I think the way the law is written the shop owner went outside the store with a gun to stop someone who had already left the store even though we see the perpetrator kicking at the door. The way the law works the shop owner would have to be attacked and left no choice but to use the gun to save his life. In the video it's about saving property not life. That's why when one owns a gun within the city limits of NYC they must be aware of the correct procedures when to pull out that gun to use it. The way the DA sees it that bullet could have struck an innocent person passing by so she sees this as being reckless.
