Nelson should have lost the tower early on; the activated ability on Idle Thoughts can be activated at any time. The ability only checks how many cards you have in hand on resolution. He didn't activate it the turn he played it, nor did he activate it each turn after, whether he had cards in hand or not, so that's a loss.

Actually, the ‘ intervening if’ clause means he would be unable to activate the ability without fulfilling the no cards requirement. If means it checks on activation and resolution.

@@TheGamblingisgood But the ruling on Gatherer states that "You can activate the ability whether or not you have any cards in your hand. However, you'll draw a card only if your hand is empty when the ability resolves." He could have activated it, regardless of if it did anything.

For those curious, in full Judge's Tower, you are supposed to activate each activated ability once per turn "for each legal target". Meaning, it tests you in not missing any legal targets, and not, in your rush to make sure to use it on an illegal target. So for example, if you have an equipment, you must each of your turns (and each of your opponents I suppose if you have Leonin Shikari in play) equip it to each creature you control. And if you have a creature with Shroud, you would lose if you try to equip to that creature.

Yes and no. The Thoughtflare should be above the discarded cards, yes. But if an opponent in the game doesn't catch you, then you're fine. This game is "Its not cheating if you're not caught."

Well for one thing, you don't lose unless someone catches you. And in addition, these guys are playing a variation of Judge's Tower -- there are several differences, like losing instantly instead of getting points and not having to activate all of a creature's abilities -- but the one that matters here is that they each have their own graveyard instead of sharing a graveyard (which makes a lot of sense when you're not playing with shame points). So no, he wouldn't have gotten a recover trigger, since recover says 'your graveyard.'
