We said in the community post that we put out that this video may infuriate and shock people. It surprised us when we looked into it just how seemingly crazy and wrong the law perceived marriage back in Victorian England and how much power a husband had over his wife.

I know here in America , the name on the stone is decided by the one that bought the stone . The maiden or preferred name can also be added along side the marital name . It all depends on who has bought the stone .

As a child St. Mary’s churchyard in clitheroe was my playground and prospect house was the local vets. I sometimes went in that house as I was friends with the daughter of Mr Tindall the vet. Crazy to think about the history it held.

Here in Ireland in 1970s my mum had to go to the high court to get my violent father out of her family home.That was nearly a hundred years after this case,but like Emily she did it.This is such a professionally put together channel,well done to you both .

@hidaburger64... In the U.S that is what is considered part of 1's Constitutional Rights. Even tho a person may have been charged with DV, they still have the right to be represented by an attorney, in a court of law.

Thank you for this, really enjoyed it. May I suggest an idea for a topic? I was once told ( I worked at Whittingham Hospital, Goosnargh, in the 1970,s) that husbands could basicaly lie and 'manufacture' a diagnosis of insanity in their wife and get her 'put away'. At that point she ceased to exist as a member of society and that the husband could then, if he was so inclined, could remarry perfectly legally. This may have been bit of overdramatising of course but then, maybe it wasn't. I had plenty of patients there who were 'put away' for what now would be seen as trivial reasons.

Hi Robert, I've just had a quick search and found one small news report from 1956 and a Thomas Wilby who was granted a decree nisi on the grounds of incurable insanity! His wife was sent to Whittingham. There could be a story in these cases.

Thanks for another enjoyable video, this time from my hometown. Yes I've heard about this story but only recently. I don't think the case is that well known in Clitheroe though it was obviously a major incident in its time. It's hard to believe that laws like that existed up until the late 19th century. It was a time which is often referred to as "The Good Old Days" but that wasn't the case in so many instances.

If I remember correctly, Im sure Hartley, her brother-in-law was a lawyer (or solicitor) and it was because of him and her sister, Betsy, they were able to look into habeas corpus knowing full well what Emily's rights were. It was still a battle though to convince the courts!

What is significant is the British government's destruction of historical files. Historical events, records are now being destroyed, if storage was/is an issue they could approach the Tasmanian Government in Australia as Tasmania has the best environment for storing textiles & paper goods in the world (it's due to the climate). Tasmania has room (space) and climate to establish an archive worth travelling to.

Yes we have had disorder in Leicester I'm only 8 minutes away from the city centre but it didn't come here the only disorder I normally get is when Leicester city play as I'm 4 minutes away from the stadium or Leicester tigers as I live across the road from them. Given that Emily had considerable wealth of her own, she probably had some very well connected members of her immediate family, one would wonder what if any influence they might have brought to bare on her behalf, or were they afraid of the negative social stigma of Emily’s situation and support for the status quo that might be aimed at them. If three men tried to force my daughter in to a carriage they too would need to set up a “go fund me page” not for legal expenses, but to pay their medical bills. Indeed this story brings in to question just how good the “good old days” were…goodnight Emily you were a shining star in the fight for equality for women.

It's interesting that we often think that in Victorian England is a more Godly society but beating your wife and treating her badly is definitely not a biblical pattern Ephesians ch 5 verse 25 - 29, 1Peter ch3 verse 7 Colossians ch 3 19. There are more. Men are called to treat there wives as a weaker vessel not to be treated like a dog.

That Betsy may be the mother’s mother. So, Emily’s grandma. I’ve noticed a lot of times mother in law’s getting buried with their daughter’s family. A few sets of my great grandparents are buried with the wive’s mother by them. Very interesting.

Many thanks David for the kind words. The stories can be very heavy at times, as we often struggle to cover some of them. Especially the recent one involving Margaret Allen in Rawtenstall. We are sorry to hear about your health and fingers crossed you get better soon! Only recently, we spoke about doing something on Sherlock Holmes!! We want to do something on the whole subject but not like what other channels have done so far, so please keep an eye out for what we do have planned. It might not happen soon, as we have a holiday already booked and time off work is now very limited. But yes, we have something special planned on Sherlock Holmes.

A very sad story, handled with care by yourselves. Was it premeditated? Was money the reason. As you say, Margaret/Bill had lost income. But we don't know what was discussed between them and why it ended in Nancy's death. As for the punishment, I'm not sure.

Not defending Bill (or Margaret), but I think the years of being bullied, talked about etc, 'may' have had a bad effect and in the end, he/she just snapped. Like I say, Im not trying to excuse what happened and as many have said, all those blows to Nancy's head was way over the top. Also, what did happen to the money that Nancy used to carry around with her? More than likely Bill/Maggie took, but it was never found.
