I used to work at a place where the local PD would work as security. I remember them talking about a guy who didn't want to consent to a search or answer questions, so they decided to waste his time even though they knew he had done nothing wrong... essentially punishing him for invoking his rights. They were laughing about how the drug dog tore up the entire inside of the car, ripping up his seats. These people are crooks with badges.

Thats ridiculous. We need to start suing police departments when a dog destroys our property during a search in which nothing was found.

@@tommyjones6866 , and what happens in that case is they have "qualified immunity." You see, in the past no one has brought a case EXACTLY like it to the supreme court, so the police get a free pass until someone does... which can't happen because each new instance of it happening will be rejected for the same reason. Makes complete sense, right? Boy our legal system is great. Even worse, they can pull you over for no reason, ask you if you have any money on you, and then just steal it (civil asset forfeiture). They get to claim that it is part of some criminal conspiracy with no evidence, and then you have to prove you're innocent (the opposite of how a legal system should work), and often the people you have to prove that to work at the same police station. But nah, go ahead and let them know you're suing the police I'm sure you won't end up on their shit list (this happens every day with retaliation from them; if you don't have money you get fucked by the legal system, and they know it). All of these bullshit "technicalities" that allows them to violate the rights of the people. Fucking tyrants; our rights are above your laws.

Eventually auditors will get to challenging police unions and that is the only area that change will happen. Your Pres Biden tried to remove Qualified Immunity two years ago but Police Unions pushed back against removing QI. The Bill failed.

@@elliottpeabody1287 You're right, the cops actually expect you NOT to know the law, so they can trample your rights, while lying to you and telling you it is legal. However I think you missed the broader point of the comment, which is that citizens MUST know the law in order to protect their rights. The point is that police DO violate rights based on the ignorance of the citizens they force to interact with them.

All they have to do is plant it. Even if cops get caught planting evidence, the case will take at least a couple years and most of the time no disciplinary actions for the cops. Cops are people and people hate being wrong. If you have the power to never be wrong, some will abuse it

​@@miahdavis8331 Problem is, lawsuits aren't the same as prosecution. Even when they lose the lawsuit, the cops don't pay. The departments don't pay. The cops don't face any consequences whatsoever, that's why they do this kind of thing so confidently and freely - because they know they can (and will) get away with it. Until they're actually held accountable for what they do - actually charged, tried, and *_prosecuted,_* nothing will change.

What scares me most about situations like this is that they will "find" drugs that weren't there before the search.

People where they're supposed to be doing what they're supposed to be doing very rarely have any trouble. And they aren't supposed to 'protect you', they're supposed to enforce the law. Protection is a by-product.

I was once pulled over for getting gas after getting off a flight. I was pulled over because it was a “known drug spot”. They wanted to bring in a drug dog if I didn’t consent to a search. I said I did not, and just like magic I was told to drive on. I was followed by a cop for about ten miles. I set the cruise at 3 under the speed limit and just sang along with the radio.

I've got a client who actually said that to a deputy sheriff who'd pulled him over and said he smelled alcohol. My client didn't hesitate and said straight back at him "well it must be you, because I wasn't drinking." No citations, violations or tickets were written that day.

Absolutely true. I've been the victim of false arrests four times. Each time, the cops completely make up the crime and "evidence". In the interrogation room, they like to keep up the whole "Come clean, confess, you'll feel better about yourself" tactic. In court, the judge said, our police officers would never lie. I have zero trust for cops.

Attitude like that will get you in trouble (reference my earlier reasoning for treating all cops respectfully) Instead of handuffing your attorney in court while he's trying to show the cops had no business in what they did to you when he asks him on the witness stand just why was (your) respectful behavior probable cause for him to treat you like a criminal.... One of the first things the cop says is turn your car off and most dash cams shut down when you turn off your car. Best thing to do is set your cell to record before the cop gets to your car so that everything that is said is recorded.

I have taken it a step further and have purchased a body cam off of Amazon. Worth the small investment/peace of mind. I purchased it to capture video/encounters during rideshare/food delivery. I also have two dash cameras in my car. Rear view mirror mounted which records outside to include audio inside the car which also has a rear camera that is mounted above the license plate/wired into my reverse light bub socket wiring, and the last dash camera is mounted on my windshield next to the rear view mirror which records outside and inside of my vehicle. Both audio and video/night vision capability. Rarely do I have any issues with anyone when they see I have all of this gear in place. Florida is a two party consent state so my Uber driver app informs riders that I record the ride for safety purposes. I also have video recording labels on my car door windows so people are reminded BEFORE the step in, If they have a problem with me recording I give the the option to cancel the ride. They shouldn't wait until I get there to voice a concern over my cameras. They should already know I record through the rider app. However, some folks can't be bothered to read and voice their concern after the see it with their own eyes.

@@billbeeb1803 You can ensure compliance by placing the ignition in the position where the electrical system is receiving power. The engine may be off, but all electronics remain active.

sorry, but a cop testifying to the smell of pot is not in any way shape or form heresay. the cop Is testifying to first hand experience. heresay would be someone else saying they could smell pot and the cop uses that testimony on his arrest paperwork.

Smelling burning odors sometimes precedes a seizure. For officer safety, they should be admitted to the hospital and subject to an EEG and full Neurological examination.

I know you didn't mean it this way, but you triggered another reminder of a potential corruption tactic of the police. Claiming to smell marijuana can be the precursor to a Civil Forfeiture of your CASH. Cops can seize your money under the pretext that they believe you acquired the money in the commission of an illegal activity. They do not have to arrest you. In fact, the definitive establishment of their corruption will be when they take your money and let you go.

@@Mike-ib7um, there is nothing about hearsay, that's illegal. Indeed, it is protected by the First Amendment. It is (usually) inadmissible as evidence in court, but it certainly is not against any law to relay, what you've heard somebody else say.

Because people smoke marijuana and drive vehicles. An officer should be able to search somebody’s vehicle if they smell weed. You should never smell marijuana in a car. Why would you be smoking it in it? Smoking weed and driving, is driving under the influence.

Do you know how many folks lives have been destroyed blowing triple zero on breath analyzers? It's pretty easy to say "I smell Marijuana"! Do you actually think that all cops are good? Pot growers are so rampant where I live (Palm Springs) that you can smell it 50 yards before your car reaches their parking lot. My son still laughs at me because I'll say "someone must have hit a skunk" when a neighbor fires some up.

In late 2020, Richardson Texas. My sleep cycle was out of whack due to I served as an Early Voting Judge in the general/presidential election. Extended to three weeks, plus I served as the election day Judge at the American Airlines Mega Vote center. Needless to say I was exhausted and 3 weeks of 16+ hour days. I made a 2am taco run about the 20th of November. A Richardson cop raced up behind me from a quarter mile closing the gap in 31 seconds (per my dashcam rear view video). Dashcam showed my speed of 35mph. Doing the math the cop with no lights or siren had to do over 65mph to close that distance. I made a right turn at the red light/yield sign on US75 toward Dallas. I audible noted the speed limit of 45 on dashcam video. I accelerate to approx 45 (dashcam shows 46). Officer waited then raced up behind me with lights. I pulled over, she claimed she paced me at 60 in a 45, a lie! Then she claimed she smelled Marijuana, I laughed out loud and called her lie out. After circling my car looking for any lights not working she wrote me a ticket for 60 in a 45. I pled not guilty and requested a jury trial. Prosecutor threatened me if i didn't accept his offer of defensive driving it was going to cost me. I stood my ground, 6 months' later trial date came up and I received a call asking if I still wanted a jury trial. I said yes, two days later I received a letter, ticket was dismissed. Turns out Richardson receives money from State Farm Insurance to write tickets that can be dismissed via defensive driving. No, conviction needed.

You've discovered yet another of the "cash registers" in the Traffic Court System. Lie as they want, it's ALL about municipalities extracting a "user tax" or "street tax" out of drivers. It's nothing short of outright theft and it takes other crimes like signing falsified statements that become court records (the ticket) and perjury to get the money. And these are the crimes committed by the police.

I had sort of a similar incident,my car was set on cruise at the speed limit at 50 dash cam said I was doing 50 as well..A cop chased me down they must have been doing 100 to close the gas that fast..They were driving opposite direction they had to slow down and and do a you turn on a tight 2 lane rural hwy with ditches on both sides.. Again oddly it was a female cop and she said I was doing 70 in a 50 zone,I laughed and said I have my car set at 50..She then forgot about the speed and asked if I had anything to drink? I said I stopped drinking in 1996(the truth as young 20 year old)..She then went into her car with my license and came back and said okay you can go ..WTH!!

When I was 17 ( I’m 64 now)I was pulled over for speeding 41 in a 30 and I basically did everything he said not to do lol 😂 Cop asked me do I know why I pulled you over I said yes I was speeding he asked do you know what the limit is I said yes it’s 30 finally do I know how fast I was going and said yes 41 and he said in a surprised voice Wow exactly. After checking my information he came back and said slow down and let me go. I was shocked 😳 and went on my way and this encounter stuck with me for years. I ran into him again several years later at a restaurant and said you probably don’t remember me but you pulled me over when I was 17 and you let me go with a warning and he remembered and told me the reason he let me go with a warning was people he pulled over that day constantly lied to him and it frustrated him and when he ran into a teenager that actually told the truth he couldn’t possibly give me a ticket because my honesty surprised him. Ok this has absolutely nothing whatsoever to do with the odor of weed but it’s a nice story that I have remembered to this day

My first question is why are police officers even doing Traffic Stops ? Traffic Stops are NOT crimes ! You don't go to jail or prison for Traffic Stops ! All Traffic Stops are a VIOLATION of The Constitution ! You have The Right to Travel Freely on State and City Highways and Streets, without being molested by Government Officials, Unless you've committed a crime. Traffic Stops are NOT crimes !

Some states, it’s actually on your license. Here in MD refusal to search is grounds for 3 days impoundment and refusal to a breathalyzer or FST is an auto suspension of your drivers licensee. Simple idea, don’t have pot in the car.

When I see a cop following me I slow down about 10 under the speed limit. I'd they don't pass me right away I pull off the road as soon as I can. Still a couple times the cop pulls in behind me. Usually they say "do you know why I pulled you over". But since they didn't pull me over they can't really use that one. So they say something like "is everything OK, why did you pull off here". So I just say "I am fine, some ahold was tailgating me and it didn't seem very safe. I thought if I slowed down he might just go around but now he is talking to me."

Had a cop follow me once like that. Before he could find something to stop me for, I pulled over and parked on the side of the road and got out of the car as though I had just arrived home. The cop said something as he drove by, but I didn't understand what he said. As soon as he was out of sight, I got back in the car and drove off.

Something similar happened to me. I was driving down a highway when I noticed a cop car behind me without lights or sirens. I was in the left lane and moved over to the right. Guess who followed me immediately. We hit a stop light and there was a gas station immediately passed it. When the light turned green, I pulled in and gassed up. Never saw him after that.

@@r0bw00d I have a better one. I was racing down a dirt road in the countryside when I came over a hill. At that very moment, my radar detector went full on. The hill had hidden the signal until the last moment, so I knew he had me good. And at the time, I hadn't yet renewed my vehicle registration. I looked in the back mirror and saw him having a very difficult time making a U-turn on that road and I knew he was making it for me. Lights not yet on. A short distance away was the highway which went into his small town. I made a right-turn unto the highway into the town, made another right-turn, and another and eventually parked into a mobile home park and got out and went for a walk. It was already dark, so I knew he lost me. He never did find me... I waited a while before I got back in the vehicle and drove away.

I've done this on two separate occasions. I pulled into a stranger's driveway, got out of the car, and started taking things out of the backseat like I was bringing it inside to my home and the cop just drove off. The second time it happened the cop stopped in the street in front of the house whose driveway I pulled into, seemingly calling my bluff. I must have been the luckiest guy in the world because I grabbed some random items out of my trunk in hopes of him driving off, but he didn't. I walked up to the door with my box of random crap and rung the doorbell. An old man answered the door and I told him I was a friend of his son, and that I had some stuff for him, so he let me inside. I saw the cop drive off through the window, so I left him a box of old rags, a tow rope, and a few bottles of 10-W30, and thanked him for making sure his son would get it. Thank God this nice old man had an adult son. It's a shame that a guy can't transport a little weed in his vehicle without having to worry about going to jail.

I had an officer make eye contact with me and immediately made a uturn to get behind me and pull me over and search my vehicle. No citation. He literally said he was fishing and let me go. Driving while black is a real thing.

Cops are millions of people and everyone has his personality, culture, biases and virtues. I find really offensive when a entire category is labeled as X. This way of thinking is the same used against black, Jews or whatever other group of people. If you dehumanise an entire group of millions saying they are racist, corrupted, etc you are not different from people saying all black are criminals, dangerous and blablabla.

I’ve been pulled over 5 times in 4 months. I smoke no weed, so it always makes me nervous that these people who are here to “protect and serve” pull me over when I have no way to know what I did wrong. Then they will ask the “why you look nervous” bs. Everyone is nervous around strangers who force someone in a situation they didn’t ask for.

Around 20 years ago my super square boomer dad was drving in rual texas and got pulled over. The cop said he smelled marijuana and my dad was absolutely shocked and shouted YOU DO NOT SMELL MARIJUANA IN MY CAR!!. The cop immediatly backed down.

@@wecvgb9 With slander lawsuits, you usually have to prove damages. Then on top of it, you have to prove the cope was intentionally lying and not "mistaken." In other words, you're going to spend a lot of time and money and you're still probably not going to win.

@@wecvgb9 There is case law that you cannot file a lawsuit against a cop, even if the cop acted outside of his legal authority. Once again, you have to know the law and abide by them or face consequences, but cops do not have to know anything and they are protected. The worst they ever get is fired, and that's few and far between anyway. With no repercussions from illegal activity, there is no incentive to change.

A cop outside Indianapolis did this to me in 2009. I was moving across the country and just passing through. My car was packed with my belongings and the cop was a real piece of shit on a mission to ruin my day. I was 24, clean-cut, and hadn't broken any traffic laws. He claimed that I didn't use my turn signal while changing lanes, which was false. I've always been religious about using my turn signals. He claimed he smelled pot and got the drug dog. I didn't have pot or any other drugs on me, and at that point hadn't smoked any pot in years. 3 additional units showed up with the lights on, lined up behind my car. He and I almost got into a violent altercation on the side of the road, because he was a lying petty tyrant, and I wasn't doing a good job of staying calm after 40+ minutes of that crap. Luckily for both of us one of the other cops was a woman, and she got between us. The whole thing ended there, and I wrote a letter to his boss documenting his actions. Unfortunately he was probably pressured or trained to act this way by his bosses.

I"m pretty conservative and just got done jury duty. But I was really surprised at how many officers "smelled" pot during a traffic stop only to find nothing or meth or mushrooms. I'm really skeptical now about the police there is no way they smell pot on that many stops. We do really need to change some of these laws.

If an office tries to use this as an excuse to search your car, ask him why he smells like beer. The legality of that search is already gray at best and now the bodycam has an accusation of the officer being drunk on duty. The whole case against you in now compromised.

The problem no one goes to the police station to fill out a complaint form. So they continue to do the same thing. They were doing in Baltimore all the time especially if you’re black. Once the interaction is over people just go on with their lives. I give it to white people if someone wronged you, you’ll write corporate or who ever to complain.

If a cop ever tries that with me, we're going to have a good time when it goes to court. Since the dog is the one who supposedly found "evidence" I would require that the dog be present in the courtroom. At the traffic stop I would watch the cop like a Hawk to see/hear the signal he gives the dog to make him "alert" on something. Then, in the courtroom, I will get the dog to alert on every member of the jury, the bailiff and the judge. How can I do this? I've successfully trained dogs for search and rescue, and to "find" things. I know that it is easy to get a dog to "alert" even when it should not happen. In the end, I will be suing the PD this cop works for and then bring charges of my own for false accusations and filing a false police report. It will become my life mission to make this cop, and whatever family he has, homeless - on the street.

Your true natural rights are not "created" by legislature, politicians or even lawyers. They are and have been from your conception all natural. They cannot be taken away. If you fail to assert, and assert in a timely manner you have no rights. You can scream and pitch a tantrum all you want. You don't have them. Then it is considered to have been waved and you are barred from asserting them after they've been waved.

At traffic stop costs the driver nothing, a citation/arrest costs the cop nothing, fighting in court to protest the accusations made by a cop often costs far beyond what driver can afford. Our system of justice does not normally favour common people.

Well, here in Alabama that's a phrase they LOVE to use just to search your car. Got stopped by a roadblock last year on the way home from work wanted to see my ID and said he was doing a sobriety check...OK cool, gave it and when he gave the ID back his head was almost through my window and said "I am smelling weed, you got anything in the vehicle I need to know about?" now, mind you I had stopped smoking 3 years ago to this incident and I never smoked in my car. So I said no, he then said sit tight we are going to do a free air sniff with the dog. Had the dog run around my car and it scratched up the side of my car on passenger side. They said the dog alerted to possible narcotics and had me step out at 3am in handcuffs sitting on the bumper. They tore my car up from floorboard to ceiling including trunk and popped my hood and checked everywhere in the engine. By the way, I didn't have anything at all. They never found anything, uncuffed me and released me and I went to court to see who would pay for the scratches on my car and the judge pretty much told me tough luck, if a dog alerted then scratches are to be expected and covered at my own cost. I mean its nothing to buff out some nail scratches but the fact that I had nothing, dog didn't alert to shit and had me go out my way to buff them out SHOULDN'T have been my problem to start with.

I keep my registration and proof of insurance in the visor above my head. If I get pulled over, I pull out my license even BEFORE he gets out of the car. That way I have the 3 required items to hand him through the crack. My cell phone is usually on a mount on the dash (so I can use it as a GPS) and I turn on the video, flip it to the front facing camera, and start recording. I don't have to inform the officer of the recording, it shows that I am calm, what he is asking, and shows the date and time and length of the recording. Also, with regards to cell phones, NEVER use a finger print, ALWAYS use a pass code. They can't force you to divulge and unlock your phone without a warrant.

I was riding in a friends car and we went through a DUI checkpoint. The car stunk like weed really bad. I thought we were screwed. This was in Colorado before it was legal. Nothing happened though. They were more worried about handing out Mothers Against Drunk Driving pamphlets than anything else. Not a word was said. very strange

Something needs to be done about the too frequent abuse of "I smell the odor of..." and the "we got a call". It is obviously part of the training, along with "quit resisting" that I've seen them start yelling before anything has happened and there was not even a hint of it about to happen.

I used to live in Pennsylvania and there were two bad neighborhoods I needed to drive through on a regular basis due to friends and work - every time I was pulled over, always for bogus reasons, the officers supposedly smelled pot - they clearly said it so often that you could tell that it was a reflex on their part due to the tone they used. There needs to be some sort of law that if a cop uses that excuse for X number of searches - fewer if the people they're allegedly smelling pot have no record - but find nothing, they should be disciplined or fired.

I lived in Lima Ohio and had called a friend for a ride. We got pulled over cause he said they went over the white line. I then said whats this really about. He then stated that he seen me getting picked up and asked if there were drugs or weapons in the car. I told him i had my medical marijuana medicine on me. He then asked for it. I told him no. He then put his hand on his service weapon and told us hands on the dash. He called for back up and brought the k-9 in. They basically took my medicine and told me to go home so basically i got robbed by the police department. Paying $250.00 for the marijuana card and taxes on the medicine doesnt mean shit. They can do what the fuck they do and get away with it

As I walked in the main entrance, at 2:30 in the afternoon. There was two young guys smoking a joint right in front of the entrance! That is actually illegal...

If an officer claims they smell pot they should have to take an air sample that's sealed in a bag to be tested in a lab. If the lab can't confirm everything should be thrown out.

If a cop is caught lying in court, they can be added to a "Brady list" and defense counsel can find out if the involved officer is on it (but the public cannot see a department's Brady list). The most interesting thing about this is that cops who testilie are put on a list, not fired.

First of all NEVER ROLL your windows down more than a crack. I totally disagree with “Giving “ them anything. Law states your only have to present/show your information not give it. They will refuse to give it back and hold you hostage by holding your information until they finish doing all of the illegal stuff. I’ve had this happen to me and had to go to the police station the next day to retrieve my license and insurance information because cop left without giving it back, therefore stranded be on the side of the road and try to ticket me for without a license. 8:25

1) i was in a private parking lot at the rear of the building next to my residence parked in my car w/ my gf so we could have a private conversation. a police officer pulled in, claimed odor, and searched us. (no contraband in car, hadn't smoked in car at all) 2) i was in an ollision with a tree driving sober from work on NYE, in the middle of the woods. without call, a police officer showed to the crash scene, and claimed dead pine needles on the passenger floorboard appeared like marijuana. he searched my (clean) car. both of these anecdotes are from a time and place of criminalization.

I live in a legal weed state and in the last 10 months got pulled over and ticketed for speeding and both cops said "i smell marijuana in the vehicle...please step out so i can figure out if its YOU or the car. I got out, answered a few questions (sobriety test) answered accordingly. Got back in my truck, got my ticket and was on my way. Lit my joint back up a couple miles down the road.

Growing up in the most corrupt town this is something I dealt with so much that I stopped getting nervous around police even when I actually had reasons to be nervous . I got pulled over 19 times in one year by the town I grew up in. The never had a legit reason to pull me over but they always claimed they smelled weed. When the k9 would come they would walk around the car and the dog would indicate to nothing . They would pull on the leash and then say the dog indicated and they’d search the car . Not once did they find anything. . Had me so sad growing up as a mixed man in a crooked town i thought about hurting myself because they made me feel stuck . Thank the Lord I got a good job and it helped me get my first apartment on the other side of the state and I haven’t been messed with ever since .

The corrupt cops show how much they fear accountability by whom they harass. I.e. a homeless guy is pretty vulnerable just about anywhere. I can't imagine some 20 year old local cop giving me a hard time over nothing while I'm sitting in my SUV with the dashcam recording 4 channels with GPS. Not that I have any special power here, but he doesn't know that. He sees a guy older than his father, that may well know his father, who would absolutely sue the shit out of him for a bad search, just out of spite. You never know which old guys might be a judge without the robe on, or play golf with the county commissioners. Corrupt cops would still fear that. That guy getting beat up by police might have friends other than criminals.

Exactly. Many people lose their security clearances or license to pilot and then their jobs. This makes it even more impossible to get justice when you first have to get by qualified immunity of the cop, DA and judges.

Nobody can prove whether or not they smell an odor, it entirely subjective. Therefore it should never be considered probable cause. Because the officer can not prove in a court of law that s/he smells something. If they don’t directly see it, it is NOT probable cause. Not only that but even if you smell something, it’s no indication of where the smell comes from. I work near a dispensary. Depending on the weather and direction of the wind it often smells as if my work is a grow house, while it certainly isn’t.

Never give consent to search even if you have nothing to hide. If they force the search without a warrant 4th amendment lawsuit for unlawful search. If you do have something just make sure nothing is in plain sight (plain sight doctrine) and refuse consent to search. then they have to get a warrant which ain’t gonna happen just for smell

I work at a local gun shop and know a lot of cops as a result. The local deputies have told me that they are no longer allowed to use a the odor of marijuana as probable cause. Idk if that’s codified or just departmental policy but this is in Pensacola Florida.

I wish this lawyer would mention the know inaccuracy of canine “alerts” - how many times they get it wrong in training scenarios. Also, the well know fact that a handler ALWAYS has several means through which to have his dog “alert” whenever he wants it to.

2 years ago I was pulled over for going 51 in a 45 zone in Texas. The cop asked me to step out of the vehicle and said, “do you know why I asked you to step out?”. “There was a strong smell of alcohol and marijuana coming from your vehicle “, he said. In disbelief, I shrilly exclaimed “what!”. I was shocked as I’m not a pot smoker and no one has ever smoked the stuff even near my vehicle. He then said, ah…I misspoke. In my opinion he didn’t misspeak. That was his training kicking in before his brain could stop it. What a bunch of bullshit! Cops should be criminally charged and punished if they lie. Our legal system is a sick joke and I’ll bet the founding fathers are rolling over in their graves. And bye the way, I just got a warning ticket.

I had a similar thing happen. They even got the damn dog. Then, when they didn't find anything, the cop's "explanation" undermined the whole point of drug dogs. He told me somebody had probably smoked near my car and the scent attached to my car. Great. So anyone who's driven through downtown Austin now has that scent on their car forever, making the drug dogs useless for detecting cars with actual drugs. Cops are amazing dumbasses. They have become what the founders were afraid a standing army would be. A militarized force against whom citizens have almost no recourse.

This is a good point at 9:20 I had a traffic stop at one time in which I did not say one word to the officer, not a single word, and let me tell you it aggravated him. He tried to engage in small talk (nothing) he asked for license/registration (I silently gave it to him, he asked why I wouldn’t talk with him (I kept my mouth closed). He was visibly annoyed but didn’t escalate and of course I got the ticket (as expected). I thought that if I didn’t have to talk with him I wouldn’t. I wonder if simply being silent could be seen as “suspicious” and be used as probable cause for search or arrest? I wasn’t but could I have been?

The odor on burnt Indica is only indicative of personally consumed weed. Traffickers hauling hundreds of pounds illegally have large bricks/bales…none of which should smell burnt. So clearly the assertion of that odor is a mere fishing expedition.

In Mississippi i was stopped for no tag light. The officer asked if my old fines were paid up and i said yes. The officer came back to my truck and asked if I had no unpaid tickets. I said yes i was sure. He went back to his car and returned again asking the same question. I said whats going on? He asked to search my truck. I said not without a probable cause. He said "get out", i asked why? He said because i was going to jail for disorderly confuct. I went to jail for failure to comply, no tag light, and no proof liability insurance after a search with dog found nothing. My tag light was shining bright. I could see it from the back seat of cop car as truck was still running during search. Cost me $235 to get out of jail the next day and $285 to get my truck back after it was towed to another town.

@@alrino9820 three years ago I got pulled over in my car (different vehicle) for no tag light. I consent to a search knowing there was nothing illegal for them to find. I got arrested for possession of marijuana in a motor vehicle. At court I plead not guilty and wanted to see evidence. There was no evidence so the charge was reduced to just simple possession, like I was done a favor. I had none to begin with. The first thing I did when released from jail and found my car was attempt replacing tag lights and found they were fine, didn't need replaced.

If you want to stop the cop cold, just ask them if this a investigation if yes, stand on "Miranda rights," you have the right to remand silence, you have the right to a arurny and if you don't have the money for one ,will be assigned one, anything you say ,can and will ,be held in a court of law " by the Supreme Court they can't hold you for more than 20 minutes for a simple traffic stop . If they are waiting for a search dog 🐕 doesn't matter as it isn't more than 20 minutes after 20 minutes it is your right to drive off. Otherwise, it is a violation of undue sirch . Under your 4 Amendment rights. They have to tell your morinda rights before ,anything past ,driver's license, registration, and proof of insurance except, check for weppons. I would add a step to the procedure outlined starting at 7:52. You should ask the reason you were pulled over. If they do not have or refuse to provide a reasonable articulable suspicion that you are involved in some illegal activity, there is no legal basis for the stop and you are not obliged to identify yourself or to provide paperwork.

However I first must search him to prove he is not going to plant anything. He started to get VERY nervous. Even tried to let me go but I kept pushing A LOT the supervisor shutting down everything sent me on my way .... I still want him searched

“It doesn’t matter if they are lying if you the driver have nothing to hide”. Typical response of someone who doesn’t understand the bill of rights. It does matter and the cop was looking for an excuse to intimidate and search the car without a warrant.

But not until after he put more than twenty people in prison for several years. Some of them served their entire sentence before this monster got caught. This is the whole point of the Constitution. To prevent this kind of garbage. Wake up

9:47 I've seen a few bodycam clips where the officer will tell the driver they're "free to leave" while refusing to return the driver's license after repeated requests. How are you supposed to handle that?

I had a cop pull me over for a bogus seat belt violation. I argued it with him because there was no way he could see if I was wearing it or not. Then he said 'I think I smell weed ' I just laughed at him because I don't do drugs. He gave me a 'warning' for the seat belt.

I’ve had something similar to this happen to me, as an ex Pinkerton. The difference being was that the cop stated my car had a strange order, and that he asked about all the grass clippings on the floorboard of my car. I should note I live in BFE Texas, a state where you stating you're exercising your right to remain silent is often taken as a sign of guilt thus giving probable cause to search. Needless to say, that cop got a proper dressing down right there about his lack of training in drug detection and traffic enforcement. Think he was especially confused with my outburst of laughter of his confusion of lawn clippings and chat gravel, which prompted his dressing down. I do not recommend doing what I did that day, but there are times and ways to get a cop to drop the issue that are better then fighting or remaining silent.

What's to stop all cops from saying they smell weed outside your house or car to be able to search it without a warrant? It makes no sense that this would hold up in court if nothing was found in a search. ALL searches should involve proof of wrongdoing and a warrant.

Your home is a different matter. The courts allow a lot less wiggle room to enter a house without warrant. That said a persons vehicle can be their home as well legally if it's their primary residence. Though this is from memory and not legal advice as I am not a lawyer.

You gave awesome advice. I'd suggest a jury loves video; So, get some video. Record it to your cellphone while the phone is locked is always a good idea. Ask "is your body cam on?" It prompts the officer to check and usually they will turn it on if they haven't. Honest officers understand the body camera protects them as often as it protect you. If it is a bad apple then you just got them not turning on their body camera on video/audio if you were recording. Its hard to testify "I forgot to turn my body cam on." when you have a recording of them being prompted to do so. I'm shocked at the number of police that forget to turn their mic on for the car's camera. My local town has a policy in place they should be and they even are supposed to tell you they are recording. If the officer says they smell something, challenge that on camera if they are making it up. "Respectfully officer no you do not smell xyz". The jury will get to see that on the video and you don't have to testify to get it on the record. Don't be combative just get the statement on the record. It is very hard to prove what an officer smelled. So, they feel empowered to smell things real or imagined. Any at the time proof you can offer a jury or a judge is a good thing. There is a funny case where the officer claimed to smell weed while his windows were up and AC was going and the Other car's windows were up and the AC was going. The judge all but called the cop a lire.
