Honourable Sir, first of all thank you very much for the informative video , Sir I want to ask you one thing, in case if there is no delivery of property of any goods, money etc whatsoever in the entire episode and also the accused is shown as VICTIM in the charge sheet after the final investigation by the Police, Kindly let me know, do the accused still have to face the trial for this false case under section 419 IPC and 420 IPC which is falsely implicated by police on him/her? please do let me know Sir.

Q1 .Whether in summon case formal charge framing is done by a magistrate?Q2. counsel is given oppurtunity to argue on charge in summon case? Or magistrate directly proceeds for PE in summon case?

In summons case there is pre charge evidence prior to arguments and framing of charge and thereafter there is again PE. However where there is framing of notice there is no opportunity for arguments on framing of notice. There is difference between framing of notice and framing of charge

Arguments on charges kaise karein? Do Lawyers actually argue on charges ? Do judges actually entertain arguments on charges or just listen and still frame charges?

In my personal opinion one should argue on charge when then there are bright chances of getting a discharge... Otherwise prosecution will get to know all the lacunae of the case and will try to cover them up at the stage of prosecution evidence... However if there is a good possibility of discharge then one should definitely argue on it and yes courts have in many cases discharged the accused at the stage of charge
