She should be charged with the murder of Brian Sicknik. Anyone participating in the commission of a violent or inherently dangerous felony which, through the actions of himself or any other participant, results in the death of another is guilty of murder under the "felony murder rule" which has been part of our law for centuries. Plenty of folks are on death row or serving life sentence now because they took part in a robbery, kidnapping or home invasion resulting in a death, even though it was some other participant who pulled the trigger or wielded the knife. Not charging any insurrectionist with murder under this rule is showing him or her special favor.

If you were (in) the U.S. Capitol the day the rioters gained entry by force, did damage of property and people were injured and deaths were reported, and you were not legally authorized to be in the building, is enough for Federal charges even if you were just a bystander (in) the building. The difference between the riots of George Floyd's death (is) the damage to buildings and theft of property were not Federal buildings but rather privately owned buildings.
