'm going any distance I just stick to the Interstate and stay at the speed limit or below. I've considered driving the old US highways to take in the scenery and such but having grown up around small towns I don't want to wander into any of them I don't know really well.

Got a ticket in Montana once. As I was signing, the officer told me that his state did not participate in reciprocity, so it wouldn't show up on my record, nor be reported to insurance. I am generally law abiding, so I paid the fee by mail, but I could have easily just ignored it.

The video said there are 46 states in the compact, but I would do my own research as to finding out which 4 states do not participate before I'd take a random cop's word for it on the roadside. After all the video also did remind us that cops are legally allowed to lie to citizens. If the cop was on the level I'd say he's a cool cop.

@@onemoremisfit Of course I checked it out, even though there was no reason for him to lie about something to an out-of-stater that was just passing through. When I got home, a week later, I went online and saw that what he said was true. I contacted my insurance agent and asked what would happen if I paid a fine to a non-compact state. He told me that they would not report it, so my insurer would not know. The fine was $40, it was in a cone-zone, so that brought it to $80. That's about 1/5 the fine it would be in my state. I thought that state deserved the money for having an awesome highway patrolman.

Id think of it as a 'thank you' to the great state of Montana for not participating in reciprocity. People will argue with the "thrilled" language here, but 40 years of life have taught me to pick my battles. @@captainjimolchs If you don't have an attorney, things will most likely not be different. The law/court racket couldn't be sustained if people didn't need attorneys to win a case. Citing a law may not do anything at all, because court judgements often modify the practical meaning, but the statute is never updated. You can know what the statute says backwards and forwards, but if you're not aware of case law that's related to it, you're going to be hosed. Lots of *lawyers* don't know that stuff, and average joes have no shot. It's not impossible to beat a traffic ticket in court without a lawyer, but it's close.

In California you are not legally required to sign a ticket, but the officer is then required to bring you in front of a judge. He/she is required by law to arrest you. All you are doing by signing is stating that you will appear in court or pay the ticket. It's written on the ticket where you sign. Watched a YT video of a cop back east explaining everything to a woman that wouldn't sign, showed her on the ticket where it said she was just stating she'd appear in court, and also telling her if she didn't sign he'd have to arrest her and take her in front of a judge. She finally signed, but it took a while. I learned this stuff in Drivers Ed (I'm 70).

I’m a retired Florida Prosecutor and Judge and I’d like to compliment you on your excellent advice and video. I use to preside over traffic hearings early in my career. Later on, I only handled the appeals from the traffic Court. If an officer failed to appear in Court without any communication with the Court of some good reason, I would dismiss the case. When a person failed to appear without some prior communication with the Court, their license was eventually suspended if they didn’t pay certain fees associated with failures to appear. Either party was freely granted reasonable continuances and given new dates as conveniently to each party as possible. I hated traffic Court with a passion and was so glad to move up in jurisdiction. For the Judge it was a no win situation as the numbers were crazy and people who came to court were very adamant about their innocence, but had little but their insistence to prove it, whereas the cops had things like radar that were regularly tested and certified as to accuracy. I was so glad to handle the worse horrible felony over speeding tickets.

Those regressive property taxes are supposed to pay for the constitutional obligations of government, which includes the court. I put this on both-sides of a business card. Plus, I have the top line on a rubber stamp in red ink. "Without Prejudice" UCC 1-308 "I reserve my right not to be compelled to perform under any contract, commercial agreement or bankruptcy that I did not enter knowingly, voluntarily, and intentionally. And furthermore, I do not and will not accept the liability of the compelled benefit of any unrevealed contract or commercial agreement or bankruptcy."

I spoke with the prosecutor prior to being called up, explained my case and he said okay they will throw out or dismiss your case. When I was called, the judge paused, called the prosecutor up, whispered a thing or two, leaned forward scratched out my original charge, wrote in another charge (improper use of vehicle) and then fined me almost double what the fine was for the original charge. I got ticket in the pouring rain for following too close after a woman pulled in front of me and slammed on the breaks on a congested highway. It was on a slick bridge with no shoulder. Having never been to court before, I hired an ex-cop to help me out. Luckily, I was first up and there was a little trial since I pleaded not guilty. The cop explained about the "slick" roadway and the lack of shoulder, then the woman explained that she had just pulled in front of me. At this point the judge asked the prosecutor "Is that all you have?" When she replied in the affirmative, he said "there's no evidence of following too close. You're free to to." Then he looked sternly at the prosecutor and told her that he wanted to have a talk with her in his chambers. I can only imagine what he said to her for bringing such a weak case.

Regarding #2, I got a ticket thrown out decades ago because the officer wrote down the wrong circumstances that warranted him pulling me over. I had cut through a gas station parking lot to avoid a light, but the officer said I went West instead of East out of the gas station. It got dismissed (or whatever the action was) by the judge and that was that.

I was happy with lowering it to non moving violation. The fine was $65 as opposed to possible loss of license for third speeding ticket. That was 15 years ago, I have since slowed down.

"Following you around waiting to see if you will commit a traffic violation" sounds a lot like harassment. If you don't think so then just reverse it. What if a bunch of news reporters followed around a police officer waiting to see if everything he did was appropriate and within the scope of his authority. I've seen youtube videos of private citizens recording a traffic stop and the police officer walks over and orders them to turn it off. Some of the citizens point out they are in their right because they are on their own property and the events taking place are in public with no expectation of privacy. The police officer still harasses the person recording. When the stop takes place at night the officer will shine a flashlight directly into the camera forcing the camera white balance to turn everything black but the light. "Following you around waiting to see" should sound wrong to any reasonable person, including law enforcement.

Shining a light into a camera has been ruled a civil rights violation because it is an attempt under color of law to infringe on the first amendment right to free press. Cops can lose qualified immunity (though they rarely do) for using a flashlight in such a manner, and can be personally sued.

5 questions, but first: always good information. Always a good reminder to go slow, turn signals, proper stops at intersections. Q1: if you are being followed buy a cop and you choose to pull into (say) a convenience store, will that be perceived as suspicious activity? +Has never happened to me.) Q2: I was once pulled over but drove further in order to pull into a shopping center parking lot. The cop asked why I did that. I asked in my 25 year old surly voice: would you have preferred that I pulled to the side of the road and block traffic? (Was no longer a problem. I had short hair, non-suspicious car.) Q3A: what's doing 52/35, got pulled over. What's clearly guilty of the offense. Paid lawyer to represent me, wound up in a dismissed charge, not even faulty equipment. I was clearly going 52/35? Secretary said don't worry about it. Never even heard from court. Insurance never went up. Q3B: How was the $300 I paid my lawyer distributed? Q4: Do cops get any "kickback" money from tickets, depending upon them municipality? Q5: Do these "Constitutional Auditors" generally receive a wave off what are they generally get in trouble for their actions?

LOL You will love this one. First I have not had a ticket for 40 yrs. But 53 yrs ago when I was 18, me and another guy was drag racing in Alton Bay NH. Early evening no one around Nov. Some resident called the cops. They never saw us doing it. We denied it. He took the word of the citizen. Remember small town of 8000, 4-6 cops on the force two cruisers. He writes in the OTHER line on the ticket: SPINNING TIRES. We signed the tickets. Two wks later we r in court. Trial case put to the end. Only 4 cases including ours. I had a week before court went to the police library and looked up laws. No laws for SPINNING TIRES inNH. Case was read. I call the Sarg to the stand. Ask him a couple general questions. Then i present the summons ticket as evidence and exhibit one. I then ask the cop what is the NHRSA for spinning tires? CRICKETS. The Archy Horn the judge says well George, to (the cop) you need to brush up on basic laws. Case(s) dismissed. We won BUT he finally got us for speeding at a later time.

If there's one thing I always hated, it's speed traps. I feel like speed traps are borderline fraud because you could be going the speed limit of 55 and then suddenly it drops down to 25 mph and cops camp out these spots like a regular at a strip club. This should be hella illegal because you practically gotta slam on your breaks at this point and risk possible collisions.

If I remember, in my State, when you sign a ticket it is a promise to appear or pay the fine. If you refuse to sign you get arrested , take to jail, until you appear before a judge.

I got a ticket in California in 1984. I was there for the summer and came back to Texas, without disposing of the matter in the California court system. TEN YEARS LATER, I got a letter from California saying I owed them over a thousand dollars in fines, fees, and interest, and had an oustanding warrant. I still ignored them. Pretty sure it's off the books by now, as I have traveled to California since without any problems.

2:50 My brother went to court over a ticket for this very reason. This was a really long time ago, we were both teenagers I think…he might’ve been early 20s. The officer only spelled out the first two letters of our last name on his ticket instead of writing out the whole last name, which is much longer than that. So he went to court and fought it, and the judge threw it out. Guess the prosecutor didn’t notice it before trial 😂.

Your videos are great! I learned as a 15 year old kid that most cops have a HEAVY attitude, at least for young guys. I spent 52 years getting harassed in San Diego, mostly by cops younger than me. I’m over 70 now- I’ve fought every BS traffic ticket I ever got on principal! I’m sick of being presumed guilty of SOMETHING… like having your Dad follow you around just to kick your ass. Look up CA Traffic Stop (CA v SEAN PENN) a really bad case for jerky cops) Really cannot have the expectation of Respect from Police who 1) Have their lives in danger always 2) Not all Officers are difficult 3) But, cops rarely STOP crime 4) Not stopping crime, they are CONDUCTING enforcement of ‘violations’, which creates REVENUE. In Georgia traffic violations are criminal violations as of 1990. You sign the ticket in lieu of posting bail so if you refuse to sign, you have to go to jail.

@@johnjames4567 In Georgia traffic violations use to be Civil violations before 1990 and you couldn't be jailed for them. But they made them a criminal violation punishable up to a year in jail. You refuse to sign the ticket you are arrested and have to post bail. It really pisses the cops off when someone refuse to sign it creates a lot more paperwork for them. How do I know this? I refused to sign a speeding ticket once.

O.C.G.A. 40-13-2.1 (2010) (a) A person who is issued a citation as provided in this chapter or Code Section 17-6-11, relating to display of driver's license in lieu of bail, shall sign the citation to acknowledge receipt of the citation and of his or her obligation to appear for trial. The officer shall advise the person that signing the citation is not an admission of guilt and that failure to sign will result in the person having to post a cash bond. If the person refuses to sign the citation, it shall constitute reasonable cause to believe that the person will not appear at trial and the officer may bring the person before a judicial officer or traffic violations bureau to post a bond as is otherwise provided by law. Fixed that for you.

Traffic stops are legal detentions . If you go silent etc & don’t sign your promise to appear, you’ll be arrested for that traffic offense, booked and have to pay bail. Most people see the light just before the handcuffs come out, but some don’t and then are begging to sign in the back of the car or when you hit the jail.

In my state a traffic ticket is a civil infraction. Refusing to sign it elevates it to a criminal misdemeanor and usually ends with the violator in custody, his or her car towed, and booking into jail.

Are you sure? In every state I know of moving violations are misdemeanors. Now parking tickets, and other non moving violations, or even moving violations that are on private property are civil, but not on public roadways. Contract law doesn't apply to citations. They aren't admissions of guilt, but it does obligate you to show up to court or pay. In some states the ticket says you are technically under arrest, but free to go till your court date. Always sign the ticket....

That's funny that you mentioned Pennsylvania. I unfortunately live here and I can vouch that Pennsylvania is one of the most money hungry States in America. They want every last penny you owe. There is a saying in Pennsylvania. "Come here on vacation and leave on probation!" It's no joke. I'd love to hear your thoughts on this. My brother has robbed me several times. He's broken into my home and robbed me. He has stolen about $ 400, 000.00 of of my parents, out of their bank accounts. But they concider him, " The golden Child " He's never had to face any consequences in his entire life. He got his 17th DUI and a few year's ago, my parents were friends with a neighbor, who work's for the Driver's license place. She is one of the head bosses. My parents paid her $10,000.00 to scrub his record clean. So when he got this 17th DUI, it appeared like it was his first. He got a slap on the hand, and I'm so aggravated. He managed to delay his hearing 8 x's. Which, was all on his side. I thought an Attorney could only get a total of 3 Continuance? Rather than get in trouble for this at home, my Dad left the couple year old, Dodge Ram where it got towed to and took him out and bought him a brand new one. I just think my Dad probably paid off the Judge, like he's done before. Is this sort of thing usual?? Thank you.

Smith and Wesson make a lot of tools you can use to prevent home invasions. Glock does as well. I'm partial to Kel Tec for all my security needs, but I understand they don't work for everyone. Head on down to your local pawn shop so you can acquire some home safety equipment and browse your options. I often find that many of my problems when it comes to home security is only 9mm away.

PLEASE HELP 😭 an officer told me to get into his car and it was midnight and as a young woman I felt unsafe getting into a car with a man I didn’t know, officer or not. So I stood next to the passenger seat inside the open door and asked “is it ok if I just stand right here because I’m feeling a little unsafe getting into the car when I’ve heard stories of men impersonating officers before.” The officer threatened to arrest me if I didn’t get in 😭 I was even more scared now and asked if I could call his department first just to verify he was legit and he just threatens to arrest me and it got so scary. 😭 I promised I wasn’t going to run I just wanted to feel safe before I got into the car. He was so aggressive and started talking like I was hiding something. I just wanted to call someone before I got into his car alone in the middle of the night …. I was left severely traumatized … thank God he didn’t try to arrest me because the more aggressive he became the more I wondered if he really was an impersonator and I was going to be murdered if I got in his car 😭 is it within my right to ask for verification for safety before I put myself in a vulnerable position like that ? Or could he have arrested me just because I was too scared to sit down ? 😭 He also refused to tell me how fast I was going and that was so weird. He threatened to give me a ticket instead of a warning if I asked again how fast I was driving. And I was very polite as much as possible. I had never in my life heard of anyone being asked to get into an officer’s car before. So I felt so unsafe. I didn’t know that was something they do sometimes. So I was so scared to get in and when he threatened to arrest me, it made me feel less safe … I didn’t know what to do to protect myself

Im a truck driver. And in Wisconsin i was pulled over. For not changing lanes. To go around an emergency vehicle with lights on. This cop was set up on a blind curve at an exit ramp on the interstate. Cop acted like a drill sergeant and obviously fresh out of the academy. Anyway this exit was where i already did my trip plan and was getting fuel at this exit. Several reasons i couldn't change lanes for safety. But i did move over to the center line. Giving cop as much room as possible while still getting my exit. Keep in mind the law states, move over or slow down for emergency vehicles. I was already showing for the exit. Also the cop was just sitting there with his lights on. He had no vehicles pulled over and no one was out walking around. Anyway fought the ticket $600 fine looming. The ticket was reduced to dirty windshield and a $300 fine. Also the first infraction was a moving violation and a ridiculous amount of points on my license. Akin to wreckless driving in a semi. I would have lost my truck, job and any future driving jobs with this on my license. My career would have been over. The dirty windshield was no points. Not a moving violation. Cost me court fees, attorneys fees and a $300 ticket. Was reduced to

I find that being respectful and complying with all the reasonable requests gets me out of the traffic stop as fast as possible. Most of the time the ticket will be reduced and you just pay a fine, it sucks but it is what it is. Just request a supporting deposition when mailing in your plea and if they don't send it in 30 days the tickets dropped

The attorney I used for over 20 years used to go to trial and fight, typically ending in a dismissal. The last time I hired him, his traffic ticket strategy changed. He would let the lower court convict, then appeal. The problem was that it ended up going on my record as a conviction, then as a dismissal on appeal. Sure, the outcome is the same. But having it visible on my record is still not a good look. I prefer the deferred disposition now.

Signing the ticket is an agreement to address the instructions in the ticket or to show up at a specific place and time to address the ticket in front of another government employee. So basically, you are entering in to an agreement with the officer to "take care of" whatever BS he's accusing you of. Remind me, what are the elements of a contract. Basically, Traffic tickets are contracts that you are being coerced in to signing.

Generally, your advice is spot on; however, consider the following clarifications (Texas): Signing the citation is "promising to appear" to dispose of the citation. If you refuse to sign, it will result in your arrest due to the refusal to promise to appear per the terms stated on the citation. Under these circumstances, the officer is instructed to present the defendant to a magistrate in order to dispose of the citation. Another clarification is that some smaller cities in Texas do not broadcast failure to appear warrants beyond their own jurisdictions, i.e. statewide or beyond. This is because they would rather pick you up in their city so they can preserve right to revenue from the citations. When picked up outside of their jurisdiction, they have to share that revenue with the apprehending agency, as well as a general fund. Last clarification is in errors on the citation. Material errors that could get your citation dismissed were based on the days when tickets were hand written. If the date was omitted, for instance, the citation became an invalid instrument for prosecution. BWC's and handheld electronic citation devices are making this a very unlikely occurrence now. Just thought I'd toss that in for some light thought.

The one thing you may want to add is the Texas Transportation Code is part of the Texas Criminal Code and every offense, except for 3, are arrestable offenses. Failure to wear a seat belt? You can be taken to jail over that. I'm pretty sure the three you can't be arrested and jailed for are speeding, open container, and using your cell phone.

I feel kind of sheepish in that I've had three warnings and zero tickets in 12 years. I signal and pull over to the right immediately. I turn the car off and shut the music down. Hands at top of wheel and give them my complete attention and give courteous, short answers to the point. Idk, I'm not especially lucky but maybe that's what it adds up to. "Ah yer getting hosed in every other way, but you'll have good luck with rollers."

Me and my wife was arrested at a Walmart self checkout, my wife never touched anything they arrested her for being with me. During my arraignment the judge never asked us if we plead guilty or not guilty, he just made us guilty. This was done through video. He released us and we did community service. We wanted to fight it because I was having problems with the self checkout. The Fort Worth police are at my Walmart everyday all day.

Those states that allow cops to arrest you for not signing a traffic ticket are like those countries with friendly-sounding names that I avoid at all costs.

In Massachusetts, a young man was pulled over. The officer took his license and proof of insurance to the cruiser. He returned everything folded as he had received it. The young man later discovered a ticket had been folded inside the proof of insurance. By way of a bench warrant. Lesson, always check the paper work before returning it to the glove box.

Lots of this is slightly incorrect. On many points. Unless you have committed a traffic violation, or there's an articulable reasonable suspicion a crime has occurred. Cops can't just stop you to Id you, except for some checkpoints, in some states. Depends what state you got a ticket in, some states reciprocate, some don't. Even in some states the best they can do is get you for suspended driving ticket. They aren't going to extradite you back to Oregon from Texas on a failure to appear for a bench warrant for a 72 in a 55 ticket. Signing a ticket isn't an admission of guilt, but it does literally say that you are technically under arrest till you go to court in some states. Always sign the ticket. He's right about that. You can absolutely get tickets dismissed on mistakes on the citation. For example, LEOs are required to calibrate radar guns as well as calibrations done by the manufacturer. I've seen dozens of tickets dismissed because a single radar gun was overdue for factory calibration on one radar gun. It was no longer "an instrument of the law" Your best bet its hand over your licence, say I don't answer any questions or consent to any searches as soon as the officer walks up. They may say something like "do you mind if I search" that could be a request, or a command under color of law. If the officer asks you to get out of the car ask them if it's a request or command. If they say command. Get out of the car immediately.

(Remember, courts have ruled that cops aren't legally required to save or protect lives, protect or recover property, or investigate or solve crimes, so therefore, they're not legally required to do any of the things that tax-payers pay them to do, so the the only thing they do is hunt people for fun and profit, looking for opportunities to hurt people and rob them.) If you feel uncomfortable when you see a cop, that's because you must obviously be a criminal. 🤷 0:27 On the one hand, cops do love people begging them, that really gets them off. Courts have ruled that the "good guys" are allowed to lie and commit crimes. 3:00 It's BS that the prosecutor can compensate for the cop's incompetence and illiteracy by just amending the ticket but still hurt you for not showing up in court because the court sent the paperwork to the wrong address because of the cop's mistake. 😠 I've seen numerous cases of this where the court kept sending paperwork to some other address, so the intended recipient didn't get the notice of when they were scheduled for court, or in some cases, even know they HAD a case, and the court didn't apologize for screwing up and actually punished them for… um… 🤔 not getting someone else's mail, or being psychic? 🤷 3:21 The courts going to let the cop and prosecutor fix their mistakes (even ones that cost lives) without any consequence, but if civilians make a mistake, there's zero mercy. You signaled at 99' from a turn at an empty intersection instead of 100'? Too bad! No fix. $300 now! 😒 5:04 The system already has ALL of your information, EVERYTHING is in the databases. There's ZERO reason for physical paperwork. 🙄 It's just a technicality to let them fabricate BS charges. 5:53 And yet, I've seen numerous cases of cops not showing up to court and their BS tickets being dismissed, but their victim still wasted time and money to go to court to deal with it. 😒 6:09 As usual, the system is specifically and hypocritically rigged against tax-payers and for the cops and courts. 😠 6:52 LOL!!! 😂 No, quite the contrary. In fact, cops SPECIFICALLY TARGET out of town plates specifically because they know it would be too much hassle and cost for you to have to stay around for a few weeks or come back in a few months to fight a BS ticket in court, so you'll just roll over and pay it. It's literal highway-robbery. 😠 8:15 Funny how the "united" states are NOT united when it comes to laws that protect people, they'll just make their own laws, but when it comes to laws that HURT people, they're suddenly united. 😒 9:28 * They follow you around like a naïve misguide and USELESS student-loan FOREVER. 9:56 And since there are INFINITE traffic-laws thanks to the auto-industry 😒, it's pretty much impossible to avoid a cop pulling anyone over at any time for any reason to say you did a traffic infraction and then magically being allowed to do a search and arrest. (Especially since cops are not required to provide ANY proof of traffic-infractions for tickets, they just SAY you did it and the court will accept their word; I've even seen cases where their victims had EXCULPATORY evidence like dashcam footage that they didn't, but the court still upheld the ticket! 🤦) 10:07 It's insane that cops are allowed to STALK people, you know, what's a CRIME for other people. 🤦 If you follow someone else around, you'll go to jail, but cops are allowed to drive around all day, stalking someone, waiting for an opportunity to pounce on them for signalling at 99' or touching the line during a turn or their wheel moving an angstrom at a stop-sign. 😠 Or they'll claim you did a traffic-infraction, but instead of pulling you over right away, they'll follow you for half an hour to stalk you all the way home and into your driveway before doing a "traffic-stop" on a parked car after you got out and went home, so they can rip you out of your house. 😠 MADNESS!!! 10:24 What if my car WAS road-worthy but was damage from all the gdmf trash roads‽‽‽ 😠😠😠 The other day, my car suddenly pulled to the left, nearly into oncoming traffic because the gdmf road (that they JUST repaved) was uneven and messed up! 😠 11:28 Cops aren't pigs, they're dogs. They have suuuuuper great noses. They can smell alcohol that doesn't exist. And if you blow 0.00, they'll suddenly smell weed that doesn't exist. And if you offer to do a blood-draw, they'll suddenly smell pills that don't exist! 🤯 (Remember the recent one of a literal gang of tatted-up cops who pulled over the guy and his daughter and covered the bodycams and pretended to find "burnt foil and white powder" in the car, and the cop said the white powder "looks like Xanax"? 😂) 11:52 PFT! How naïve. If you're stressed, the cop will say that's "suspicious". If you're calm, the cop will say that's "suspicious". Remember how they say that anyone who isn't stressed out in the interrogation room is guilty and that only guilty people can sleep while in jail at night? The police-department? The city? That should be ILLEGAL!!! 😠 There should be some sort of regular inspection to check if there are any quotas and punish them if they do. 15:13 Yup, you get hurt TWICE, you get the primary damage, AND the COLLATERAL-DAMAGE. 😠 It's like if an SAist violates someone and then leaves them with HIV as well. 😒 15:44 The government is willing to drop it if you give them some money, you know, LITERAL EXTORTION. 😠 (It's basically a traffic version of an Alford plea, the most disgusting thing in the jurisprudence-system, a sure sign that the system has FAILED HARD! 😠 Imagine a prosecutor telling you to take the deal because "would you rather be innocent and go to prison for one year or be innocent and go to prison for 20 years?" 😠) 16:35 If you hire a lawyer and pay their exorbitant fees, they will NOT be reimbursed if the state drops the charges or the cop doesn't even show up in court. One way or another, the cop has inflicted damages on their victim. 😠

That HP lied to you. Most speed limit in the USA is 65-70. There's a few section in some states that still has 55, but I don't think they enforce it, cuz we're still doing 65+ in a 55 zone & I never see anyone pulled over. There is a minimum speed of 45, but if you can't do 45, like a heavy slow semi going up a steep grade with 40,000 lbs, then just put on your flashers & stay in the rightmost lane.

Another important thing to remember for the citations in other states, be careful when pleading guilty as your state may have harsher penalties than the one you were cited in. I had a coworker who lived in Connecticut but got pulled over in Massachusetts. I forget the exact infraction (something like unsafe driving maybe). In MA, it was a 0 point ticket so he just plead guilty and paid it. In CT where he lived, the infraction of the same name was 4 pts, and he ended up with a suspended license.

1:22 ask or demand/order though. those are 2 completely different things. I think it should be clarified if it's a "lawful order" then yes, comply. But don't get out voluntarily. 2:48 BUT if they're making mistakes on the ticket then. You can use that to make the police sound incompetent when they issued the ticket in the first place. It won't be a deal breaker but it will help your case. 5:22 It's part of their job and they get paid BUT, it's NOT FUN for them to go to court lol. They HATE going especially if they don't have a strong case against you. Some states they made it illegal for the police to have quotas they have to meet with traffic citation. Everyone knows that. What people DON'T know is that there are still INCENTIVES for them to write a certain amount of citations. If they don't write enough traffic citations then they might not be allowed to patrol certain areas that are more fun than others OR they can get their speedometers taken away and they have to manually catch speedsters with their patrol car. What I'm saying is, if they go to court THEN they have time taken away from them from doing something more fun like meeting their INCENTIVIZED traffic citations. 6:05 for my state, you get ONE freebie to reschedule but you have to do it 1 week before the hearing. You can do it a second time but it has to be legit, like a doctor’s note or something. ALWYAS delay your hearing at least once if you're able to. 14:12 Lol convince the prosecutor to dismiss the case that they're trying to prosecute you for? That doesn't seem right. Only one that needs convincing I thought, is the judge? 14:46 If they refuse to dismiss the case or they try to give you a “deal”, you can actually WAIT to see if the officer shows up before you take the deal lol. If the police shows up, THEN take the deal if you’re shy about defending yourself infront of everyone. If the police doesn’t show up, then the judge might outright just dismiss the case like they did with mine. DO NOT take the deal before the officer shows up lol, that would be dumb because they might not even show up in the 1st place.

The problem is if you follow all these rules, they can still cause you problems... It will cost you money to fight these bogus charges... How do we get that money back? How do we get that time back.

Yup, plus you gotta take a day off work, waste your gas, time, mileage driving to the court house. Pay for parking, while the cop still gets paid, using the police vehicle.

Absolutely do not exit the safety of your vehicle for a traffic violation without a justified reason. Makes me wonder how many of these pro cop lawyers giving advice online actually have these kind of encounters with law enforcement.

This is part of the reason both i and my daughter have dashcams. They also record audio, and because it's a video recording it's admissible in court as evidence. It even records video when the vehicle is off and in parking mode. So, as long as I'm standing in front of or behind my car, the camera will pick up the motion and record the video. I think that this information, that only you possess, is very valuable.
