A lot of times in a case like this, the DA will not make an offer. The defense would have to make an offer. Unless that offer were in the neighborhood of 40 years in prison (or possibly more), the DA wouldn’t accept it. As you can imagine, it can be a challenge to try and convince a client that they should take a 40 year “deal”. So if the DA and defense can’t come to an agreement, the case has to go to trial.
